I contest the city's citation on the following grounds: Use of ambiguous language of the city and lack of specific information on the citation. I contest the citation on the use of ambiguous language on the Outside Water Use Restrictions flier. English is my second language, and I firmly believe that the wording on the restrictions is ambiguous. Bullet point number 4 (not dated) reads as follows: "Hand watering (hose must be attended) of plants, and children's water toys, when in use by children, are not restricted." According to dictionary. com, a plant is defmed as: "any member of the kingdom Plantae, comprising multicellular organisms that typically produce their own food from inorganic matter by the process of photosynthesis and that have more or less rigid cell walls containing cellulose..." This strict botanical definition is the basis that I used to justify hand watering my grass (which is a type of plant) on July 1, 2007. The city never clarified their definition of a plant to exclude grass. Secondly, I contest the city's citation on the lack of specific information on which provision was violated. On the administrative citation that the city issued to be on July l, 2007, the notes section states "independent sprinkler, odd/even water restriction violation." I firmly deny using a sprinkler system on odd days. Furthermore, the citation does not state clearly by whom it was issued (only the initials J. H. are written). Since there is no stated title of the issuer, I do not know if this person is a city official, an officer of the law, or just a zealous neighbor. Thus, there arises the possibility that I was issued the citation on the basis of hearsay (which has no legal justification). Since no city official confronted me on this matter, the burden of proof rests with the accuser (the city). In conclusion, I wish to request an administrative hearing and\or an immediate dismissal of this case on the basis of the city's use of ambiguous language, and the lack of specific information on the citation. I have new strip of sod along my driveway and was told by the people who put it in and the association to water it twice a day everyday for two weeks. I have only been hand watering it once a day instead of twice because of my work schedule and usually at night around 8 pm. On this particular day, I was hand watering earlier because I had a meeting for work in the evening and at the time this happened I needed to go answer the phone for . my job. I set the hose on the end of the chair I was sitting in, to continue watering for about ten minutes while I was on the phone then came out and continued to hand water for about ten minutes longer. In the course of that ten minutes, I received a citation. I know there are no restrictions on hand watering and being I do not have a sprinkler that's what I have been doing. I really didn't think that putting the hose on the chair for that period of ten minutes would have been an issue. I do know the water restrictions and abide by them. Normally I do not have to worry about watering anything because the association takes care of it, but in this case they replaced sod that was damaged by people working on the irrigation system and I was told I was responsible for watering it for two weeks. Please understand that had I known that leaving the hose on the chair for that few minutes was going to be an issue, I really would not have done it. This home is a showcase home for us and a source of revenue to the City of Farmington. . Sprinkler systems, water bans, odd-even days of the week that we can or cannot water, and hours of the day we can or cannot water have caused many headaches for builders in all communities, not just in Fannington. We have tried to abide by the rules of the city, and have the water sprinkler company set up the system accordingly to your schedule. Real estate agents go into the models on different days and times - yard seems dry - and touches the system to get water-and we are out of schedule with the city. We have only been watering 3 days a week, but poOssibly not always on the correct day. \V c do apologize for this and are asking that these fees be eliminated for us. We purchased the home at 19953 Desmond Ct on July 27. There was new sod in the front yard that was in poor condition. Only a portion of the front yard had been replaced, and was replaced two days before the purchase. The builder informed us that we could not run our irrigation system between 12 and 5, and that there was an odd/even watering restriction. It was our understanding that these restrictions did not apply to newly sodded areas. We were misinformed. On both July 28th and Au~st 3rd we were issued citations for watering at the wrong time. Unfortunately, we did not begin receiving mail until August 2nd. The carrier did not know where to leave the mail, and a temporary box was not used until this date. We finally received and read all of our mail on August 4t\ at which time we found the . first citation along with literature stated exactly what the watering restrictions were, along with the requirement for a special permit to water outside of the normal times. We immediately ceased all watering activity that did not comply with the restrictions. I can assure you that our violations were completely unintentional; we thought it was perfectly ok to water new sod outside of the allowed times. I am pleading with you to please release us from any financial liability for these citations. We are new residents that were mis-informed of the rules. We look forward to living in Farmington, fully support the watering restrictions and intend to respect all such rules and regulations. Which I have included with this letter. I would like to explain the situation and have the fine dropped. I have an automatic sprinkler system for my property and it is scheduled to start at 6am and 8pm on the even number days. Up until this incident it has been fine, but we had a loss of power on the 12th of August which caused my control box to reset. It then reset to the wrong year causing it to start up on the wrong day and wrong time. I have now turned off the automatic timer box and will control it manually so this doesn't . occur again. I have lived here for 4 months without any other issues and understand the importance of the watering policy. I would not purposely have broken it. I hope that you understand that this was unintentional and I have taken measures to correct this so it will not be an issue in the future. From: Wendy Conboy RE: Bristol Square 5th - MW Johnson Water Use Restriction Violations On Sunday, July 8, 2007 while on water patrol, I witnessed 11 independent sprinklers attached to 11 hoses connected to 11 different units. I issued citations and put them in the mail Monday morning and I also called Luke, the job superintendent for MW Johnson, and left a message for him to call me to arrange to get a Water permit for Bristol Square 5th. When the violations were called in on the afternoon of July 9th, I called him again and asked him to come in for a permit and that even with a permit they were not allowed to water between noon and 6:00 pm. I informed him that he already had 22 citations. I also left a message at the MWJ office with Linda Walch. On July 10th I got a call from Linda Walch to arrange for a permit by FAX, and a permit was issued the morning of July 10th. I explained that no watering was allowed between . noon and 6 pm. After 1 :00 pm on July 10th, after 14 more violations were called in to me, I called Linda Walch and told her that they needed to turn off the sprinklers immediately, which they did.
