Approval of Minutes a) August 11, 2009 Regular Meeting Minutes b) September 9, 2009 Regular Meeting Minutes c) September 15, 2009 Special Meeting Minutes MOTION by Stokes, second by Bonar to approve the minutes. APIF, MOTION CARRIED. 3. Public Hearings a) Variance request to encroach into side yard setback. Applicant: Tom Weber 809 7th Street Farmington, MN 55024 The applicant would like to construct an 832 square foot garage in the rear of his yard. The proposal requires a 14 foot variance to the front (side) yard setback. Mr. Webber's lot is on a comer and has two front yards requiring 20 foot setbacks. Due to the size of the boulevards in this area of roughly 20-30 feet, the variance conditions are unique to this area. MOTION by Bonar, second by Stokes to close the public hearing. APIF, MOTION CARRIED. MOTION by Stokes, second by Bonar to approve the variance. APIF, MOTION CARRIED. b) Conditional Use Permit to allow an off-premise directional sign at the southeast intersection of 195th Street and Akin Road. Applicant: Bible Baptist Church 19700 Akin Road Farmington, MN 55024 The applicant would like to install an off premise directional sign on a parcel that they own on the comer of Akin Road and 195th Street. The conditional use permit is required because the church is technically located on an adjacent parcel, so it is an off premise sign. The proposed sign is 24 square feet in size and meets the code requirements. The required setbacks are 50 feet from 195th Street and 20 feet from Akin Road. Approval of the conditional use permit would be contingent upon the following: 1. The applicant obtains a sign permit. 2. The applicant coordinates with small utility providers in the area to ensure that the sign is not interfering with any of those services. Planning Commission Minutes October 13, 2009 Page 2 Commissioner Bonar asked if the church is well established and currently has a marquee sign. Staff stated that yes the church has been there for some time and does currently have a marquee sign. Chair Rotty asked what would happen to the conditional use permit if the property were to be developed since it is zoned residential. Staff stated that the CUP would run with the property. They also stated that the site offers significant challenges in terms of development. MOTION by Stokes, second by Bonar to close the public hearing. APIF, MOTION CARRIED. MOTION by Stokes, second by Rotty to approve the conditional use permit with the stated contingencies. VOTED FOR: Rotty, Stokes. VOTED AGAINST: Bonar. MOTION CARRIED. c) Conditional Use Permit, Site Plan, Variance & Final Plat - Multiple family senior housing complex in the SSC zoning district. Applicant: Dakota County Community Development Agency 1228 Town Centre Drive Eagan, MN 55123 The sketch plan for this proposal was reviewed two months ago and there has not been much change to the plan since that time. The property is zoned SSC and a conditional use permit is required for the sixty unit senior housing complex to be constructed, with possible expansion of another 12 units at some time in the future. The building will be roughly 93,800 square feet of space with a foundation of approximately 24,000 square feet. The requirements for the conditional use permit have been met. The site plan shows the parking at the rear of the building and all setbacks except the front yard setback do meet the SSC requirements. The front yard setback varies from 20-30 feet from the right-of-way. Staff is interpreting the intent of the 20 foot maximum setback as being geared more for commercial structures. This is a residential use and staff finds the setbacks acceptable. Main access to the site will on the northern side off of Dushane Parkway; there will be no access from Spruce Street. The access will be shared with the lot directly to the north. And easement agreement will have to drafted when the lot to the north develops. There is currently a 15 foot sidewalk shown along Dushane Parkway as was previously approved in 2006 with the landscape and amenities plan. Dushane Parkway is currently under construction. On the west side of McDonald's a 7 % foot sidewalk has been installed. Engineering is suggesting that the CDA modify the proposed sidewalk to match what was done by McDonald's. A total of 28 parking stalls are being proposed, and there will be underground parking with an additional 60 spaces. The city code currently requires that 2.5 parking stalls are required for each unit of a multi family dwelling. The CDA is requesting to reduce that amount from 2.5 stalls per unit to 1.45 stalls per unit. A variance is required for this change. The CDA has roughly 20 senior properties throughout the county, and most use the 1.45 parking stalls and this ratio has appeared to work well at those locations. Staff is comfortable with the variance request. The solid waste handling for the site is still being discussed with the developer and the City's Solid Waste Division. This will need to be worked out before building permits are pulled. The exterior of the building will consist of a combination of materials. There will be a plaza at the comer of Spruce Street and Dushane Parkway. There would be two monument signs proposed. The position of the sign placed on Spruce Street will have to be modified slightly to keep the sign out of the right-of-way. Planning staff and Engineering staff have reviewed the plans and provided comments to Planning Commission Minutes October 13, 2009 Page 3 the CDA. The majority of the comments can be addressed at the construction plan phase of the development. The final plat for Vermillion River Crossing Senior Housing has also been submitted. Staff is recommending approval of the site plan and conditional use permit subject to the following contingency: 1. Satisfaction of all Planning and Engineering comments. Approval of the final plat subject to the following contingency: 1. The execution of a development agreement. Approval of the variance to the off street parking requirements. Commissioner Bonar stated that he has no objection to the parking ratio reduction or the reduction of the sidewalk width. He asked if a trash compactor option is being discussed for the solid waste handling. Staff stated that it has not been discussed thus far. Commissioner Stokes also agreed that the parking ratio and the sidewalk width seemed reasonable. He asked about the placement of the trash receptacle at the bottom of a driveway where cars are coming in and out and there will need to be snow plowing. He has concerns with that location. Chair Rotty agreed that the variance seemed reasonable. He had no issues with the final plat. He pointed out the site amenities that include a plaza area. Kari Gill from the Dakota County CDA stated that this area will be a focal point but the details have not been confirmed yet. She stated that there will be an additional outdoor area for residents to use. MOTION by Stokes, second by Bonar to close the public hearing. APIF, MOTION CARRIED. MOTION by Bonar, second by Stokes to approve the applications as recommended and fOlWard the final plat to the City Council for their consideration. APIF, MOTION CARRIED. d) Ordinance establishing Downtown Commercial Overlay District (DC) Design Standards. Applicant: City of Farmington 430 Third Street Farmington, MN 55024 This item has been before the Commission previously. The Economic Development Authority reviewed the design standards at their recent meeting and has made some minor changes. A section has also been added describing projecting signs. MOTION by Stokes, second by Bonar to close the public hearing. APIF, MOTION CARRIED. MOTION by Bonar, second by Stokes to recommend approval of the Downtown Commercial Overlay District Design Standards and fOlWard them to the City Council for approval. APIF, MOTION CARRIED. e) Ordinance amending Section 10-6-20 of the City Code concerning Industrial Park Design Standards. Applicant: City of Farmington 430 Third Street Farmington, MN 55024 This item has also been previously reviewed by the Planning Commission. The Economic Development Authority (EDA) reviewed this item as well and made very few changes. The EDA was very much in favor of the standards for metal on the upper half Planning Commission Minutes October 13, 2009 Page 4 of commercial buildings and the outdoor storage verbiage. MOTION by Stokes, second by Bonar to close the public hearing. APIF, MOTION CARRIED. MOTION by Stokes, second by Bonar to recommend approval of the Amendments to Section 10-6-20 regarding the Industrial Park Design Standards and forward them to the City Council for approval. APIF, MOTION CARRIED. f) Ordinance repealing Section 10-5-9 concerning the R-4 (Medium/High Density Residential) zoning district. Applicant: City of Farmington 430 Third Street Farmington, MN 55024 Staff is proposing to repeal the R-4 Medium Density Residential zoning district because there were minimal properties that were zoned R-4 and those properties that were, actually needed to be rezoned to R-5. Therefore the R-4 zone is no longer in use. This change was part of the Comprehensive Plan update. MOTION by Stokes, second by Bonar to close the public hearing. APIF, MOTION CARRIED. MOTION by Stokes, second by Bonar to recommend the repeal of the R-4 Zoning District, Section 10-5-9 and forward the item to the City Council for approval. APIF, MOTION CARRIED. g) Ordinance amendment adding Section 10-5-20 concerning Mixed Use Commercial / Residential Zoning District (MUCR). Applicant: City of Farmington 430 Third Street Farmington, MN 55024 The City is looking to amend the official zoning map to comply with the updated Comprehensive Plan. The property known as Fairhill will be officially zoned as a Planned Unit Development (PUD). The PUD agreement was established a little over a year ago. There is a 29 acre are of the development that is unique in that it is guided as Mixed Use Commercial/Residential (MUCR). The City of Farmington does not currently have a zone that fully integrates the uses and bulk densities that this particular guide was intended to do. Staff is proposing to add the MUCR zoning district by creating Section 10-5-20. MOTION by Stokes, second by Bonar to close the public hearing. APIF, MOTION CARRIED. MOTION by Stokes, second by Bonar to add section 10-5-20 regarding the MUCR Zoning District. APIF, MOTIN CARRIED. h) Ordinance amending Section 10-5-1 concerning the Official Zoning Map. Applicant: City of Farmington 430 Third Street Farmington, MN 55024 The City of Farmington's Official Zoning Map needs to be updated to comply with the 2030 Comprehensive Plan. This item was reviewed last month by the Planning Commission. There have been zoning changes to 9 areas or properties on the map. There were no resident present for the public hearing. APIF, MOTION CARRIED. i) Amend the 2030 Comprehensive Plan and Zoning Map at 1001 Ash Street and 913 10th Street. Applicant: City of Farmington 430 Third Street Farmington, MN 55024 The properties at 913 10th Street and 1001 Ash Street are currently zoned R-3, but should actually be zoned R-2 due to the fact that they are single family homes. This would make the properties consistent with the surrounding area. MOTION by Stokes, second by Bonar to close the public hearing. APIF, MOTION CARRIED. MOTION by Bonar, second by Stokes to recommend approval of the recommended changes to the Comprehensive Plan and Official Zoning Map and forward this item to the City Council. APIF, MOTION CARRIED. j) Text amendments to the City Code for R-l, R-2, R-3, R-5, R-T, and R-D zoning districts concerning density. Applicant: City of Farmington 430 Third Street Farmington, MN 55024 The proposed changes are in conjunction with the Comprehensive Plan update and the updates to the Official Zoning Map. The density definitions are being updated to comply with the 2030 Comprehensive Plan definitions. MOTION by Stokes, second by Bonar to close the public hearing. APIF, MOTION CARRIED. MOTION by Stokes, second by Bonar to recommend approval of the amendments and forward this item to the City Council. APIF, MOTION CARRIED. k) Amend Section 10-5-5 (C) 2 concerning the Commercial Recreational Uses. Applicant: City of Farmington 430 Third Street Farmington, MN 55024 A minor grammatical change was made to the verbiage of this section. MOTION by Stokes, second by Bonar to close the public hearing. APIF, MOTION CARRIED. MOTION by Stokes, second by Bonar to recommend approval and forward this item to the City Council. APIF, MOTION CARRIED. 4. Discussion a) 2010 Census - Complete Count Committee Staff met recently with representatives from the US Census Bureau and they requested that Farmington work to create a "Complete Count Committee". Staff felt the Planning Commission meeting might be a good forum to use to spread the word to residents that they census will be coming soon. Planning Commission Minutes October 13, 2009 Page 6 5.
