INTRODUCTION
Currently, the EDA does not hold clear title to the McVicker lot that would allow it to be sold to a
developer for redevelopment.
DISCUSSION
In discussions with Dakota County, it has been determined to establish clear title to the property, the
EDA will need to approve a Resolution that (a) approves the reconveyance of the property back to
the State of Minnesota and (b) requests that the State of Minnesota then convey the property back to
the EDA without any restrictions or reversion clauses. A copy of the required Resolution is attached
for your review and approval. The signed Resolution and required applications will be submitted to
Dakota County and brought before the County Board on November 2nd.
BUDGET IMPACT
There is approximately $380 in fees associated with this activity.
ACTION REQUESTED
A motion in favor of approving and executing the attC:lChed Resolution is requested.

RESOLUTION NO. 10.- 0/
RESOLUTION APPROVING THE RECONVEYANCE OF TAX FORFEITED
LAND TO THE STATE OF MITNNESOTA BY THE ECONOMITC DEVELOPMENT
AUTHOIDTY IN AND FOR THE CITY OF FARMITNGTON, MITNNESOTA AND
REQUESTING THE STATE OF MINNESOTA TO RECONVEY LEGAL OWNERSHIP
TO THE ECONOMIC llEVELOPMENT AUTHOIDTY IN AND FOR THE CITY OF
FARNUNGTON,NUNNESOTA
'WIIEREAS, the property described on Exhibit "A" (the "Property") was conveyed as
forfeited lands to the Farmington Housing and Redevelopment Authority ("HRA") on August
19,2005, by State Deed No. 0200771 with use restrictions ("2005 Deed"); and
WHEREAS, the !IRA was reestablIshed as the Economic Development Authority in and
for the City of Farmington ("EDA") effective January 1,2006;
WHEREAS, the EDA desires that fee simple title in the property be transferred to the
EDA for conveyance in connection with a proposed development project for the Property; and
WHEREAS, the EDA has expended funds exceeding the appraised value of the Property
through building demolition, site investigation, asbestos abatement, and street improvements to
prepare the Property for re-sale; .'
WHEREAS, the EDA will retain a permanent interest in southerly 16 feet of the
Property for public walkway purposes further reducing the value of the Property for re-sale for
redevelopment purposes;
WHEREAS, in order to transfer fee simple title of the Property to the EDA, it is
necessary to first reconvey the Property to the State of Minnesota; and
WHEREAS, the EDA is willing to reconvey the Property to the State of Minnesota as
required by Minnesota Statutes Chapter 282, conditioned upon the Property being transferred to
the EDA free of the restrictions contained in the 2005 Deed.
NOW, THEREFORE, BE IT RESOLVED, by the Board of Directors of the Economic
Development Authority in and for the City of Farmington approves:
1. The execution by the Chair and Executive Director of the required form
evidencing the reconveyance of the Property to the State of Minnesota, conditioned upon
approval by the State of Minnesota of the reconveyance to the EDA as provided UIider Paragraph
2; and

2. The Application and request of the EDA to convey fee simple title to the Property
to the EDA for a nominal amount without any restrictions or reversion clauses pursuant to the
required Application for Conveyance and the execution by the Chair and Executive Director of
the same.
