INTRODUCTION
At the September 4, 2001 City Council meeting, a resident expressed concern that she had not been
informed of the construction activity in the Autumn Glen Development.
DISCUSSION
Staff has considered the concerns expressed at the meeting and will be working to establish a
procedure for notifying properties in the vicinity of new development construction. A specific
mailing to property owners informing them of upcoming construction activity in their area could be
included as a step in the City's overall development process. Staff will bring back a proposed
procedure that could be implemented for the next new development.

Citizen Comments - Tree Preservation Ordinance

INTRODUCTION
Nicolas Roberts of 5597 180th Street attended the September 4,2001 City Council
meeting and expressed concerns regarding the extent of tree removal that has occurred in
Farmington in conjunction with recent subdivision developments adjacent to Pilot Knob
Road.
DISCUSSION
In addition to expressing his concerns regarding the extent of tree removal that has taken
place in several recently approved developments in Farmington, he also provided a copy
of the Woodland Protection Standards Ordinance for the City of Burnsville.
City staff, the Planning Commission and City Council, in conjunction with the consulting
fIrm of Hoisington Koegler have been working on the preparation of an update of the
City's Zoning Ordinance since last fall with anticipation of completing the project by the
end of 200 1. Proposed tree preservation and/or tree replacement ordinance provisions
have been discussed and a number of sample ordinances from other communities have
been reviewed. .
Additional discussion between staff, the Planning Commission and City Council will
continue on this and other aspects of the Zoning Ordinance over the next several months.
The Burnsville ordinance and other ordinances will be reviewed in conjunction with this
discussion to determine the most appropriate approach to this issue in the City of
Farmington. It is anticipated that several public meetings and hearings will be held prior
to adoption of the updated Zoning Ordinance.

Affordable Housing Concerns

INTRODUCTION
Amber Garland of20195 Doffing Avenue in Vermillion Township addressed concerns regarding
the availability of affordable housing in Farmington as well as Empire Township.
DISCUSSION
Ms. Garland addressed the issue of the tax forfeited lot at the comer of 4th and Main Street as a
site for the development of affordable housing. Dakota County and the Minnesota Pollution
Control Agency (MPCA) have not been willing to consider redevelopment of that parcel until the
source of groundwater contamination can be identified and addressed. A meeting with City and
MPCA staff is scheduled for September 13,2001 to get an update on the ongoing investigation
being completed by MPCA to determine the cause and location of groundwater contamination in
this area.
The development of affordable housing in Empire Township will need to be taken up with their
Board of Supervisors.
A copy of the most recent Livable Communities Act statistics for Farmington, Dakota County
and the entire Metropolitan area that was recently provided to the Mayor and City Council has
been forwarded to Ms. Garland.

5. ANNOUNCEMENTS
a) Award Presentation - Safe and Sober - Police Department
Mr. Bob O'Brien and Ms. Susan Palmer from the Minnesota Office of Traffic
Safety awarded a laser speed detector to the Police Department. This award was a
result of active participation in a recent Safe and Sober seatbelt enforcement
campaign, and for the day to day work the officers do. MOTION by Strachan,
second by Soderberg adopting RESOLUTION R79-01 accepting the Laser
Speed Gun from the Minnesota Office of Traffic Safety, Safe and Sober
Campaign. APIF, MOTION CARRIED.
b) Proclaim Pollution Prevention Week - Parks and Recreation
MOTION by Cordes, second by Verch proclaiming the week of September 9-15,
2001 to be Pollution Prevention Week in Farmington. APIF, MOTION
CARRIED.
c) Community Survey Presentation - Administration
Mr. Bill Morris and Mr. Peter Leatherman from Decision Resources presented the
results of the Community Survey. Approximately 400 households were called
between April 19, 2001 and May 9, 2001. The highlights of the survey are as
follows:

Quality of Life was rated Excellent/Good by 93% of those surveyed. 10% have
always lived in Farmington. The small town feel was what residents liked most
about Farmington, which is a very unique response. The most serious issue
facing the community was rapid growth. 68% felt the City is moving in the right
direction, and 90% would recommend Farmington to others. There is about the
right amount of community characteristics, however residents felt there are too
few entertainment/dining establishments and service/retail businesses. 40% had a
personal tie to their region of the City, while 40% felt a personal tie to the entire
community. The residents felt a strong sense of community. Regarding public
safety, 92% felt very or reasonably safe and stated there is about the right amount
of patrolling. 60% felt homes and yards are in good condition and appearance.
As far as the number of major corridors, 44% felt it was a somewhat serious
concern, and 16% felt it was very serious, which means this issue should be
reviewed in the future. City services received overwhelming positive ratings
across the board. 6~,Io stated the value of City services is good, but 47% oppose a
tax increase to maintain the services. 49% felt property taxes are about average.
41 % stated they have a fair amount of knowledge about the work of the Mayor
and Council, and 49% approve of their job performance. 33% have had some first
hand contact with City staff, and 50% gave staff a good job performance rating.
Regarding the Police Department, 34% had contact with the police, and of those
87% indicated it was favorable. 68% were aware the police were on duty around
the clock; 58% felt there were an adequate amount of officers; and 41 % would
support a tax increase for more officers. The greatest public safety problem was
juvenile crime at 42%. Enforcement of codes and ordinances was rated about
right by 81 %. Of those surveyed, 25% own snowmobiles. 52% would support a
ban on snowmobiling in residential areas, and 47% would oppose a ban.
Regarding the sprinkling policy, 80% were aware of it; 85% agree with it; and
60% felt enforcement was about right. 83% felt City services kept pace with
residents needs. 71 % felt there was adequate opportunity for zoning input.
Development was rated by 60% as well planned for the future. The rate of
development was rated as too fast by 50%, while 46% felt it was about right.
73% go to Apple Valley for shopping, and 47% do shopping on a weekly basis.
Regarding retail/leisure business needs, 35% would like a family sit-down
restaurant. 69% gave a satisfactory rating to in-city travel time. Their average
commute time is 20 minutes. 29% would support a tax increase for public transit,
and 27% oppose it. Regarding Parks and Recreation, 74% said they were
somewhat or very well informed on park facilities and programs. 70-80%
received parks and recreation information from the Independent or the Update,
while 41 % call City Hall. Ease of reaching staff, courtesy, and ease of transaction
was rated at 90%. 86% have used the community parks and 82% gave them a
favorable rating. Trails were used by 81% with a 75% favorable rating. The
pool, senior center, and arena received equal usage and favorable ratings, which is
the highest across the metro area. Most residents would oppose a tax increase for
a recreational facility. 47% use the recreation programs, and 87% felt the
recreation opportunities met their needs. As an information source for the City
government, 46% use the Independent, and 20% use the Update. 71 % felt they

were somewhat well informed about City government. 78% knew they received
the City Newsletter, and 98% felt it was very or somewhat effective. City
Council meetings were viewed by 37%. Regarding computer capability, 75%
stated they have access to a modem; 26% have accessed the City's website, and
38% were unaware of the website.
6. CITIZEN COMMENTS
Mr. Craig Stibbe, 20060 Akin Road, before the Akin Road project was started, residents
said there was going to be a serious accident if something was not done, and there was.
Stop signs are needed, as children have to cross the road to get to the school bus. The
speed limit has been lowered to 40 mph during construction and he would like to keep it
there. If there are a dozen meetings or no meetings, the City will do what it wants to do.
If the City wants a fast road into town, he will use it as a fast road to do his business out
of town.
Mr. Nicholas Roberts, 5597 180th Street, distributed pictures and information to help
preserve trees in future developments, especially Middle Creek. He obtained a tree
preservation ordinance from Burnsville. He would like Council to pass an ordinance to
preserve the trees in future developments. He realizes the need to build houses, but we
also need to preserve what we have.
Ms. Amber Garland, 20195 Doffing Avenue, expressed her concern about affordable
housing. The price of rent has escalated so much, that there is a lack of affordable
housing. She heard of a house on 4th Street and Main that cannot be sold because of toxic
chemicals and was wondering if there were funds available to be used to clean up the
property and then sell it for affordable housing. She also heard 1000 houses were
proposed to be built in Empire Township and was wondering if a percentage of those
houses could be used for affordable housing.
a) Park Construction Update - Lake Julia Park - Parks and Recreation
At the August 20, 2001 Council Meeting, Mr. James Munro had requested the
City start developing Lake Julia Park. A summary of what has been done and
future plans was sent to him.
Mr. James Munro, 18863 Embers Avenue, wanted to clarify a statement
Councilmember Soderberg made at the last meeting. Mr. Munro said he has a
tendency to speed through his neighborhood, not that he actually did speed.
Councilmember Soderberg said he did not identify Mr. Munro in particular. Mr.
Munro said the reason for the residents being at the last meeting was for the speed
on Embers Avenue and a concern about the traffic. Council is not doing anything
to control the speed on Embers. Rerouting the street was discussed to make it
easier for 187th, but has the speed been discussed. Staff replied speed studies take
a week or two to gather the data. Information will be brought to Council at the
next meeting or the one after. Mr. Munro said it is the neighbors that are speeding
and construction workers. It makes no difference who it is, the point is people are
going too fast on Embers. If there is a speed study, what is the solution? He then

asked for the name of the person who designs the streets. Mayor Ristow stated a
response will be brought back to the next meeting or the meeting after. Mr.
Munro stated Council discussed several times not passing the plat for Meadow
Creek, but in the end it did pass. Mayor Ristow stated it met all the requirements
for development.
Ms. Deb Johnson, 18675 Embers Avenue, stated since Embers has been opened,
the trucks do not slow down. If the people on 187th have a concern, let them
voice it, but why should she be opened up for construction traffic at 7 a.m. on a
Saturday. They have a speed monitor on 187th, why not on Embers? She wanted
Council to know that residents are voters, and Council will be up for re-election.
When watering bans were in effect, flyers were posted downtown, squad cars are
sent out when watering is done when it's not supposed to be. Why couldn't the
residents be sent a flyer regarding upcoming construction on their street?
Mr. James Munro, 18863 Embers Avenue, stated there are more tickets being
given for watering on the wrong day, than speeding on Embers.

Item 7a) Approve Council Minutes (8/22/01 Special) was pulled so Councilmembers
Strachan and Verch could abstain from voting as they were absent from that meeting.
MOTION by Soderberg, second by Cordes approving Council Minutes (8/20/01
Regular). APIF, MOTION CARRIED. MOTION by Cordes, second Soderberg
approving Council Minutes (8/22/01 Special). Voting for: Ristow, Cordes, Soderberg.
Abstain: Strachan, Verch. MOTION CARRIED.

8. PUBLIC HEARINGS
a) Consider Resolution - Designating Farmington Heritage Landmarks -
Administration
The Heritage Preservation Commission has determined that the following three
properties meet the eligibility criteria for designation as Farmington Heritage
Landmarks:
Farmington State Bank Building, 320 Third Street
Masonic Temple Building, 324-328 Third Street
Hamilton Clay House, 621 Oak Street
Mr. Bob Vogel, HPC Consultant, stated this is the local equivalent of the National
Register of Historic Places. The City must consider the effects of any action
taken on the properties. It also creates a partnership between the owners and the

City. Letters of agreement were received from property owners of the
Farmington State Bank building and the Masonic Temple building.
Ms. Jeanine Hill, 621 Oak Street, stated she is very excited about the designation
and wants to support it in any way she can.
Mr. Marty Clough, 312 7th Street, stated heritage continues to change throughout
time. The Hamilton Clay House has a lot of history and beauty that you do not
see anywhere else. It is vitally important that Council gives strong support to this
project.
MOTION by Verch, second by Soderberg to close the Public Hearing. APIF,
MOTION CARRIED. MOTION by Soderberg, second by Verch adopting
RESOLUTION R82-01 designating the Farmington State Bank Building, 320
Third Street, as a Farmington Heritage Landmark. APIF, MOTION CARRIED.
MOTION by Soderberg, second by Verch adopting RESOLUTION R 83-01
designating the Masonic Temple, 324-328 Third Street, as a Farmington Heritage
Landmark. APIF, MOTION CARRIED. MOTION by Soderberg, second by
Verch adopting RESOLUTION R84-01 designating the Hamilton Clay House,
621 Oak Street as a Farmington Heritage Landmark. APIF, MOTION
CARRIED.
9. AWARD OF CONTRACT
10. PETITIONS, REQUESTSAND COMMUNICATIONS
a) Middle Creek 4th Addition Development Contract - Engineering
The Development Contract for Middle Creek 4th Addition was brought to
Council. The conditions of approval for the development contract are:
a) The Developer enter into this Agreement.
b) The Developer provide the necessary security in accordance with the
rennsofthisAgreement.
c) The Developer record the plat with the County Recorder within 75 days
after City Council approval of the final plat.
MOTION by Cordes, second by Strachan adopting RESOLUTION R 85-01
approving the execution of the Middle Creek 4th Addition Development Contract
and authorizing its signing contingent upon the above conditions and approval by
the Engineering Division. APIF, MOTION CARRIED.
b) Akin Road Speed Study Results - Engineering
MnDOT has completed the first speed study for Akin Road. The
recommendation based on the results of the speed study is to keep the speed limit
at 50 mph at this time. MnDOT will be conducting another study after the
improvements to Akin Road are completed. Currently, there is a 40 mph speed
limit due to construction and it is temporary during the construction phase.
Councilmember Soderberg stated it troubles him that improving the conditions on

the road would probably make the speed limit come back the same or higher. The
stop sign at 195th will be installed permanently. Councilmember Strachan asked
if the second study says 50 mph is fine, can Council pass a resolution for 40 mph?
City Engineer Mann replied once a stretch of highway is designated as an urban
district, it does need to be forwarded to MnDOT for review. Councilmember
Cordes asked if it could be designated as an urban district now? Councilmember
Strachan agreed that staff could look into that now. City Administrator Shukle
stated we should do anything we can to mitigate problems. Councilmember
Soderberg stated it makes sense to change the speed limit while it is under
construction and the placement of stop signs. City Engineer Mann stated there are
guidelines as to when and how areas are designated as urban districts. Staff will
prepare a report for urban designation.
c) Reschedule CouncillPlanning Commission Workshop - Community
Development
County staffhas requested the Joint Workshop scheduled for September 19, 2001
to discuss the status of East-West Corridor Study be changed to September 26,
2001. Council approved the change.

12. NEW BUSINESS
a) Adopt 2002 Preliminary Budget and Tax Levy - Finance
State statute requires a preliminary tax levy be certified to the County by
September 17, 200 I. Once the proposed tax levy is adopted, the Council may
lower the levy, but cannot increase it. The Tax Levy proposed as part of the
budget is $3,607,016 and includes $1,006,937 for debt service and $55,000 for the
Fire levy. The State Department of Revenue has notified the City that our Levy
Limit for pay 2002 is $4,593,182. The proposed tax levy is $986,166 under the
City's statutory levy limit. The requirements to hold a Truth in Taxation public
hearing has been eliminated for payable 2002. If Council desires to hold a Truth
in Taxation public hearing, staff proposed it be held on December 3,2001 as part
of the regular Council Meeting. The Council could then adopt the 2002 Budget
and Tax Levy immediately after the hearing. Staffhas been working with a
proforma for the last 5 years. The growth and expenditures have been predicted
to grow at 10% for the last five years. Councilmember Cordes stated she is not
supportive of this budget, but in fairness to the new Administrator and the fact we
need to meet deadlines, she will support the preliminary budget, but it can be
changed. MOTION by Soderberg, second by Strachan adopting RESOLUTION
R86-01 certifying the 2002 Preliminary Tax Levy of$3,607,016 to Dakota
County and establishing December 3,2001 as the City of Farmington's Truth in
Taxation hearing for Tax Levy collectible 2002. APIF, MOTION CARRIED.

Councilmember Soderberg: Welcomed City Administrator Shukle. Regarding Embers
Avenue and the new development to the east, as was done with 195th and Akin Road, he
would like to look at the Traffic Engineer's numbers for Eaglewood Trail and 187th to see
if stop signs might be warranted at those intersections. If they are, the City should be
proactive in placing them in anticipation of the increased traffic. This is only a
suggestion. City Engineer Mann stated staff is working on traffic counts on Embers as
well as looking at speed surveys. Staff is also researching speed bumps and will bring it
back at the next meeting. Police Chief Siebenaler stated the new speed trailer has been
placed on Embers A venue four or five times in the last six weeks. This is one of many
streets with the same concern.
Councilmember Cordes:

Councilmember Verch: Welcomed City Administrator Shukle and thanked Finance
Director Roland and staff for carrying the burden.
City Administrator Shukle: Thanked Council for this opportunity and is looking
forward to getting started. He is very excited to be here and it is a great City. From what
the community survey said, people are very happy with what is going on and he is glad to
be part of it. Finance Director Roland and staff have done a fabulous job of picking up
the pieces from where John Erar left off when he vacated the position, and have kept him
informed and sent him information. He looks forward to working with everyone.
Finance Director Roland: Thanked Council for the privilege of acting as Interim City
Administrator. She appreciated Council's confidence and support, and welcomed City
Administrator Shukle.

INTRODUCTION
The City has received notification from Ms. Jennifer Hoeppner of her intention to resign from
her position as Full-time Liquor Clerk with the Liquor Division of the Finance Department.
DISCUSSION
The Human Resources Office has received notification that Ms. Hoeppner will resign from her
current position on September 28, 2001. She began her employment in a part-time capacity in
May of 1998 and was promoted to full-time in December of 1999. She has been an excellent
employee and has gained the respect of her co-workers. The City has appreciated her
commitment to the organization and wishes her well in her future endeavors.
ACTION REQUESTED
Acknowledge the resignation of Ms. Jennifer Hoeppner effective Friday, September 28, 2001.

INTRODUCTION
I am currently a member of the Public Employees Retirement Association (PERA). Under -
Minnesota Statutes, City Administrators and City Managers are allowed to be excluded from
PERA membership.
DISCUSSION
Because of previous participation in the International City County Management Association
Retirement Corporation (ICMA-RC) I desire to opt out of PERA and rejoin ICMA-RC with the
City of Farmington and myself contributing jointly. You may recall that this item was part of my
employment agreement negotiated between the City and myself through The Brimeyer Group.
ACTION REQUESTED
Approve the attached resolution prepared by Joel Jamnik, City Attorney, authorizing the
exclusion of the City Administrator from PERA and providing for City contributions to a
deferred compensation program. If you have any questions, please contact me.

WHEREAS, the City Administrator of the City of Farmington qualifies for membership in the Minnesota
Public Employees Retirement Association (PERA), and;
WHEREAS, Minnesota Statutes (353.028) authorizes the City Administrator to elect to be excluded from
membership in the association within six months following the commencement of employment, in writing
on a form prescribed by the Executive Director of PERA and approved by a resolution of the governing
body of the City and filed with the Executive Director, and;
WHEREAS, the election to be excluded from membership must include a provision agreeing that the
person will not at any time in the future seek authorization to purchase service credit for any period of
excluded service and is irrevocable, and;
WHEREAS, if an election of exclusion is made, and if the city administrator and the governing body of
the City agree in writing that the additional compensation is to be deferred and shall be contributed on
behalf of the city manager to a deferred compensation program which meets the requirements of section
457 ofthe Internal Revenue, the governing body may compensate the city administrator, in addition to the
salary allowed under any limitation imposed on salaries by law or charter, in an amount equal to the
employer contribution which would be required by section 353.27, subdivision 3, if the city administrator
were a member of the association, and;
WHEREAS, the City and the City Administrator have entered into an employment agreement
authorizing this election of retirement contribution, and;
WHEREAS, the City Administrator has submitted the necessary applications for exclusion compliant
with the statutory requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FARMINGTON, MINNESOTA:
1. That the application for exclusion from PERA by City Administrator Ed Shukle is hereby
approved.
2. That the City Council hereby approves payment of an amount equal to the employer contribution
which would be otherwise required if the City Administrator were a member of PERA to an authorized
deferred compensation program designated by the City Administrator.
3. That the Mayor, City Clerk, and other City officials are hereby authorized to execute such
documents and take other such steps as to effectuate the exercise of this option.

As of July 23, 2001 there is a vacated seat on the Senior Center Advisory Council.
DISCUSSION
In accordance with the City Commission Appointment Process policy that is attached,
staff researched the file and found that we do not have an application on file, however,
Senior Center staff has recruited a potential candidate from the Senior Membership. That
application is attached.
Beverly Preece originally submitted an application in January, 2000, to serve on the
Senior Center Advisory Board. Ms Preece was interviewed by Council, but there were
no available seats at that time and she was appointed to the Heritage Preservation
Commission.
Ms Preece is requesting to be appointed to the Senior Center Advisory Board in addition
to the term she fills on the HPC. She feels she has the time and interest to fill both
positions.
The expiration term of this Senior Center Advisory Board seat is 1/31/03.

CITY COMMISSION APPOINTMENT PROCESS
Policy Purpose
The purpose of this policy is to set forth the procedures to be used in appointing interested
citizens to the City Commissions.
The appointment of citizens to City advisory commissions and boards shall be made by the City
Council on an annual basis to fill all expired terms. The Council shall conduct interviews of all
qualified candidates to consider relevant qualifications and interests, and appoint such members
as the Council deems in the best interest of the City.
Commission seats vacated by resignation and/or removal shall be appointed by first reviewing
any applications on file and/or any. requests to be appointed by interested citizens having taken
notice of an existing vacancy. If no applications are on file, the City shall solicit applications for
appointment by advertisement in the legal newspaper and other public mediums as appropriate.
Appointments to fill seats vacated by resignation and/or removal shall coincide with the normal
expiration date of the seat and shall be made as soon as practical. Appointments to fill vacated
seats during an unexpired term shall be in accordance with the City Code.

INTRODUCTION
The City Council scheduled the 2001 Seal Coat project assessment hearing at the August 20, 2001 City
Council meeting.
DISCUSSION
The 2001 Seal Coat project has been completed. Properties abutting streets within Pine Ridge Forest Addition,
Nelson Hills Farm 6th Addition, Charleswood 1st Addition, and Dallas Avenue from 208th Street to its
northerly terminus, and property abutting the streets of Westview Acres, 208th Street from Akin Road to the
east, Spruce Street from 4th Street east to the frontage road of C.S.A.H. 50/ T.H. 3, and 5th, 6th, and 7th
Streets for Y2 block north and south of Spruce Street were seal coated with this year's project.
All affected property owners have been notified as to the date and time of this public hearing and that fmal
assessments may be adopted at the public hearing pursuant to M.S. 429.
BUDGET IMPACT
The total project cost for the 2001 Seal Coat project is $50,641.43. At the April 2nd, 2001 Council meeting,
Council directed staff to prepare the assessment roll allocating 50% of the project costs to the benefiting
properties. Accordingly, staff has calculated the proposed assessment amount for the 2001 Seal Coat project
to be $42.56 per buildable lot. The total amount to be assessed to benefiting properties is $25,320.72. Several
streets in the project area have already been assessed for seal coating costs through their respective
development contracts. The City's portion of the project cost is $25,320.71 and will be funded through the
Road and Bridge fund.

Monday in January, 2002 and shall bear interest at the rate of 6.5% per annum from the
date of the adoption of this assessment resolution until December 31, 2002.
3. The owner of any property so assessed may, at any time prior to certification of the
assessment to the County Auditor, pay the whole of the assessment on such property,
with interest accrued to the date of payment, to the City Treasurer, except that no interest
shall be charged if the entire assessment is paid within 30 days from the adoption of this
resolution; and s/he may, at any time thereafter, pay to the City Treasurer the entire
amount of the assessment remaining unpaid, with interest accrued to December 31 of the
year in which such payment is made. Such payment must be made before October 17 or
interest will be charged through December 31 of the next succeeding year.
4. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County
Auditor to be extended on the property tax lists of the County. Such assessments shall be
collected and paid in the same manner as the other municipal taxes.

Wetland Alteration Permit - Extension of 195th Street and Farmington Preserve Park Trail

INTRODUCTION
The City of Farmington has submitted Wetland Conservation Act (WCA) Applications for proposed wetland
impacts resulting from the extension of 195th Street and the construction of a trail on the east edge of the
Farmington Preserve Park. The applications are required when projects are proposing to impact water/wetland
resources regulated by local, state and federal agencies implementing the MN Wetland Conservation Act
(WCA) of 1991.
DISCUSSION
A Notice of Wetland Conservation Act (WCA) Application for the 195th Street road project was mailed on
June 11, 2001 and initial comments on the application were due by June 29, 2001. The Application for the
trail project was mailed on July 2,2001 and comments were due by August 2,2001. A Technical Evaluation
Panel (TEP) meeting was held on June 20, 2001 regarding the proposed wetland impacts, wetland concept and
banking of excess wetland replacement credits. The attached letter from Brian Watson, Dakota County Soil
and Water Conservation District states that the proposed wetland impacts appear to have been avoided and
minimized to the best extent possible and the mitigation sequencing requirements under the WCA have been
met. No other adverse comments were received concerning the projects.
The grading plan for 195th Street shows that the proposed wetland impacts from the road will be 0.35 acres.
The total mitigation area is 1.62 acres. The proposed trail will impact 0.31 acres of wetland, however most of
the impact is limited to the farmed and degraded portion of the wetland. The replacement of the wetland
impacts will be accomplished utilizing the wetland created for the 195th Street road project.
After the road and trail projects are mitigated, an excess of 0.30 acres will be placed in a wetland bank as new
wetland credit. The Board of Water and Soils Resources, Soil and Water Conservation District and Corps of
Engineers have reviewed the mitigation/wetland banking area as required by the Wetland Conservation Act.
The wetland banking area has received preliminary approval by the WCA Technical Evaluation Panel to be
used for WCA impacts. The TEP will review the replacement site after construction to make a final approval
if it becomes a wetland.
ACTION REQUESTED
Consider approving the Wetland Conservation Act Applications for the 19Sth Street and Farmington Preserve
Park Trail and approve the Wetland Banking of 0.30 acres of the remaining wetland credit.

Remarks: There are two proposed city projects that have gone through the Wetland Conservation Act
(WCA) review process. The projects are cal'led the 19S1h Street and Farmington Preserve Park Trail.
19S1h Street
The project will extend 19S1h from Akin Road to a point approximately 2,400 feet east. This street will serve
Autumn Glenn Second Addition to the north. The raid is Identified as a minor arterial in the Farmington
Comprehensive Plan.
The proposed wetland impacts from this road will be 0,35 acres. The wetland mitigation will be
accomplished adjacent to the same wetland that ill being imp.cted. The wetland with the proposed impact
and mitigation is identified on the Wetland and Waterbody Classification Map as F-W8.2.3. This wetland is
26.8 acres and is identified on the Wetland and Waterbody Classification Map as a Potential Wetland
Enhancement and Banking Site. The attached Figure 6 shows the location of the impact and replacement.
The proposed replacement area will be built larger thsn that required for the road to accommodate
potential wetland impacts from future city projects. The total mitigation area is 1.62 acres.
Farmington Preserve Park Trail
The proposed project involves the construction of a trail on the east edge of Farmington Preserve Park.
This trail is part of a planned trail system in Farmington and will link to other trails in the city system. The
195"\ Street road project has provided the opportunity to build a portion of this planned trail immediately.
The trail will serve as a temporary access road to sllow construction of the mitigation site being created as
part of the 195"' Street project. The proposed trail will impact 0.31 acres of wetland, however moat of the
impact is limited to the farmed or degraded portion of fhe wetland. The replacement of the wetland impact.
will be accomplished utilizing the wetland created for the 195111 road project.

A table that shows a summary of the proposed wetland impact from the road and trail and mitigation Is
attached. After the trail and road impacts are mitigated, the 0.30 acres that remain will be placed in a
wetland bank as new wetland credit. This project will also involve a ditch block (Figure 8) to help restore
the hydrology of Wetland F-WB.2.3 to accomplish the enhancement goals as shown on the Wetland and
Waterbody Classification Map.
The Board of Water and Soils Resources, Soil and Water Conservation District, and Corps of Engineers
have reviewed the mitigation/wetland banking area as required by the Wetland Conservation Act. The
wetland banking area has received preliminary approval by the WCA Technical Evaluation Panel (TEP) to
be used for WCA impacts. Ultimately the WCA TEP will review the replacement site again once
constructed to make a final approval if it becomes wetland.
Recommendations
The comment period for the Farmington Preserve Park Trail and 19S1h Street Wetland Permits has expired
and no adverse comments were received. I recommend approval of the Farmington Preserve Park Trail
and 1951n Street Wetland Conservation Act Permit Applications. It is also recommended that the city
approve the Wetland Banking of 0.30 acres of the remaining wetland credit.

RE: Wetland Replacement Plan - Extension of 195th Street
Dear-Lee,
On behalf of the Dakota County Soil and Water Conservation District (SWCD) and the Vermillion River Watershed
Management Organization we have reviewed the above referenced Wetland Replacement Plan Application pursuant to the
Minnesota Wetland Conservation Act rwCA). The project will extend 195th Street from Akin Road to approximately
2,400 feet east. A wetland delineation report was prepared in May of 200 1 and was provided with the Wetland
Replacement Plan application. A Technical Evaluation Panel (TEP) meeting was held on June 20th regarding the proposed
wetland impacts, wetland replacement concept, and banking of excess wetland replacement credits.
The proposed roadway alignment would impact 0.35 acre of wetland and the proposed wetland replacement site is
estimated to be a total of2.0 acres. Approximately 1.30 acres of excess wetland credit would be deposited into the State
Wetland Banking system on behalf of the City of Farmington. The following comments are submitted for your review and
consideration:
. The wetland delineation report submittal adequately locates and defines wetlands located within the project site.
. The proposed wetland impacts appear to been avoided and minimized to the best possible extent and the mitigation
sequencing requirements under the WCA have been met.
. The general concept of the wetland replacement site and develop~ent of wetland banking credits for the City of
Farmington has merit as shown in the application. A TEP meeting will need to be held as soon as construction is
complete to evaluate "as built" conditions. It is helpful if this meeting is held prior to the contractor removing
grading equipment from the site. We would be happy to provide any pre-construction assistance prior to the
grading of this wetland replacement site.
Our office anticipates the receipt of a TEP Findings of Fact document. This letter is intended to supplement that anticipated
document and allow the City to make a decision on this WCA application without the need for a formal extension. We
appreciate the opportunity of reviewing this proposal with City staff and other agency personnel. We look forward to
reviewing the grading and erosion control plan when it becomes available and submitting recommendations to reduce soil

Summary of Project: The project will extend 195th Street from Akin Road to a point
approximately 2400 feet east. This street will serve Autumn Glen Second Addition to
the north. Storm sewer will be installed to serve only the immediate road area. A trunk
water main will be installed in accordance with the Farmington Comprehensive Plan.
The road will eventually become Dakota County Road 64. The road and sewer design
allows for future transition to the county. This road is identified as a minor arterial in the
Farmington Comprehensive Plan. The design also takes into consideration future
extension of the road and new developments.
The proposed wetland impacts from the road are 0.35 acres. The proposed
replacement will involve the creation of 1.19 acres of wetland along with buffer outside
the cities required buffer of 25 feet. Final buffer width is yet to be determined. The
proposed road impacts will utilize 0.70 acres of the 1.19 acres created and the
remainder will be placed into a BWSR Wetland Bank.
The Wetland Replacement Plan Application is enclosed. A WCA TEP meeting is
scheduled to review the proposed wetland bank site on Wed. June 20th.

INSTRUCTIONS FOR PERMIT ApPLICATION
TO WORK IN
DNR PUBLIC WATERS OR WETLANDS
1. Statutory Authority: Minnesota Statutes S 1 03G.245 makes it unlawful for the state, any person, partnership,
association, private or public corporation, county, municipality or other political subdivision of the state, to
change the course, current or cross-section of any DNR public waters or wetlands without a written permit
previously obtained from the Commissioner of Natural Resources. Warnina: Any work in DNR public
waters or wetlands that requires a permit cannot legally be started until a permit and a Notice of Permit Card
have been issued by the Department of Natural Resources. Any work in a public waters or wetlands without
a permit is a misdemeanor and is punishable by fines up to $700 and/or 90 days in jail. The Commissioner
also has the authority to require restoration of any work done without a permit or beyond the work authorized
by a permit and shall assess double the additional application fees, as well as the actual cost for any field
inspection.
2. Who should apply: Application must be made on the attached form and submitted to the DNR Regional
Office for the area where the proposed project is located (see map below), by the riparian (shoreline) owner
of the land on which the project is proposed, except:
a. A government agency, public utility or corporation authorized by law to conduct the project may apply if the
property rights acquired or to be acquired are fully described in the application. An authorized agent should
be identified on the application in Part I and sign where appropriate.
b. A holder of appropriate property rights such as a lease or easement may apply provided that the application
is countersigned by the owner and accompanied by a copy of the lease or other agreement. A permit will be
issued for the term of the lease only.
c. A prospective lessee of state-owned lands may apply for a permit in their own name after a lease has been
requested fro the Department responsible for the affected lands. The lease request and the permit
application will be processed concurrently.
J. Fees and Application Instructions: No DNR permit can be processed until all application fees have been
paid. Contact the appropriate Regional Office (see below) for full Public Waters Work Permit application
instructions, the checklist DNR uses to identify projects subject to Minnesota Pollution Control Agency
review, and fee information. These instructions, checklist and fee information can also be viewed on the
DNR's web site at htlp://www.dnr.state.mn.us/waters/forms/indexlhtml.
Make sure that you furnish all information that is requested in the full application instructions and
sign the application form. Lack of requested information and required fees would cause delay in
your application.

the north. Storm sewer will be installed to serve only the immediate road area. A trunk water main will be installed in accordance with the Farmington
Comprehensive Plan. The road will eventually become Dakota County Road 64. The road and sewer design allows for future transition to the county.
This road is identified as a minor arterial in the Farmington Comprehensive Plan. The design also takes into consideration future extension of the road
and new developments. Storm sewers will discharge into storm water ponds east of Autumn Glen, thus pre-treating the majority of the runoff prior to
discharging to the wetland. Water supply to the wetland will continue from its current source from a conservation area to the north through a 24-inch
culvert under the road. This water should not need treatment as it currently drains into the wetland. The culvert will provide for the least disruption in
water supply for the wetland, reduce storm sewer pipe sizes. and increase effectiveness of the water treatment ponds.

A ditch block will be installed to divert water to the proposed mitigation site. The ditch block should have a positive affect on a large existing wetland
located northwest of the mitigation site by restoring a higher outlet resulting in fully or at least partially restoring the hydrology of this basin. Raising the
outlet elevation higher then 905.0 is not possible due to potential flooding of land that is outside ownership of the city. The restoration of the existing
wetland is an added benefit and is not include in the mitigation calculation. The proposed mitigation will be accomplished by excavation. Flows from the
ditch will be directed to the mitigation site prior to discharge back into the ditch. Soil pits dug during the delineation indicate a clay layer approximately 8-
inches below the surface. This clay layer will be stockpiled and re-spread on the mitigation site to a depth of 6-inches. This combined with excavation of
the mitigation site to an elevation that is near the ditch bottom should eliminate the potential scope and effect of the ditch on the mitigation site.

INSTRUCTIONS FOR PERMIT APPLICATION
TO WORK IN
DNR PUBLIC WATERS OR WETLANDS
1. Statutory Authoritv: Minnesota Statutes 9 103G.245 makes it unlawful for the state, any person, partnership,
association, private or public corporation, county, municipality or other political subdivision of the state, to
change the course, current or cross-section of any DNR public waters or wetlands without a written pennit
previously obtained from the Commissioner of Natural Resources. Warnina: Any work in DNR public
waters or wetlands that requires a pennit cannot legally be started until a penn it and a Notice of Permit Card
have been issued by the Department of Natural Resources. Any work in a public waters or wetlands without
a penn it is a misdemeanor and is punishable by fines up to $700 and/or 90 days in jail. The Commissioner
also has the authority to require restoration of any work done without a permit or beyond the work authorized
by a penn it and shall assess double the additional application fees, as well as the actual cost for any field
inspection.
2. Who should apply: Application must be made on the attached fonn and submitted to the DNR Regional
Office for the area where the proposed project is located (see map below), by the riparian (shoreline) owner
of the land on which the project is proposed, except:
a. A government agency, public utility or corporation authorized by law to conduct the project may apply if the
property rights acquired or to be acquired are fully described in the application. An authorized agent should
be identified on the application in Part I and sign where appropriate.
b. A holder of appropriate property rights such as a lease or easement may apply provided that the application
is countersigned by the owner and accompanied by a copy of the lease or other agreement. A penn it will be
issued for the tenn of the lease only.
c. A prospective lessee of state-owned lands may apply for a permit in their own name after a lease has been
requested fro the Department responsible for the affected lands. The lease request and the penn it
application will be processed concurrently.
3. Fees and Application Instructions: No DNR penn it can be processed until all application fees have been
paid. Contact the appropriate Regional Office (see below) for full Public Waters Work Pennit application
instructions, the checklist DNR uses to identify projects subject to Minnesota Pollution Control Agency
review, and fee information. These instructions, checklist and fee infonnation can also be viewed on the
DNR's web site at http://www.dnr.state.mn.us/waters/forms/indexlhtml.
Make sure that you furnish all information that is requested in the full application instructions and
sign the application form. Lack of requested information and required fees would cause delay in

The proposed trail will be installed in a way to act as a ditch block to divert water to the proposed mitigation site. The ditch block should have a
positive affect on a large existing wetland located northwest of the mitigation site by restoring a higher outlet resulting in fully or at least partially restoring
the hydrology of this basin. Raising the outlet elevation higher than 905.0 is not possible due to potential flooding of land that is outside ownership of the
city. The restoration of the existing wetland is an added benefit and is not included in the mitigation calculation. The proposed mitigation will be
accomplished by excavation. Flows from the ditch will be directed to the mitigation site prior to discharge into the ditch. Soil pits dug during the
delineation indicate a clay later approximately 8-inches below the surface. This clay layer will be stockpiled and re-spread on the mitigation site to a
depth of 6-inches. This combined with excavation of the mitigation site to an elevation that is near the ditch bottom should eliminate the potential scope
and effect of the ditch on the mitigation site.

3. The replacement wetland was not drained or filled under an exemption during the previous ten years; AND,
4. The replacement wetland was not restored with financial assistance from public conservation programs, unless the
replacement wetland qualified under Minn. Rules Chapter 8420.0540, Subp. 2. D. (3). [Check here if applicable OJ; AND,
5. The replacement wetland was not restored using private funds other than those of the landowner unless the funds are
paid back with interest to the individual or organization that funded the restoration and the individual or organization
