Call to Order Chair Rotty called the meeting to order at 7:00 p.m. Members Present: Rotty, Bonar, Kuyper Franceschelli Members Absent: Vanderbeck Also Present: Lee Smick - City Planner, Tony Wippler - Assistant City Planner, 2. Approval of Minutes a) May 10, 2011 Regular Meeting Minutes MOTION by Franceschelli , second by Bonar to approve the minutes as presented. APIF, MOTION CARRIED. 3. Public Hearings a) Continued - Ordinance Amending Section 6-4-2 related to Keeping Animals within the City and Adding Section 6-4-6 Chickens on Urban Residential Lots. Assistant Planner Wippler noted that an administrative permit is being proposed. Notification would be to adjacent property owners. After this process a yearly renewal permit would be required. Initial administrative permit fee could be $100 (public hearing and notification of adjacent property owners), to cover the city's costs. The renewal permit proposed fee $25/yearly. MOTION by Kuyper, second by Franceschelli to close the public hearing. MOTION by Kuyper second by Bonar to recommend approval of the ordinance. APIF, MOTION b) Conditional Use Permit to allow outdoor sales within the B-2 Zoning District for the purpose of selling fireworks - 115 Elm Street (Econofoods) Assistant Planner Wippler noted that the applicants have requested approval of a Conditional Use Permit to allow outdoor sales offireworks. Conditions of this CUP would be for the applicant to obtain the necessary permits from the Fire Marshal and sign permits from Planning. MOTION by Kuyper second by Franceschelli to close the Public Hearing. APIF, MOTION CARRIED. MOTION by Kuyper, second by Franceschelli to approve the Conditional Use Permit with the conditions as discussed. APIF, MOTION CARRIED. c) Conditional Use Permit to expand a Convenience Store with Gas within the B- 2 (Downtown Business) Zoning District. - 217 Elm Street. Assistant Planner Wippler noted that Kwik Trip would like to expand the southern side of building approximately 15 feet. The purpose of this expansion will be for food preparation. Staff would recommend to have the stores sidewalk extended to the public sidewalk, along Hwy 50, as a condition of this expansion. Planning Commission is recommending screening of mechanical equipment being proposed on the side of the building. MOTION by Franceschelli second by Kuyper to close the Public Hearing. APIF, MOTION CARRIED. MOTION by Kuyper second by Bonar to approve the Conditional Use Permit with the indicated conditions. APIF, MOTION CARRIED. Planning Commission Minutes May 10, 2011 Page 2 d) An Ordinance amending Section 10-2-1 of the City Code as it relates to the definitions for private school and public school. Chair Rotty recommended that the commission review and make comments to staff. MOTION by Franceschelli second by Kuyper to table this item until the next regular Planning Commission meeting. APIF, MOTION CARRIED. Planner Smick stated that staff would like to have a workshop to discuss the transportation plan and that they are beginning to look at the 2030 Comprehensive Plan update (2-3 year). 5.
