Call to Order Chair Rotty called the meeting to order at 7:00 p.m. Members Present: Rotty, Bonar, Vanderbeck, Franceschelli Members Absent: Kuyper Also Present: Lee Smick - City Planner, Tony Wippler - Assistant City Planner, 2. Approval of Minutes a) June 14, 2011 Regular Meeting Minutes MOTION by Franceschelli , second by Bonar to approve the minutes as presented. APIF, MOTION CARRIED. 3. Public Hearings - Continued Business a) An Ordinance amending Section 10-2-1 of the City Code as it relates to the definitions for private school and public school. Assistant Planner Wippler reviewed with the Board that the school district is in the process of constructing a clinic within the High School. Staff is proposing to amend the zoning definitions for public and private schools to include verbage regarding clinics as accessory uses that serve school district employees and their dependents. Member Franceschelli expressed concerns with regard to dispensing medication in a facility that has a drug policy, access to the clinic and location of clinic. (educational need). Member Bonar suggested removing the words "school related activities". MOTION by Vanderbeck, second by Franceschelli to close the public hearing. MOTION by Bonar second by Vanderbeck to recommend approval of the ordinance with the modified language. VOTING FOR: Rotty, Bonar, Vanderbeck. VOTING AGAINST: Franceschelli. MOTION CARRIED. b) Conditional Use Permit to allow a Commercial Daycare Center within the B-1 (Highway Business) Zoning District. -19645 Pilot Knob Road (Charleswood Marketplace Mall) Planner Smick noted that the applicants are proposing to operate a child daycare center in the B-1 zoning district. They are proposing to fence in an area on the west side of the building for a play area. It is recommended to require bollards for this area. Angela DeAndriano explained about the play area and what the reasoning was for the site they selected. The consensus of the board was to have the business owner and developer look at this issue and bring it back to the board. Angela stated that they meet the requirements for daycare without the park area and would like to move forward with this and address the park at a later time. MOTION by Vanderbeck second by Franceschelli to close the Public Hearing. APIF, MOTION CARRIED. MOTION by Vanderbeck, second by Franceschelli to approve the Conditional Use Permit without the play area and to provide staff with the provision that the park is not required by law. Also, to apply for any sign permits andbuilding permits that may be necessary. APIF', MOTION CARRIED. Planning Commission Minutes July 14, 2011 Page 2 4. Discussion a) Fairhill AUAR Update - The AUAR update needs to be performed. The AUAR needs to be updated every 5 years until development in the area has been approved. The following revisions were made: Low, low-medium and medium density residential ranges were updated. 195th Street and the roundabout were discussed in the 2011 update as being completed. Diamond Path Road still remains in the AUAR as a planned roadway, the channel realignment of North Creek was discussed in the 2011 update and the entire Transportation Section has been revised in the 2011 update to include the completion of 195th Street. 5.
