1. CALL TO ORDER
The meeting was called to order by Chair Larson at 6:30 p.m.

a) EDA Powers and Status/Future
At a previous EDA meeting, members wanted to determine if there were things an
EDA can do that a City Council cannot do. The City Attorney provided
information showing there are things an EDA can do that a City Council cannot
do. The majority of the members agreed the EDA is needed. Councilmember
May disagreed, because most of the items deal with a taxing authority and most of
the motivation is the EDA's levy power. She felt it is more transparent to operate
with a City Council. We could still have a functioning commission, but eliminate
the need for a tax return and audit. Most of the items listed have to do with a
taxing authority. Member Bonar felt there is a valid role for the EDA. Its

representation should be predominantly appointed individuals, not elected. This
is for diversity versus duplicity. Council is adept in promoting the interest of
citizens, but the EDA should be a balanced group of diverse opinions. It is a
return to the past. Member Fogarty agreed, stating she was one of the dissenting
votes when it was restructured from a seven member board to five members
consisting only of Council. Council would interview candidates and we can
ensure we have a broad spectrum. Member Jolley agreed there should be a
division of responsibilities and you get more input when you have a group
dedicated to EDA only and not to City business. Member Bartholomay agreed
with restructuring the EDA and having more resident involvement. Chair Larson
would like to see this accomplished by year end. Member Fogarty noted we also
have the discretion to decide if we want five members or seven members. This
should be discussed over the next couple of meetings.
b) EDA Strategic Plan
City Planner Smick presented the Economic Development strategic plan. She
also revised the mission and vision statements. A mission statement is who we
are and why we are here. The vision states what we want to be. Members agreed
with the statements. The plan also contains a SWOT analysis. City Planner
Smick felt the City has a huge opportunity to bring in Dakota County Technical
College to partner with businesses. We also need to pay more attention to the
fairgrounds and market Farmington during events held there. A weakness is we
do not have enough apartments.
Mr. Chris Schwartz, a Farmington resident for 18 years, ran a family business
since 1985, was a business broker for three years and currently works at Re-Max
doing business development in Minnesota and Wisconsin. Regarding diversified
housing stock, there is a huge glut of rental property right now, so apartments are
struggling. There are investors buying up single family homes for rental
properties. He agreed we do not have a diversified housing stock. At the other
end, we do not have a high end housing stock.
City Planner Smick also reviewed a tracking sheet to keep track of activities being
done and what is coming up. Ruthe Batulis, Dakota County Regional Chamber,
noted a matrix would be helpful with this for example showing the permitting
process takes x number of days. She will provide an example from Owatonna.
Mr. Schwartz stated Farmington's process for opening a business is very easy and
friendly. City Planner Smick asked members to list types of businesses they
would like to see. Members listed a hotel, grocery store, and retail. Member
Fogarty felt it is not the City's role to create and foster competition, but it is also
not our job to protect existing businesses. The number one goal is to create an
environment that is inviting for everyone.
Mr. Schwartz suggested determining what the City's assets are. Where is our
developable land, where are the vacancies? He suggested partnering with a
developer rather than a broker. Tell a developer what you would like to see and

let the developer contact the businesses. A developer is here for the long term.
Member Bartholomay asked about the value of marketing programs and is our
name out there enough. Mr. Schwartz replied probably not. It is not something
you should devote a tremendous amount of resources to, but a couple years ago
you sent out a nice package that showcased Farmington and included a short
economic plan. Those are the tools you want to give to a developer. Member
May stated we should be best friends with Vermillion River Crossing
representatives. They should know what the City wants and we should do what
we can to help them. If we can get that going, it will greatly compliment
downtown. We have the developer and we need to nurture that relationship.
Chair Larson stated he and City Administrator McKnight met with the
representative last week. The representative was not up to date on what was
being done in that development. Mr. Schwartz noted they met with the broker,
not the developer. There isn't a developer out there. There are developers in
town, who want to see Farmington succeed and have the capital to make that
happen. Currently the bank owns the land at Vermillion River Crossings, land is
available and the price is greatly reduced. Mr. Schwartz suggested making that
information available and do some research on good developers. Tell them our
community wants these types of businesses. Staff will contact the bank. Member
Fogarty hears people want to do their shopping in Farmington so they want retail.
Member Jolley felt there will always be a grocery store here. If we set goals, that
should not be one of them. Our time is better spent pursuing a hotel. Member
Bartholomay stated whatever marketing staff does, a grocery store should still be
included. Member Fogarty stated we need to stay neutral when bringing in new
business. A competing business should not be brought in because the City offered
them an incentive. Chair Larson stated in order for Vermillion River Crossing to
fill up, it needs an anchor store for smaller businesses to build around. Mr.
Schwartz noted the Cub in Apple Valley owns the side lots and that causes a lot of
competitive disadvantages for people to build there. So you have to be careful of
the anchor you get. You don't necessarily need an anchor. Sometimes a
developer knows a good tenant mix. People shop the way they commute. If they
go north, they shop in the north. Member May stated a Trader Joe's would
provide a bigger store and something different than our neighbors.
City Planner Smick will be working with the Dakota County Regional Chamber
to be introduced to developers and economic development people in the county.
Member Bartholomay asked about the Greater MSP group. Ms. Ruthe Batulis
cautioned to be prepared first with what our offerings are. You do have to pay to
be involved with this group. In April there will be an event for Chambers and
cities to look at expansion efforts. City Planner Smick has also attended several
Chamber events and made business contacts. Also, Dakota County Technical
College held an event at Dunn Bros. and they would like to bring their professors
to talk to Farmington businesses about learning how to do business.
Chair Larson asked Mr. Schwartz what we do well, and what do we need to work
on. Mr. Schwartz stated you need one point person. Ifit's everyone's

responsibility, it's no one's responsibility. You need outside the box thinking.
He suggested the TH3 area needs to be visually cleaned up. He felt there is
nothing we need to do better. Our process is good and the people are friendly.
We have vacant buildings that would be interesting for entrepreneurs to purchase.
We have raw land for industrial. Our asset is affordable housing. People can
move out of apartments and into affordable housing. The City shrunk the north
liquor store so if people want fine wine, they stop at Apple Valley on the way
home. By shrinking the space, we allowed people to go north. We need to
protect our borders by providing services people get elsewhere. Develop at those
borders. Member Fogarty felt we need to create a destination and capitalize on
what we do have downtown. Member Bonar felt we should be branding for what
is absent in the market, not what is available. It is hard to draw the demographics
we represent south rather than north. Member Fogarty agreed we have to create a
destination. Mr. Schwartz noted the fairgrounds and the trout stream are a
tremendous opportunity for marketing.
10. CITY STAFF REPORTS
a) GROW Update
City Planner Smick attended the GROW Steering Committee meeting this week.
Sunny Bahkta, with Comfort Inn was in attendance. She asked for information on
population numbers and traffic numbers and staff has provided that information.
A 70-room hotel would require 2-3 acres.

Easy to Use Guide"

INTRODUCTIONIDISCUSSION
When commercial/industrial applicants fill out a permit, staff gives them verbal instructions
about how to go through the permit process. There are no written instructions available to
applicants concerning the permits. In order to make the City more business friendly, staff has
prepared an "Easy to Use Guide" for applicants to review before submitting the permits/licenses
for review. The "Guide" includes things such as Home Occupation Permits, Conditional Use
Permits, Design Standards for the Downtown Oyerlay Zone, Sign Permits, Liquor licenses,
Massage Therapy and other permits/licenses all to achieve the goal of making the permitting
process easIer.
ACTION REQUIRED

concerning it.

CITY OF FARMINGTON PERMITS
SIGNAGE
This guide specifies the general standards and requirement of the Sign Code in the City of
Farmington. Please also consult Section 10-6-3 of the City Code before applying fora sign
permit and for complete information on signs. What zoning district the property is in plays a
key role in how much signage is permitted. A Farmington zoning map and the City Code are
found at ci.farmington.mn.us under the Department/Planning section of the website.
An important function of signage is to assist in the efficient identification and advertisement
of business locations, products and services, and public facilities. Sign regulations are used
to promote efficient identifications and to set standards, as well as ensure signs contribute
positiyely to the City's image. For a complete list of sign types and regulations, please con-
sult Section 10-6-3 of the City Code or contact the City Planners at 651-280-6820 or 651-280-
6822.

Rotating, Moving, Animated, Or Flashing Signs Rotating: moving or flashing signs shall not be
permitted in any district.
Traffic Interference: No sign shall be erected that, by reason of position, shape or color
would interfere in any way with the proper functioning or purpose of a traffic sign or signaL.
Snipe Signs: There shall be no use of snipe signs anywhere within the city. A snipe sign is any
sign of any material whatsoever that is attached in any way to a utility pole, tree or any ob-
ject located or situated on public property.
Roof Signs: Roof signs, roof adyertising symbols, roof logos, roof statues or roof sculptures
shall not be permitted in any district. No sign shall extend aboye the roofline.
Public Rights Of Way: No sign shall be upon or overhang any public right of way, with the ex-
ception of B-2 districts where an overhang of fifteen inches (15") is possible.
Obsolete Signs: Signs which advertise an activity, business, product or service that has not
been produced or conducted on the premises for more than thirty (30) days and are consid-
ered obsolete.

CITY OF FARMINGTON PERMITS
CONDITIONAL USE PERMIT
Conditional uses are potential uses that may have conditions set to its approyal. They may
be allowed or denied by the board of adjustment in accordance with Section 10-3-5 of the
Code. The board of adjustment may place upon the conditional use any reasonable condi-
tions of approval that are deemed necessary to mitigate any adyerse impacts to neighboring
properties.
1. Applications for conditional uses need to be filed with the planning staff.
2. The planning staff sets a public hearing for the CUP.
3. The planning staff mails a notice to property owners within three hundred fifty feet
(350') the subject property. Failure of those owners to receive notice does not inyalidate
the proceedings.
4. The board of adjustment must take action within sixty (60) days unless the petitioner
agrees in writing to a time extension.
5. The approyed site plan (see attached) and all required conditions shall be filed by the
applicant with the planning staff within thirty (30) days of final approval.
A conditional use will be approyed if it is found to meet the following criteria:
1. The proposed use conforms to the district permitted and conditional use provisions and
all general regulations of this title.
2. The proposed use does not inyolye any element or cause any conditions that may be dan-
gerous, injurious or noxious to any other property or persons and complies with the per-
formance standards listed below.
3. The proposed use be constructed, designed, sited, oriented and landscaped to produce
harmonious relationship of buildings and grounds to adjacent buildings and properties.
4. The proposed use produces a total visual impression and environment which is consistent
with the environment of the neighborhood.
5. The proposed use organizes vehicular access and parking to minimize traffic congestion in
the neighborhood.
6. The proposed use preserves the objectives of Section 10-3-5 and is consistent with the
comprehensiye plan.

CITY OF FARMINGTON PERMITS
VARIANCE PERMIT
The board of adjustment has the power to hear requests for variances from the require-
ments of any official control including restrictions placed on nonconformities. Variances are
only permitted when they are in harmony with the general purposes and intent of the Code
and when variances are consistent with the comprehensive plan. Variances may be granted
when there are practical difficulties in complying with the Code. The board of adjustment
may impose conditions in granting of variances. A condition must be directly related to and
must bear a rough proportionality to the impact created by the yariance.
"Practical difficulties" as used in connection with the granting of a yariance, means that the
property owner proposes to use the property in a reasonable manner not permitted by an
official control, the plight of the landowner is due to circumstances unique to the property
not created by the landowner; and the variance, if granted, will not alter the essential char-
acter of the locality.
Practical difficulties inClude, but are not limited to, inadequate access to direct sunlight for
solar energy systems and variances shall be granted for earth sheltered construction as de-
fined in state law when in harmony with this code.
(A) The following are required with a variance application unless waived by the zoning offi-
cer:
1. A boundary surveyor an area survey including the property in question and up to three
hundred feet (300') beyond showing: topography, utilities, lot boundaries, buildings, ease-
ments and soil test data if pertinent (see attached site plan).
2. A site development plan showing buildings, parking, loading, access, surface drainage,
landscaping and utility service.
(B) Procedure for obtaining a variance are as follows:
. 1. The property owner or agent files with the zoning officer an application form together
with required exhibits plus a filing fee in an amount established annually by the city council.
2. The zoning officer sets a public hearing, transmits the application directly to the board of
adjustment and mails a notice to property owners adjacent to the subject property disre-
garding public rights of way. Failure of such owners to receiye notice does not invalidate the
proceedings.
3. The board of adjustment within sixty (60) days of submittal of all required exhibits, ap-
proyes, denies or approves under conditions accepted by the applicant.
(C) The board of adjustment does not approve any variance request unless they find that
"practical difficulties" as previously defined exist using the following criteria:
1. Because the particular physical surroundings, or the shape, configuration, topography, or
other conditions of the specific parcel of land inyolved, strict adherence to the regulations
of this title would cause practical difficulties. Economic consideration alone does not consti-
tute practical difficulties.
2. That the yariance would be consistent with the comprehensiye plan.
3. That the yariance would be in harmony with the general purposes and intent of this title.
4. The conditions upon which a variance is based are unique to the parcel of land for which
the variance is sought and are not applicable, generally, to other properties within the same
zoning classification.
5. The alleged difficulty or hardship is caused by this title and has not been created by any
persons presently having an interest in the parcel of land.
6. The granting of the yariance will not alter the essential character of the locality or be in-
jurious to other property in the vicinity in which the parcel of land is located or substantially
diminish property yalues.
7. The proposed yariance will not substantially increase the congestion of the public streets,
or increase the danger of fire, or be detrimental to the public welfare or public safety.
8. The requested yariance is the minimum action required to eliminate the practical difficul-
ties.
9. Variances may not be approyed for any use that is not allowed under this title for prop-
erty in the zone where the affected person's land is located except that the temporary use
of a one-family dwelling as a two-family dwelling may be authorized by variance.

HOME OCCUPATIONS
The City of Farmington Zoning Ordinance permits the
conduct of businesses in residential districts. The standards for home occupations
are intended to seek a balance between supporting a quiet, safe, and aesthetic resi-
dential environment while supporting the aspirations of home-based entrepreneurs.
Operating a home business requires approval by the Farmington Planning Commis-
sion. A home occupation is a business or commercial activity that is conducted from
a single-family attached or detached dwelling, duplex, apartment, or mobile home
and is clearly incidental to the residential use of the dwelling. A Conditional Use
Permit is required for a home occupation. All home occupations must conform to
the City Code.
Examples of Home Occupations include, but are not limited to the following:
. Handicrafts
. Dressmaking
. Home offices
. Teaching music, dance, art to only one person at a time
. Home beauty salon/barber with no more than one chair or work station
. Photography
. Telemarketing-
Review of home occupations by the City of Farmington helps to maintain property
values by ensuring that the location and type of business does not adversely affect
the character of a residential neighborhood. Anyone who runs a business from their
home within the city limits of Farmington is required to have a valid Conditional Use
Permit for a Home Occupation.
The permit costs $200 for the city application and $46 paid to Dakota County for re-
cording fees.
A home occupation is permitted (Section 10-6-2) as an accessory use if it complies
with the requirements of Section 10-3-5 following all procedures outlined for ap-
proval.of a conditional use.
(A) The home occupation needs to be conducted solely and entirely by persons who
reside full time in the home.
(6) The home occupation needs to be conducted wholly within the principal or acces-
sory structures.
(C) No structural alterations or enlargements can be made for the sole purpose of
conducting a home occupation.
(D) Only one home occupation is permitted for each principal structure.
(E) Exterior displays or signs other than a two (2) sided, two (2) square foot, non-
illuminated sign and exterior storage of materials and exterior indication of the
home occupation or variation from the residential character of the principal struc-
ture are not be permitted.
(F) The activity does not involve the manufacture, assembly or distribution of goods
and the activity does not deal with the general retail public.
An application is attached for your convenience in applying for a conditional use per-
mit for a home occupation. The application also requires a brief written statement
describing the proposed home occupation. The description should include informa-
tion such as the type of business, equipment used, operating hours, and the average
number of people per day to come to the home for products or services.
Also, explain any problems or conflicts the business may have with the home occupa-
tion requirements or criteria.
Upon submittal of the application, the Planning Department staff will put together a
list of individuals who live within 350 feet of the proposed business to notify them of
a public hearing at the Planning Commission (meets 2nd Tuesday of the month). An
application submittal is due 3 weeks before the Planning Commission meeting.

OVERLAY DISTRICT
DESIGN STANDARDS
This guide specifies the general standards and requirements of the Downtown Design
Standards in the City of Farmington. Please also consult Section 10-6-28 of the City
Code before applying for a building permit and for complete information on the
overlay district. The Downtown Overlay District was established in 2010 in order to
ensure aesthetics in the Downtown were maintained by bridging the gap between
historical buildings and new construction, renovations, and additions. This is accom-
plished by utilizing certain building materials, awnings, window treatment, fencing,
and signage. Below are criteria for review pertaining to the standards.
. New construction, renovations, or additions, needs a mixture of 2 or more of the
predominant downtown finish materials (clay, brick, stucco, natural stone, orna-
mental concrete).
. Transparent glass makes up 50% to 75% of the total wall area of the first floor ele-
vation on the primary fac;ade.
. Blank, windowless walls are avoided wherever possible.
. Exterior walls cannot be covered with metal panels, EIFS (exterior insulation and
finish system), vinyl siding, faux half timbering, logs, shakes, shingles, exposed
aggregate, or poured in place concrete.
. Preassembled clay brick panels, artificial stucco, decorative precast units resem-
bling stone needs to match the appearance of historic materials.
. 'Trademark" commercial building types need to meet the architectural style of
the downtown.
. Colors and/or building materials shall distinguish the street level from the upper
stories.
. Imitation of historical styles shall be encouraged.
. New commercial buildings bridge the gap between old and new buildings.
. Large "big box" commercial buildings appear as multiple storefronts by breaking
the facade into smaller bays of 20 feet in width.
. The size, scale, massing, and facade materials of new construction complement
the architectural character of existing historic buildings.
. Corner buildings shall be designed with 2 street facades and a main entrance on
both sides.
. The maximum height of new construction is 45 feet.
. Rooflines shall be flat or gently sloping.
. Awnings are allowed with conditions.
. Decorative Fencing consists of wrought iron, vinyl, and Ornamental aluminum.
. Projecting signs perpendicular to the building, wall signs flat along the building
frontage, painted wall signs, A-frame signs, and monument signs are allowed with
conditions.
These standards mentioned apply.to all new construction and renoyations or additions of ex-
isting commercial structures in the downtown commercial district and will be required to
meet the design standards in the downtown commercial overlay district, unless otherwise
provided. Projects exempt from meeting the standards are those commercial buildings that
are comprised of any of the following project types:
1. Interior remodels;
2. Buildings used solely for residential purposes;
3. Normal or routine maintenance and repair of existing structures;
4. Construction that does not require a building permit.

CITY OF FARMINGTON
LICENSE PROCESS
On-Sale Liquor, Sunday Liquor or Club License
On-Sale Intoxicating Liquor Licenses can only be issued to hotels and restaurants. Please review
Title 3 Chapter 12 of the City Code for complete details. All licenses expire December 31 of
each year. Following is the process to obtain an on-sale liquor license:
1. Application forms, fees, and a Certificate of Insurance showing liquor liability coverage
through December 31 of the current year should be submitted to the City of Farmington.
2. A background check will be performed by the Farmington Police Department.
3. A public hearing is required to be held at a City Council meeting. The public hearing
requires 10 days notice prior to the meeting. The public hearing notice is submitted to
the newspaper a week prior to this 10-day period. Council meetings are held the first and
third Mondays of every month.
4. Upon City Council approval, the application is submitted to the State for approval and a
license is issued. The State can take up to 30 days to approve it. At this time, the
applicant should submit an application to the state for a Buyer's Card which enables them
to buy liquor to sell. The entire application process takes approximately 6-8 weeks.
5. Fees: On-Sale Liquor License $3,500/year
On-Sale Sunday Liquor License $200/year
Investigation Fee $300
On-Sale Club License $300/year
Therefore, the first payment for On-Sale Liquor and Sunday Liquor will be for $1,225;
subsequent quarterly payments will be $925.

LICENSE PROCESS
3.2 On-Sale / Off-Sale Beer License
Retail on-sale 3.2 beer licenses can only be issued to drugstores, restaurants, hotels, clubs, and
establishments for the sale of non-intoxicating malt beverages, all forms of tobacco, beverages
and soft drinks at retail.
Retail off-sale 3.2 beer licenses permit the licensee to sell non-intoxicating malt liquors in
original packages for consumption off the premises only.
Please review Title 3 Chapter 2 of the City Code for complete details. All licenses expire
December 31 of each year. Following is the process to obtain a 3.2 on-sale or off-sale beer
license:
1. Application forms, fees, a Certificate of Insurance showing liquor liability coverage

Strong Beer License
Wine licenses can be issued to restaurants for the sale of wine not exceeding 14% alcohol. A
holder of a wine license who is also licensed to sell on-sale 3.2 beer and whose gross receipts are
at least 70% attributable to the sale of food, is authorized to sell intoxicating malt liquor at on-
sale without an additional license. Please review Title 3 Chapter 12 Section 4E of the City Code.
All licenses expire December 31 of each year. Following is the process to obtain a 3.2 on-sale
beer and wine license:
1. Application forms, fees, and a Certificate of Insurance showing liquor liability through
December 31 of the current year should be submitted to the City of Farmington.
2. A background check will be performed by the Farmington Police Department.
3. A public hearing is required to be held at a City Council meeting. The public hearing
requires 10 days notice prior to the meeting. The public hearing notice is submitted to

INTRODUCTIONIDISCUSSION
City staff continues to complete items from the Economic Development Strategic Plan (EDSP).
The following items have been addressed as shown on the attached tracking sheet:
1. Review components of the EDSP.
2. Review mission and vision.
3. Review SWOT.
4. Defme roles of ED A, Staff and Stakeholders.
5. Remove barriers for conducting city business.
6. Improve the regulatory environment for business (Le. streamlining permits)
7. "Doing Business Guide" has been completed.
At the April 23, 2012 EDA meeting, staff will discuss the Business Retention and Expansion
program with the EDA which includes EDAlFBA/Chamber business visits. Staff will also
discuss the creation of a satisfaction survey when a new business is welcomed to town and they
comment on the communication they received from the EDA, Stakeholders, and staff. A date
will be set to meet with the property owners of the land west of Pilot Knob Road to discuss the
owner's intentions for the property. Broker calls and business meetings will also be discussed.

INTRODUCTION
The EDA has discussed changing the composition of the EDA from five Councilmembers and
two residents to a different composition of members.
DISCUSSION
Currently the EDA is comprised of five Council members and two residents. At the February
EDA meeting, members discussed changing the composition. In order to proceed, staff needs
direction on the following:
1. Should the total number of ED A members be five or seven? According to State Statute,
the EDA does have to include two Councilmembers. With five members there would be
three residents, with seven members there would be fiye residents. The current two ex-
officio seats would be changed to official seats.
2. Keeping in mind we are starting the strategic plan now, do you want to make this change
as soon as possible, or wait until February 2013 when new terms begin?
3. Depending on the effective date, it needs to be determined which Councilmembers will
serve on the EDA. It should be one person from each set of terms (Larson or Donnelly or
May) and (Bartholomay or Fogarty).
BUDGET IMP ACT
The stipend for the ED A is $10/person/meeting.
ACTION REQUESTED
Once the above questions are answered, recommend to Council that a public hearing be held to
change the composition of the EDA and following the hearing, an advertisement be placed for
applicants.
