APPROVAL OF MINUTES a) February 14,2012 Regular Meeting 3. PUBLIC HEARINGS None 4. DISCUSSION ~ A Proud Past - A Promising Future Committed to Providing High Quality, Timely and Responsive Service, to All Of Our Customers a) Findings of Fact - Denial of Interim Use Permit for an auto repair-major and auto sales use in the 6.4 Zoning District - 821 3rd Street . b) 2030 Comprehensive Plan - 2011 Amendment - Verbal Update 5. ADJOURN ~ I Planning Commission Minutes February 14, 2012 Page 2 primarily uses this area. The applicant would be permitted to park vehicles in front of the storages area. Vehicles that are being repaired would not be allowed to be parked in the west parking lot. Dave Kennedy, 312 Maple St., expressed concerns regarding this type of business use. There has been a lack of enforcement for violations at this property and a disregard for his property. He is concerned that this would continue. If approved he would like to request a privacy barrier as a condition of this use. Member Bonar verified that the previous similar use was done without seeking approval from the Planning Commission. Planner Smick stated that was the case. He was puzzled why the applicant would make this type of request knowing it wasn't an approved use. Member Franceschelli referenced #6 of staffs recommendation, specifically that the purpose is consistent with the Comprehensive Plan, he disagree's with the statement because he feels there are better areas for this type of business. He feels the zoning should stay as B-4. Member Kuyper echoed the concerns of the other members. He would be concerned about noise and the duration of parked vehicles. Member Primmer asked if current businesses had or needed a CUP. Planner Smick stated they did not, however, staff just recently learned of some of the businesses and they are not permitted uses. Member Rotty shared the history of the previous auto use. The consensus ofthe Commission is this is not the location for this type of business. Mr. Gathungu disputed the decision of the commission. MOTION by Kuyper second by Primmer to close the Public Hearing. APIF, MOTION CARRIED. MOTION by Franceschelli second by Kuyper to deny the Conditional Use Permit because 1) the use doesn't comply with current zoning and 2) inadequate buffer within the neighborhood, and request Findings of Fact for the next meeting. APIF, MOTION CARRIED. Member Rotty explained to the applicant and building owner that there is an appeal process that would go to the City Council and must be appealed with 10 days. 6. Discussion a) Downtown Fringe Properties - 2011 Comp Plan Amendment Planner Smick indicated that post cards were sent out to property owners within the areas identified as #1 and #2, to see if they would prefer to have their property zoned B-2 or R-T. A total of6 owners were notified and 4 replied back. All responses were in favor of rezoning their properties to R- T. This is for informational purposes only. b) 2012 Meeting Schedule - Calendar The 2012 meeting schedule was provided to the Commission for informational purposes only. c) Member Franceschelli indicated that there are vacancies on the Heritage Preservation Commission and would encourage any persons interested in serving, contact city staff. 7. ACTION REOUESTED Review the Findings of Fact and either approve and/or request revisions to the findings. cVL Lee Smick, AICP City Planner cc: Francis Gathungn CITY OF FARMINGTON DAKOTA COUNTY, MINNESOTA IN RE: Francis Gathungn Request for an interim use permit for auto sales and repair at 821 Third Street, Farmington, MN 55024 FINDINGS OF FACT On February 18,2012, the applicant requested an interim use permit to stmt an auto repair and sales business in the building at 821 Third Street in Farmington. The Planning Division for the City of Farmington now makes the following Findings of Fact regarding the property addressed as 821 Third Street, Farmington, MN 55024. FINDINGS OF FACT 1. The property is located at 821 Third Street and is zoned B-4 (Neighborhood Business). 2. Per the 2030 Comprehensive Plan, the subject property is guided for Commercial uses. 3. Based on the current zoning and land use designation, the City's prefel1'ed use ofthe property is neighborhood business. 4. On February 19,2002, the B-4 (Neighborhood Business) zone was created. 5. On January 18,2012, the applicant submitted an interim use application to stmt an auto repair and sales business from 821 Third Street. I 6. The B-4 zoning district does not allow for auto repair or sales. 7. Based upon this requested use, the City's Planning Commission did not approve the interim use because the auto repair and sales uses are not an allowed use in the B-4 zoning district. 8. Additionally, the City's Planning Commission stated that the propelty at 821 Third Street was not properly screened for this use and did not approve the interim use permit. 9. The applicant was told thathe may request an appeal to the zoning board's decision within 10 days, but the applicant did not pursue the appeal. Zoning Administrator: (p{~
