In all the years we have lived in Farmington we have never watered on a day we were not supposed to, we understand and abide by this policy. The day in question July 1st, one of our neighbors had just stopped over and advised us that one of our automatic sprinkler system heads needed to be adjusted, that it was spraying in the street and not watering our yard. We have our sprinkling system set on automatic for OUR watering on even days. To adjust the head you need to turn the zone on in that area, which my husband did and adjusted it and headed back towards the house to turn it off when he seen the city employee drive right onto our lawn - yes the city employee drove onto our lawn! Took a picture of the sprinkler head and house number and left. We turned that zone on for less than five minutes to adjust the head so that when our system turned on automatically on July 2nd on our even watering day that we were not wasting water by it spraying in the street. Our system turns on after we leave for work, so on early morning July 2nd on our watering day it was adjusted and all set not to waste water. I do not think that your policy of a city employee out mandating water restrictions has the right to drive onto a resident's yard, this city employee seen my husband working on this and how briefly it took, the city employee waited until my husband walked away to snap the picture of the sprinkler head. If the city is going to hand out citations', hand them out or talk to the resident if they are outside- this could have been resolved right there and then, instead of wasting tax payers dollars mailing these citation's to their home and then not even listing the home owners name on the envelope but addressing it to that of Resident - most mail addressed in that manner is junk mail and would normally be thrown out and then the city would automatically charge our City Of Farmington utility bill and claim that we admit fault by not paying the citation. So we are contesting this citation and are requesting an administrative hearing before the Farmington Water Board, we would like our metered water amount for July 1st available as well for proof that we were not watering on an odd day but adjusting a sprinkler head that took less than five minutes. July 16,2012 City of Farmington 430 Third St. Farmington, MN 55024 To Whom It May Concern: We are in receipt of the Water Use Restrictions Citation issued by "BW-TS" in your office on the 9th of July, 2012. While we do not dispute we were using water on that day after 12:00 p,m" we wanted to bring a few things to your attention, with hope that we might be granted a waiver for this time. It was an odd day, so we didn't realize we were in violation at the time, We are only 2 people running this complex, and we are only here 2 days a week, This community is seniors, and folks with disabilities, so we cannot put watering responsibilities on them, We had a large garbage dumpster that was full of a very foul smelling substance, and had attracted flies, so that was the reason we pulled the hose out. We didn't notice how bad it was until after they had taken the trash that afternoon. While using the hose to wash out the dumpster, which is stored inside the building, it was discovered that one of the trees was wilting from heat and lack of water, so we hooked the sprinkler to the hose for a few minutes to try to give the tree some water. We're here only Mondays and Thursdays, and haven't been watering at all. We might not be here enough to give ample water to the trees, which are more of a concern than the lawn at this time. We will make every effort, but we can't mow and water on the same day when we can't water past noon, so it is a tricky balance. We would sincerely appreciate a waiver for this one violation, and perhaps the possibility of a secondary watering time for our community, as it would be only on those two days during the week. We can guarantee we will not be watering on any other day of the week, so this should do our part in conserving, We also understand that the City of Lakeville provides a warning rather than a fine for their first violation, so we thought we might plead for the same, or at least a hearing in front of the Water Board. Nextel uses the Site for a communications facility that, pursuant to the Lease, may include among other things, an antenna tower or pole and foundation, utility lines, transmission lines, an air conditioned equipment room or shelter and pad, cable wiring, conduit runs, radios and other electronic equipment, transmitting and receiving antennas and microwave dishes, batteries and other power sources (possibly including a generator and pad), related fixtures and supporting equipment, and structures therefor (collectively, the "Communications Facility"). C. By letter dated June 25, 2012, as permitted by the terms of the Lease, Nextel notified Owner ofNextel's election to terminate the Lease, effective as of September 30, 2012 ("Notice"). Owner acknowledges that Nextel's written Notice was properly given and effective. D. Nextel and Owner are willing to so terminate the Lease, pursuant to the provisions of this Agreement. 1 04 iDEN DeComm Lease Termination Agreement 05142012 (Nextel Site # MN0201) AGREEMENT NOW, THEREFORE, in consideration of the mutual covenants contained herein and other good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the parties agree as follows: 1. Date of Termination: Final Payment. a. The Lease is hereby canceled and terminated effective at 11 :59 p.m. on September 30, 2012 ("Termination Date"). From and after the Termination Date, neither Owner nor Nextel will have any further rights or obligations under the Lease, and Nextel will have no further right or interest with respect to the Site. In full and final payment of any and all sums due or owing by Nextel to Owner under the Lease or otherwise in connection with Owner's Property or the Site, Nextel will pay Owner a one-time payment of Fifteen Thousand Dollars ($15,000.00) (the "Final Payment") within ten (10) business days after Owner provides Nextel with: (i) a fully executed Site Acceptance (as defined below); and (ii) if required by Nextel because the entity to whom rent is delivered (as set up in Nextel's rent payment system) is different than the entity defined above as Owner, a fully executed W-9 Form (with the Tax ID Number and signature ofthe entity defined above as Owner). 2. Vacation and Surrender ofthe Site: Site Acceptance. a. Owner and Nextel have expressly agreed that, on or before the Termination Date, Nextel will vacate and surrender the Site to Owner in its current "AS-IS" condition, except that Nextel will remove from the Site the following (the "Removed Equipment") : Nextel's radios and back-up batteries Nextel will have no further obligation (notwithstanding anything to the contrary contained in the Lease or otherwise) to remove the Communications Facility (all of which will be deemed abandoned by Nextel and accepted by Owner) or otherwise repair or restore the Site or any other portion of Owner's Property. b. Upon Nextel's vacation of the Site, Owner and Nextel will each execute duplicate originals ofthe "Site Acceptance and Release" in the form attached hereto as Exhibit A ("Site Acceptance"). Owner's execution of the Site Acceptance will constitute conclusive evidence and proof that Nextel has vacated and surrendered the Site to Owner in the condition required by the Lease and this Agreement, and that any portion of the Communications Facility (and any other equipment or property) remaining on Owner's Property will be deemed abandoned by Nextel and accepted by Owner, on the terms set forth therein. 3. Release of Obligations. Except for Owner's and Nextel's respective rights to enforce the provisions of this Agreement and the Site Acceptance, effective as of the Termination 2 04 iDEN DeComm Lease Termination Agreement 05142012 (Nextel Site # MN0201) Date, Owner and Nextel, for themselves and their respective parent, subsidiary and related corporations, partners, affiliates, heirs, successors and assigns, do each hereby release and forever discharge each other and their present and former directors, officers, shareholders, managers, agents, trustees, beneficiaries, attorneys and employees (the "Released Parties") from all obligations, damages, losses, costs, expenses and liabilities whether known or unknown, contingent or direct, liquidated or unliquidated, and from any claims, demands, judgments, actions or suits of any kind (collectively, "Claims") which they may have against one another arising out of or relating to the Lease, and the use and occupancy of Site, the Communications Facility and/or Owner's Property, including without limitation, any attorneys' fees incurred in connection therewith. Each party acknowledges the possibility that the other party may have unknown Claims against the other arising out of or related to the Lease, and the use and occupancy of Site, the Communications Facility and/or Owner's Property, and that by signing this Agreement, each party expressly waives such Claims. The parties further acknowledge that the consideration for this mutual release takes into account the possibility of such further Claims. 4. Voluntary Agreement. The parties have read this Agreement and the releases contained herein and, on advice of counsel, have freely and voluntarily entered into this Agreement with full understanding of its terms. 5. Recitals. The above recitals are an integral and substantive part of this Agreement and are incorporated herein. 6. Attorneys' Fees. If either party commences an action against the other party arising out of or in connection with this Agreement, the prevailing party will be entitled to recover attorneys' fees and expenses from the other. 7. Successors. This Agreement will be binding upon and inure to the benefit of the parties hereto and their respective heirs, successors and assigns. 8. Counterparts. This Agreement may be executed in any number of duplicate originals or counterparts, each of which will be deemed to be an original, and all of which taken together will constitute one and the same agreement. The parties agree that their signatures may be delivered by fax or email. 9. Governing Law. The validity, interpretation, construction and performance of this Agreement will be controlled by and construed under the laws of the state in which the Site is located. Owner and Nextel are parties to that LEASE TERMINATION AGREEMENT and GENERAL RELEASE dated ,2012 (the "Agreement"), that terminated a Lease for a Site on Owner's Property located at 18515 Pilot Knob Road, Farmington, MN (Nextel Site #MN0201), all terms of which are incorporated herein. Capitalized terms used but not defined herein have the meanings set forth in the Agreement. B. Nextel used the Site for a communications facility that may have included, among other things, an antenna tower or pole and foundation, utility lines, transmission lines, an air conditioned equipment room or shelter and pad, cable wiring, conduit runs, radios and other electronic equipment, transmitting and receiving antennas and microwave dishes, batteries and other power sources (possibly including a generator and pad), related fixtures and supporting equipment, and structures therefor (collectively, the "Communications Facility"). Nextel removed some or all of the Communications Facility and restored the Site and Owner's Property to the condition required by the Lease and the Agreement, and Nextel vacated and surrendered the Site to Owner. The parties now desire to execute this Site Acceptance and Release, pursuant to the Agreement. NOW, THEREFORE, in consideration of the foregoing, the provisions set forth below, and other good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, Owner hereby acknowledges that Nextel has restored the Site and Owner's Property to the condition required by the Lease and the Agreement, and Nextel vacated and surrendered the Site to Owner on or before the Termination Date as required by the Agreement. Farmington, MN 55024 Members Present: Weierke, Snobeck, Jensen Members Absent: None Staff Present: City Engineer Schorzman, Administrative Assistant Miller. 1) Call to Order: The meeting was called to order at 7:00PM by President Weierke.. 2) Approve Agenda: Motion by Jensen second by Snobeck to approve the agenda as presented. APIF, Motion Carried. 3) Approve Minutes - June 25, 2012: Motion by Snobeck, second by Jensen to approve the minutes as presented. APIF, Motion Carried. 4) Water Citation Appeals a. Bob & Monica Rahn, 18546 Egret Way: Monica Rahn was present, citation stands as issued. b. John Jordan, 4842 _190th St. W.: Present, citation stands as issued. c. Katie Kehneman, 18700 Dunbury Ave.: Not present, correspondence reviewed, citation stands. d. Catherine Kohout, 315 Spruce Street: Not present, correspondence reviewed, citation stands. 5) New Business a) Termination of Lease Agreement - Sprint: Engineer Schorzman indicated that Sprint has requested to terminate the lease agreement. Sprint has offered $15,000 to leave the equipment. Sprint would remove the radios and batteries. After discussion the consensus was to not accept the termination agreement. Motion by Weierke second by Jensen to deny the terms of the agreement for termination. APIF, Motion Carried. 6) Approve Bills - Member Jensen asked about the Department of Health bill and Ferguson Waterworks bill. Engineer Schorzman will research and report back. Motion by Weierke second by Snobeck to approve the bills in the amount of $45,937.98. APIF, Motion Carried. 7) Open Forum - Engineer Schorzman informed the Board that 121 watering citations have been issued through noon today. The Board reviewed the well pumpage report. 8) Adjourn: Motion by Weierke, second by Jensen to adjourn at 7:47 pm. APIF, Motion Carried.
