Call to Order Chair Rotty called the meeting to order at 7:00 p.m. Members Present: Rotty, Franceschelli, Kuyper Members Absent: Bonar, Primmer Also Present: Tony Wippler Assistant City Planner 2. Approval of Minutes a) June 12, 2012 Regular Meeting Minutes MOTION by Kuyper second by Rotty to approve the minutes as presented. VOTING FOR: Kuyper, Rotty. ABSTAIN: Franceschelli. MOTION CARRIED. b) July 10, 2012 Regular Meeting Minutes MOTION by Franceschelli second by Rotty to approve minutes as presented. VOTING FOR: Franceschelli, Rotty. ABSTAIN: Kuyper. MOTION CARRIED.. 3. Public Hearings None 4. Discussion a) Empire Orderly Annexation Area Comprehensive Planning and Rezoning discussion Assistant Planner Wippler noted that in March 2008 the City Council and Empire Township adopted a joint resolution establishing an orderly annexation agreement for a portion of the township that includes 33 parcels of land totaling 575 acres. Recently, the township expressed its expectation that the City would assume to zoning regulations for the properties within the Orderly Annexation Area (OAA) prior to the properties being annexed into the city. Discussion followed with the commission regarding each of the seven sites. Area A Consists of approx.9.03 acres at the SW intersection of CR 66 (Vermillion River Trail) and Cambodia Avenue and is divided over seven (7) residential properties where the units per acre range from 1 to 3.5. The potential zoning and comprehensive plan guidance recommendation is Low Density Residential (R -1). The Commission agreed with this zoning recommendation. Area B Consists of approx. 166.38 acres of land and is generally located at the NW intersection of Biscayne Avenue and 210th Street W. and contains 5 parcels of land ranging from 5 acres to 80 acres. A majority of the acres are currently utilized for farming operations. There are three (3) residential parcels in this area. The potential comprehensive plan guidance recommendation is Low Medium Residential and zoning of R -2 (Low /Medium Density Residential) given it's proximity to existing land zoned and guided as such. Assistant Planner Wippler noted that A -1 could also be appropriate based on the 2030 Comprehensive Plan. Member Rotty felt agricultural use would be most appropriate. Assistant Planner Wippler noted that the residential could be low density and the larger parcels could be agricultural. The Commission agreed. Area C Consists of 24.78 acres spread over four parcel and contains two cemeteries owned by the Corinthian Lodge and St. Michaels Church. Approx. half the property is currently utilized for farming. The area is generally located at the SE intersection of Cantana Avenue and 208th St. W. The potential zoning of R -2 (Low /Medium Density Residential) would be appropriate (cemeteries are a conditional use in this zone but would be grandfathered in). Due to the current and future use of the properties as cemeteries the appropriate comprehensive plan guidance would be Public /Semi- Public. The Commission agreed with the recommendation. Area D This area consists of two parcels totaling 2.54 acres of land. Two commercial businesses (Farmington Plumbing Heating and what used to be Zarbok Construction) are contained on the properties. The parcels are located on the east side of Trunk Hwy 3 directly north of the former American Legion property. The potential zoning is B -1 (Highway Business) with a comprehensive plan guidance of commercial for this area. The Commission agreed with the recommendation. Area E This area consists of four parcels of land totaling 13.9 acres. Two of the parcels contain single family residences, one is a vacant lot and one contains a commercial building. The properties are located on the east side of Trunk Hwy 3 off of Chippendale Court. The potential comprehensive plan guidance would be Commercial and staff feels that this areas best use, long term would be commercial due to the proximity of TH 3 with a zoning of B -1 (Highway Business). The Commission agreed with the recommendation. Area F This area consists of six parcels of land totaling 122.48 acres. The majority of the acreage in this area is utilized for agricultural purposes. There are two residences also located within the area. The area is located off Minnesota State Highway 50, north of Fountain Valley Golf Course. The Potential Zoning and Comprehensive Plan Guidance would be a mixture due to the size and location of the area. The northern 3 /4 of the area would likely lend itself to be a mix of Low Medium Density and Medium Density Residential. With the frontage on MN Highway 50, there is potential for the south 1 /4 of the area to be guided and zoned as commercial, long term. Agricultural could also be considered immediately. The Commission agreed that agricultural is appropriate at this time for a majority of the area. Area G This area consists of a portion of five parcels of land totaling 248.22 acres. The property is located south of 190th Street, west of the railroad tracks and east of the Mystic Meadows subdivision. The area consists of floodplain and agricultural land. The Potential Zoning and Comprehensive Plan Guidance would be park and open space for the northern most parcel. The remainder of the property would be mixture of Low Density, Low /Medium Density and Medium Density Residential. Dakota County is proposing a regional greenway and trail that would bisect this area. It is anticipated that the widths of this greenway will vary from 100 to 300 feet. The Commission would like the southern part agricultural until there is an interest in development. Assistant Planner Wippler is suggesting the Planning commission have a workshop with the property owners and township representatives for input. Chair Rotty asked Wippler to email some dates to the commission members and the Township Planner for consideration. 5.
