Regular Meeting
June 12, 2012
1. Call to Order
Chair Rotty called the meeting to order at 7:00 p.m.
Members Present: Rotty, Bonar, Kuyper, Primmer
Members Absent: Franceschelli
Also Present: Lee Smick City Planner, Tony Wippler Assistant City Planner
2. Approval of Minutes
a) May 8th, 2012 Regular Meeting Minutes
MOTION by Bonar 2nd by Primmer to accept the minutes as presented. APIF, MOTION
CARRIED.
3. Public Hearings
a. Variance request of 500 Square feet to construct a 2,000 square foot
detached garage within the R -1 Zoning District Kerry Hanifl, 19927 Akin
Road
Assistant Planner Wippler introduced the request to build a 2000 square foot garage.
The current code allows for a 1,500 square foot detached garage. Currently, there is a
horse barn /out building that would need to be demolished per City Code. The variance
does meet the seven criteria as specified in the city code under "practical difficulties
MOTION by Kuyper second by Bonar to close the public hearing. APIF, MOTION
CARRIED. Applicant asked if they could keep the current outbuilding for storage until
the new one is constructed. Assistant Planner stated we could work with the applicant.
Demolition would occur prior to winter. MOTION by Bonar second by Kuyper to
approve the variance with the following conditions, 1. demolish existing outbuilding,
after the completion of the new structure and before the winter season. 2. Submission
and approval of a building permit. APIF, MOTION CARRIED.
b. Variance requests from the waiver of platting requirements and minimum
lot size requirement within the A -1 Zoning District Mildred Pelach
Planner Smick introduced this request. Minimum lot size in Ag is 40 acres. A parcel
may only be split into 2 parcels through the waiver of platting process. The proposal is
to create 4 separate parcels from the 66.44 acres. Staff recommends the request be
approved with the following condition: 1. The four (4) parcels (13.89 acres (Parcel 1),
27.17 acres (parcel 2), 23.76 acres (Parcel 3) and 1.58 acres (Parcel 4) cannot be split
further without platting the property per the City Code. Mrs. Pelach's attorney, Mr.
Nord explained the reasoning behind the request. Mrs. Pelach is looking to "gift" the
land to her children. Chair Rotty stated that this is the last time the property can be
split without going through the formal platting process MOTION by Kuyper second by
Primmer to close the public hearing. MOTION by Primmer second by Kuyper to
approve the variance from the waiver of plat requirement of no more than two (2) lots
and the minimum lot size requirement in the A -1 zoning district to allow the property
to be divided with these conditions: 1. The four (4) parcels (13.89 acres (Parcel 1),
27.17 acres (parcel 2), 23.76 acres (Parcel 3) and 1.58 acres (Parcel 4) cannot be split
further without going through the formal platting process. APIF, MOTION CARRIED.
4. Discussion
a) Chiropractic Office in IP zone Dale Pettis
Planner Smick indicated that Mr. Pettis has approached City staff regarding the
location of a chiropractic office in his building in the Industrial Park. The IP zone
does not allow a clinic. An Interim Use could be an option to explore if the board
feels it is practical. Member Bonar expressed a desire to have discussions regarding
updating uses within the IP zone. All members agreed that review of the IP code is
necessary. The Commission was open to hearing a request for an interim use permit
to allow a chiropractic office within Mr. Pettis's building. The Commission would
like to review the entire IP code to see if it would be appropriate to modify the IP
Code to potentially open it up for additional business uses.
5. Adjourn
MOTION by Kuyper, second by Primmer to adjourn at 7: 55 PM APIF, MOTION
CARRIED.

c. Review of the 2011 Amendment to the 2030 Comprehensive Plan City of
Farmington
Planner Smick reviewed the amendments with the Board. The changes include: 1.
population, household, etc., numbers that are associated with the 2010 Census, 2.
Agricultural Preserve Acres have been modified because property owners want to re-
enroll in the program., 3. 2009 Transportation Study has been included in the Plan
along with the construction discussion for 195th street. 4. The Sustainability Chapter
is now included in the plan., 5. The Economic Development Chapter has been revised
to include the Economic Development Strategy., 6. The "fringe properties" along 1St
and Elm Streets and 4th and Oak Streets have been revised from commercial to low
medium density residential. MOTION by Kuyper second by Primmer to close the
Public Hearing. MOTION by Bonar second by Kuyper to recommend approval and
forward to the City Council for review and approval at their meeting in July. APIF,
MOTION CARRIED.
d. An Ordinance amending Section 10 -6 -28 (I) of the Zoning Code as it relates
to screening and fencing City of Farmington
Staff is suggesting amending the screening and fencing requirements within the
Downtown Commercial District (DCD) Design Standards to allow for chainlink and
slatted fencing for properties that are zoned B -3 within the DCD overlay district.
Properties that are adjacent to established residential uses would require those
portions of the fence be of a vinyl or wood material. MOTION by Primmer second by
Kuyper to close the public hearing. MOTION by Kuyper second by Primmer to
recommend approval of the ordinance as presented. The Ordinance will go to the
City Council for final review and adoption. APIF, MOTION CARRIED.
