ADJOURN INTRODUCTION DISCUSSION City of Farmington 430 Third Street Farmington, Minnesota 651.280.6800 Fax 651.280.6899 www.cilarmington.mn.us TO: Planning Commission FROM: Tony Wippler, Assistant City Planner SUBJECT: Conditional Use Permit Construction of an Accessory Structure in a Commercial District Pizza Man Restaurant DATE: October 23, 2012 Ed Endres of Farmington Pizza Man has applied for a conditional use permit in order to construct an accessory storage building on his commercially zoned property. The subject property is addressed as 409 Third Street, Farmington, MN 55024. The executed application along with site plan, building plans and building elevations are attached to this memorandum. The subject property is zoned B -2, Downtown Business, and according to Section 10 -6 -6 (Accessory Structures) of the City Code accessory structures within commercial districts require the approval of the conditional use permit. The proposed accessory structure shown on the attached site plan (Exhibit B) is approximately 1,006 square feet in size with a height of twenty (20') feet to its peak. The applicant is proposing to locate the accessory structure in the northeast corner of the property behind the restaurant. As shown on the attached site plan, Exhibit B, the building is proposed to be setback three (3') feet from the principal structure (restaurant). Zoning Code requires a minimum separation of ten (10') feet from an accessory structure to the principal structure. An accessory structure, per the Building Code, can be located closer than ten (10') feet from a principal building provided the walls and roof of the accessory structure are adequately fire rated. Planning staff is comfortable with allowing the accessory structure to be placed three (3') feet from the principal building; however, the CUP should be conditioned that the building walls and roof shall be adequately fire rated as seen fit by the City's Building Official. All other setback and lot coverage requirements are met with this application. The accessory building is proposed to be placed upon a cement slab. The City's Building Official has indicated that a structural engineer will have to sign off on the slab in order for this size of structure to be constructed on top of it. If the building were to be 1,000 square feet or less in size it could be placed on the slab without the need of a structural engineer. This will have to be resolved prior to issuance of a building permit. Building materials Section 10 -6 -6 (Accessory Structures) states that commercial and industrial accessory structures must be constructed of similar material as the principal structure. The principal structure is currently sided with a fiber cement siding. The accessory structure is proposed to be sided with the same type and color of fiber cement siding. The proposed building elevations and plans are attached as Exhibits C1 -C3. The City Code provides criteria that must be satisfied for the Planning Commission to grant a conditional use permit. Those criteria are: 1. The proposed use conforms to the district permitted and conditional use provisions and all general regulations of this title. 2. The proposed use shall not involve any element or cause any conditions that may be dangerous, injurious or noxious to any other property and persons and shall comply with the performance standards listed below. 3. The proposed use shall be constructed, designed, sited, oriented and landscaped to produce harmonious relationship of buildings and grounds to adjacent buildings and properties. 4. The proposed use shall produce a total visual impression and environment which is consistent with the environment of the neighborhood. 5. The proposed use shall organize vehicular access and parking to minimize traffic congestion in the neighborhood. 6. The proposed use shall preserve the objectives of this title and shall be consistent with the comprehensive plan. Planning staff has reviewed the conditional use permit application and has determined that the request meets the above mentioned criteria for approval of the CUP. ACTION REQUESTED Approve the conditional use permit for the construction of an accessory storage building on the property addressed as 409 Third Street subject to the following conditions: 1. Building permit approval 2. The accessory structure may be placed closed than ten (10') feet from the principal structure provided the walls and roof of the accessory structure are adequately fire rated as seen fit by the City's Building Official.
