Call to Order Chair Rotty called the meeting to order at 5:30 p.m. Members Present: Rotty, Franceschelli, Kuyper, Bonar Members Absent: Primmer Also Present: Tony Wippler, Assistant City Planner 2. Approval of Minutes None Chair Rotty opened the Public Hearings 3. Public Hearings a. A conditional Use Permit to construct an accessory structure on a commercially zoned property 409 Third Street (Ed Endres, Pizza Man) Assistant Planner Wippler introduced the request for a Conditional Use Permit in order to construct an accessory storage building. Accessory structures require a conditional use permit in the B -2 Downtown Business zone. Mr Endres is proposing a 1006 square foot accessory structure building, with a maximum height of 20 feet. He is proposing to locate the structure in the NE corner of the property, behind the restaurant. All setbacks are being met however, the Zoning Code requires a 10 foot minimum separation from a principal structure and Mr. Endres would like a 3 foot separation from the restaurant. Per the building Code, an accessory structure may be placed closer than 10 feet if the walls and roof of the accessory structure are adequately fire rated. The Building Official is requiring that a structural engineer sign off on the cement slab prior to a building permit. MOTION by Kuyper second by Franceschelli to close the public hearing. APIF, Motion carried. MOTION by Bonar second by Kuyper to approve the Conditional Use Permit with the following conditions: 1. Building permit approval, 2. Fire rate the walls and roof in accordance with the building code. APIF, Motion Carried. 4. Discussion None 5. Adjourn MOTION by Kuyper, second by Franceschelli to adjourn at 5:50 PM APIF, MOTION CARRIED.
