Council work session outcomes should not be construed by the attending public and/or reporting media as the articulation of a formal Ciry policy position. McKnight, City Administrator SUBJECT: License Center DATE: January 9,2012 INTRODUCTION The City has been in discussions with the Minnesota Department of Public Safety Driver and Vehicle Services Division about the possibility of operating a license center at City Hall in conjunction with QuickServ. After meeting with representatives from the Vehicle Services Division in October the City was informed that the state believes that our proposed arrangement constitutes a delegation of responsibility of operating the proposed office which is prohibited by Minnesota Rule 7406.0500, subpart 1A. DISCUSSION City staff is looking for direction from the City Council on whether or how to proceed on this topic. It does not appear that our current proposal can be tweaked to satisfy the Vehicle Services Division. Substantial changes would need to be made to address this issue. BUDGET IMPACT None. ACTION REQUESTED Provide staff with direction on whether or how to proceed on the license center issue. Respectfully submitted, David J. Communication Networks Driver and Vehicle Services appreciated the opportunity to meet with you and Homeland discuss your application and tour your offices. But, after a thorough review of Security and Emergency your application and supporting documents including the updated Farmington Management License Center Agreement,the Department still believes that the proposed - Minnesota arrangement constitutes a delegation of responsibility of operating the proposed State Patrol office;which.is•prohibited:by Rule 7406.0500, Subpart 1A. Our review shows Office of that the city has made some minimal amendments to the original proposal by Communications appointing the;City. Manager and the Parks and Recreation Director as Operations Office of Manager.-The fact remains the responsible entity is a separate corporate entity Justice Programs having employees that are neither city employees nor subject to city oversight or Office of discipline. Because these employees are removed from the deputy registrar Pipeline Safety appointment and, indeed, work for an independent corporate entity, a delegation Office of would exist. As a result,your application is denied. Traffic Safety State Fire The department is bound to follow laws and rules governing the appointment and Marshal operation of a deputy registrar office, including Minnesota Statutes, section 168.33,and Minnesota Rules, chapter 7406.
