1. Call to Order
Chair Rotty called the meeting to order at 7:00 p.m.
Members Present: Rotty, Kuyper, Franceschelli, Primmer
Members Absent: None
Also Present: Tony Wippler Assistant City Planner, Lee Smick City Planner
2. Approval of Minutes
a) December 11, 2012 Regular Meeting Minutes
MOTION by Kuyper second by Primmer to approve the minutes as presented.
VOTING FOR: Kuyper, Primmer, Rotty, ABSTAIN: Franceschelli. MOTION
CARRIED.
2. Public Hearings
a. Conditional Use Permit application to allow an Auto Repair, Major business within the
B -3 Zoning District Colin Garvey, 100 5 Street Planner Smick presented the
information to the commission. The site is the Landscape Depot location. Garvey has
proposed to locate the repairs on the inside of the building. Hours proposed are 7AM 5PM,
Monday through Saturday. The applicant is moving his business, Farmington Truck Center,
from the site on Canton Court to this site. A condition of approval of truck repair would be the
combination of the lots into one parcel. He would also like to park his construction trucks at
this site. This is allowed under the zoning code, however, a condition of the CUP will be
paving of the parking area. He will need to grade the property for drainage prior to the paving.
Screening has been addressed and meets requirements. No open storage will be allowed. Staff
will work with Mr. Garvey regarding this. Mr. Garvey is also requesting a parking lot on
Parcel B, old railroad property. The Commission needs to approve this request. 100% opaque
screening, wood or vinyl fencing would be required for the residential properties. Access would
be from 4 Street. It is possible to have heavy equipment and equipment on trailers, stored on
the property. This area would need to be paved. Suzanne —108 4 Street, was concerned about
Mr. Garvey's employees stating that the trucks will be running 24/7. She is against this
proposal. Mr. Garvey explained that the railroad property that he bought, he believes will be
an operating train spur in the future so it wouldn't be practical to place a permanent structure
on it. He has 2 buildings and just can't keep both going so needs to consolidate all into one.
Member Rotty asked about the railroad rights and operating it in the future. Planner Smick
indicated we have no way of knowing when that will occur. Steve Finden Dakota Lumber,
will also have access to rail when it opens again. Parcel B he is just requesting to park trailers
on it. Chair Rotty asked Members opinions on the Major Auto repair, Parcels A. Planner
Smick indicated that Suzanne has submitted a signed petition against any use of parking on
Parcel B. Parcel A Member Franceschelli, good fit for area, meets requirements. Member
Kuyper agreed that it's a good fit and should clean up the area. Member Primmer asked about
a specific truck route. Assistant Planner Wippler indicated that most trucks travel down Willow
Street. Primmer `s concern was to keep the trucks from impacting the residential areas. He also
feels it meets the requirements. Member Rotty noted that he likes to hear from residents.
Heavy traffic hasn't been part of this immediate area. He feels that the fit is appropriate as long

as the owner realizes how close he is to residences and is considerate of them. The conditions
must be understood and adhered to. Mr. Garvey agreed with the paving. Parcel B Member
Rotty idicated that he needs more information before he can make a recommendation.
Francescelli, has a problem because it's not attached to a business. It is separated by streets.
He needs more information from applicant. Member Kuyper, it would need to comply with
design standards. He understands need for parking but he has concerns about the
neighborhood. It does affect peoples quality of living. Would like more information. Member
Primmer, agrees with the other members before any decision can be made. Member Rotty
noted that this parcel will be addressed at the next meeting. Planner Smick clarified what
needed to be brought back to the commission in February: 1. Agreement between Mr.
Garvey, Mr. Finden and the City with regard to the railroad. 2. What would be stored, 3.
Understanding between applicant and city staff on what requirements would be, how much
would be paved and gate access. 4. Is equipment to be stored on trailers? Planner Smick noted
we need the history of the railroad property. Nevada Poole, 316 Pine Street, concerned that
Parcel B will be used for trailer storage. It is 10 feet from his property and he is asking for
screening /fencing. Doug Pederson, 101 4 Street, His father had a gentleman's agreement
with the railroad that they could use the parcel for a parking lot. He will lose his parking lot.
He realizes that this is between himself and Mr. Garvey. Suzanne, if railroad becomes active
again, where would his trailers go. Member Rotty indicated that is a question that needs to be
answered. Mailing will be sent to property owners when the Commission will discuss Parcel B.
MOTION by Kuyper second by Franceschelli to close the public hearing. APIF, MOTION
CARRIED. MOTION by Franceschelli second by Kuyper to approve the CUP at 100 5 Street
(Parcel A) with the following conditions: 1. All repair work will be done inside of the Landscape
Depot building from 7 AM to 5 PM, Monday through Saturday. 2. All zoning code requirements
pertaining to a business and the accessory use in the B -3 zone must comply with Section 10 -3 -5,
Section 10 -6 -4, Section 10 -6 -9, and Section 10 -6 -10 of the City Code. 3. The conditional use must
comply with Section 10 -3 -5 (D) of the City Code. 4. The lots on Parcel A are combined and the
residential use on 407 Main Street be split from Parcel A. 5. Parcel A is paved with concrete or
bituminous material for the parking of vehicles on the property. 6. Cleanup of Parcel A, should occur
including but not limited to sand and gravel piles, concrete barriers. 7. Section 10 6 28 (I) of the
(not part of condition for Parcel A) 8. The
applicant obtains all necessary building permits from the Building Official and Fire Marshal. 9. The
applicant obtains a sign permit for any signage to be placed on the subject property. 10.Any other
condition deemed necessary by the Planning Commission. APIF, MOTION CARRIED.
b. Variance applications to allow construction of a building addition within the required front
yard setback and to allow placement of pylon sign within the required setback. Steve Finden,
Dakota County Lumber Company, 28 5 Street Assistant Planner Wippler introduced the
request for 2 variances. The proposed expansion will be 2400 square feet. This would double the
size of their office space. A condition would be to provide a parking lot plan showing the required
19 parking spaces. The applicant is requesting a 20 foot variance for placement of the sign.
Member Kuyper approves of the request. Assistant Planner Wippler shared the requirements of the
pylon sign for this zoning designation. It was the consensus of the commission to follow the staff
recommendation for approval with the conditions noted. 1. The applicant obtain all necessary
building permits from the Building Official and Fire Marshal. 2. The submission of a parking plan
to the City showing a minimum of 19 off street parking places on site. 3. The submission and
approval of a sign permit. MOTION by Kuyper second

the variance request for both variances. APIF,MOTION CARRIED.
