ANNOUNCEMENTS a) Star of the North Congressional Award—Rambling River Center Lap Robe Ladies Several members of the Rambling River Center received a Star of the North Congressional Award from Congressman John Kline to recognize extraordinary acts of service and random acts of kindness. These ladies made 98 quilt-like blankets and 18 heart pillows given to veterans and the Trinity Care Center. Members recognized were Betty Steege, Julia Johnson,Austa Harmer, Peggy Webster and Dorothy Schmidtke. Ms. Julia Johnson gave a brief history of how this project started. b) Adopt Resolution—Accepting Liquor Store Donation to Rambling River Center Mr. Blair Peterson, Liquor Operations Manager,noted 2012 sales at the liquor stores were very impressive. The net profit after transfer was $191,534 in 2012 up from less than$18,000 in 2011. This occurred due to negotiation of new leases at both stores resulting in a reduced rent payment,the Pilot Knob store was downsized, Family Fresh has provided additional traffic to the area, and sales were up. Also 2013 sales and profits are up in both stores for January and February. Product displays have been changed to present a more conducive 4 Council Minutes(Regular) April 1,2013 Page 2 environment for shopping, signage has been added inside and outside,they have also done cross-marketing with other businesses. Family Fresh has offered free advertising in their weekly flyer. They are also taking advantage of larger purchases and discounts. Liquor Operations received a 46"TV from Johnson Brothers due to liquor purchases and this was donated to the Rambling River Center. Councilmember Bonar noted Blair Peterson,Liquor Operations Manager, City Administrator McKnight and the Liquor Operations Committee deserve credit for the increase in sales. MOTION by Fogarty, second by Bonar to adopt RESOLUTION R21-13 accepting the donation of the television from Johnson Brothers to the Farmington Liquor Store and the liquor store donating the television to the Rambling River Center. PETITIONS,REQUESTS AND COMMUNICATIONS a) Approve City Council Strategic Plan/Goals for 2013-2017-Administration The City Council has established a strategic plan/goals for 2013-2017. The projects and priorities fit into five strategies: 1. Ensure the long term fmancial health of the City 2. Position the City for future economic development 3. Review the use and efficiency of City facilities 4. Maintain the long term viability of the City liquor operations 5. Continue communication with residents and partnerships with other local governments. There are a number of goals and tasks to achieve each strategy. Upon Council approval, City Administrator McKnight will assign the work to staff members. Regular updates will be provided to the Council and placed on the website. Any needed adjustments will be brought back to Council. The budget impact varies, as some is staff time and some will require additional investment in the future. DISCUSSION First Quarter Building Permit Information: During the First quarter of the 2013 building construction season (January 1st through March 31st), the City issued 20 new single-family detached housing permits and 0 new multi- family permits,for a total of 20 new first quarter housing permits. The average building valuation of the single-family homes during the first quarter of 2013 was $219,526, up from $219,330 during the fourth quarter of 2012.(Note that the valuation averages do not represent the average sale price or average market value of the homes in question,since they do not include the value of the lot or any amenities added to the home that are not part of the building code formula). Year-End Population Estimate: At the beginning of 2003,City staff decided that each quarterly building permit report should also include an updated population estimate for the City of Farmington. After discussing several methods of calculating population,a decision was made to base our population estimates on Certificates of Occupancy rather than upon building permits. Building permit activity is not a "real time"reflection of actual population, given the "lag time" between the issuance of the permit and the actual occupancy of the dwelling unit(i.e.,the time required to construct,market and sell the home). Accordingly,staff started with the City population as of April 1,2000(as determined by the U.S. Census Bureau)and then determined the number of Certificates of Occupancy [C.O.s] issued by the City since that date. The number of C.O.s is multiplied by 2.95, which was (according to the 2010 Census) the average number of occupants per Farmington dwelling unit. Approximately every two years, Dakota County, in cooperation with cities in the county, updates the aerial photography. When this is done, a Joint Powers Agreement is executed between the County and the cities, by which the County is responsible for the contract, and the cities reimburse the County for their portion of the cost of the project. In 2013, the County is contracting for 6 inch, color, leaf-off orthophotography which will meet the national accuracy standards for 1"=100' scale mapping. The expected total cost of the project is $50,000 with 11 cities contributing $13,459 of this cost. Farmington's share of the $13,459 cost is$835. BUDGET IMPACT The estimated cost of Farmington's portion will be $835 which is included in, and will be paid from the professional services line item in the Planning budget. ACTION REQUESTED Approve the attached Joint Powers Agreement with Dakota County for cost sharing related to the acquisition of orthophotography in 2013. Respectfully Submitted, Kevin Schorzman City Engineer cc: file 16 Dakota County Contract#GR00466 JOINT POWERS AGREEMENT BETWEEN THE COUNTY OF DAKOTA AND THE CITY OF FARMINGTON FOR COST SHARE RELATED TO THE PURCHASE OF AERIAL PHOTOGRAPHY WHEREAS, Minn. Stat. §471.59 authorizes local governmental units to jointly or cooperatively exercise any power common to the contracting parties; and WHEREAS, Dakota County(County) is a political subdivisions of the State of Minnesota; and WHEREAS, the City of Farmington (City) is a governmental and political subdivision of the State of Minnesota; and WHEREAS, the County has agreed to purchase aerial photography of Dakota County from Aero-Metric, Inc. (dba AeroMetric)at an estimated cost of$50,000.00; and WHEREAS, the City desires to utilize the aerial photography and is willing to cost share in the amount of$835.00 towards the purchase of said aerial photography. NOW,THEREFORE, in consideration of the mutual promises and benefits that the County and the City shall derive from this Agreement, the County and the City hereby enter into this Agreement for the purposes stated herein. SECTION 1 PURPOSE The purpose of this Agreement is to define the responsibilities and cost sharing obligations of the County and the City for the purchase and use of aerial photography from Aero-Metric, Inc. (dba AeroMetric). SECTION 2 PARTIES The parties to this Agreement are Dakota County, Minnesota(County)and the City of Farmington, Minnesota(City). SECTION 3 TERM This Agreement shall be effective the date of the signatures of the parties to this Agreement and shall remain in effect until September 30,2013, or until completion by the parties of their respective obligations under this Agreement, whichever occurs first, unless earlier terminated by law or according to the provisions of this Agreement. SECTION 4 COOPERATION The County and the City agree to cooperate and use their reasonable efforts to ensure prompt implementation of the various provisions of this Agreement and to, in good faith, undertake resolution of any dispute in an equitable and timely manner. SECTION 5 OBLIGATIONS OF PARTIES 5.1 The County will purchase aerial photography of Dakota County from Aero-Metric, Inc. (dba AeroMetric)at an estimated cost of$50,000.00. • 5.2 The City will pay to the County the sum of$835.00 which shall be applied towards the purchase price of the aerial photography as set forth in Section 5.1 above. The City shall make payment to the County within 45 days of receiving an invoice from the County. 5.3 In exchange for its cost share contribution, the City will be allowed to obtain said aerial photography from the County and use said aerial photography at no additional cost to the City. This section shall survive the expiration of this Agreement. SECTION 6 INDEMNIFICATION Except as provided below, each party to this Agreement shall be liable for the acts of its officers, employees or agents and the results thereof to the extent authorized by law and shall not be responsible for the acts of the other party, its officers, employees or agents. To the fullest extent permitted by law, the City shall defend, indemnify and hold harmless the County, its officers, employees or agents from and against all claims, damages, losses and expenses, including but not limited to attorney's fees, arising out of or resulting from the City's use of any of the aerial photography purchased by the County from Aero- Metric, Inc. (dba AeroMetric),which is the subject of this Agreement. The provisions of the Municipal Tort Claims Act, Minn. Stat. ch. 466 and other applicable laws govern liability of the County and the City. The provisions of this section shall survive the expiration or termination of this Agreement. SECTION 7 TERMINATION Either party may terminate this Agreement upon 30 days written notice to the other party,with or without cause. Notice of termination shall be made by certified mail or personal delivery to the person signing this Agreement on behalf of the other party. Termination of this Agreement shall not discharge any liability, responsibility or right of any party,which arises from the performance of or failure to adequately perform the terms of the Agreement prior to the effective date of termination. SECTION 8 GENERAL PROVISIONS 8.1 ACCOUNTING AND RECORDS. The parties agree to establish and maintain accurate and complete accounts, financial records and supporting documents relating to the receipt and expenditure of the cost share funds. Such accounts and records shall be kept and maintained by the parties for a minimum period of six years following the expiration of this Agreement. 8.2 AUDITING. The books, records, documents and accounting procedures and practices of the parties that are relevant to this Agreement are subject to examination by the other party and the State Auditor for a minimum of six years following the expiration of this Agreement. 8.3 NOTICE. Notice required to be provided pursuant to this Agreement shall be provided to the following named persons and addresses unless otherwise stated in this Agreement, or in a modification of this Agreement: TO THE COUNTY: Dan Cater or successor, Director Information Technology 1590 Hwy. 55 Hastings, MN 55033 TO THE CITY: Todd Larson or successor, Mayor City of Farmington 430 Third St. Farmington, MN 55024 2 In addition, notification to the County regarding termination of this Agreement by the other party shall be provided to the Office of the Dakota County Attorney, Civil Division, 1560 Highway 55, Hastings, Minnesota 55033. 8.4 LIAISONS. To assist the parties in the day-to-day performance of this Agreement and to ensure compliance and provide ongoing consultation, a liaison shall be designated by the County and the City. The parties shall keep each other continually informed, in writing, of any change in the designated liaison. Any alterations, variations, modifications, or waivers of the provisions of this Agreement shall only be valid when they have been reduced to writing, approved by the parties respective Boards, and signed by the authorized representatives of the County and the City. 8.6 MINNESOTA LAW TO GOVERN. This Agreement shall be governed by and construed in accordance with the substantive and procedural laws of the State of Minnesota,without giving effect to the principles of conflict of laws. All proceedings related to this Agreement shall be venued in the County of Dakota, State of Minnesota. 8.7 MERGER. This Agreement is the final expression of the agreement of the parties and the complete and exclusive statement of the terms agreed upon and shall supersede all prior negotiations, understandings, or agreements. 8.8 SEVERABILITY. The provisions of this Agreement shall be deemed severable. Hydrant flushing is done to check fire hydrants and flush out any accumulated rust. Rusty water is expected during the flushing process.To avoid getting rust on clothing residents should avoid doing laundry during hydrant flushing dates. If laundry stains occur,keep the discolored items damp and pick-up a bottle of rust remover at the City Hall or Maintenance Facility. A map outlining the tentative schedule is available on the City website. Respectfully Submitted, Jennifer Dullum Natural Resource Specialist 23 4 MOWING CONTRACT This AGREEMENT dated this 15th day of April, 2013, by and between the CITY OF FARMINGTON, a Minnesota municipal corporation ("City") and Schneider Outdoor Services, LLC, a Minnesota corporation("Contractor"). IN CONSIDERATION OF THE MUTUAL UNDERTAKINGS HEREIN, THE PARTIES HERETO AGREE AS FOLLOWS: Section 1. Scope of Work. A. The City hereby engages Contractor to provide mowing services in accordance with the Request for Proposals and as specified herein (in the event of a conflict, this contract shall control). Contractor shall mow only those areas identified by the City. B. Contractor will provide mowing services on those areas identified by the City within 72 hours of notification from the City. C. The City's Inspector shall verify that the work is completed to the satisfaction of the City. Contractor's failure to mow to the City's satisfaction and in a timely manner shall be cause for termination of this Agreement by the City without notice. Section 2.Notification. A. Lists of addresses or areas within the City that require mowing will be called, faxed or emailed (which ever the Contractor prefers) by the City to the Contractor. If there are no areas that require mowing, no list will be sent to the Contractor. If within the 72 hours of notification encompasses severe weather, as determined by the City, or site conditions prohibit equipment functionality, the City shall designate an alternate day for performance of Contractor's services. Section 3. Equipment. A. Contractor shall perform the work required under this Agreement using mowing equipment appropriate to the situation encountered which could include vacant properties on a development-wide scale or a single foreclosed residential property. Section 4. Contract Term. A. Contractor shall commence services May 7, 2013 through April 4, 2015 (24 months). This Agreement may be terminated earlier by either party without cause upon thirty (30)days'notice to the other party, except as otherwise provided in this Agreement. Section 5. Payment. A. The City shall pay Contractor a unit price per lot as follows: $32.50/lot(developed lots) $38.50/lot(vacant lots) B. The unit price per lot includes only time spent actually operating equipment and does not include downtime. The unit prices per lot shall cover all of the City's costs associated with the mowing. Contractor shall be responsible for all costs it incurs in the transportation. C. Application for payment shall be made monthly. Contractor may invoice multiple properties mowed in the City on separate lines on the same invoice. Upon approval of the invoice by the City,the City will remit the approved invoice amount directly to Contractor. Section 6. Documentation. A. Contractor shall be responsible for keeping and maintaining the following records per property and noted on each invoice submitted to the City. 1) The property address that was mowed. 2) The date and time mowing was performed. 3) For each property mowed; a time-stamped before and after photo must be submitted with the invoice to receive payment. 4) When submitting invoices to the City, "Weed Notice" must be written on the invoice. Section 7.Lowest Proposal Determination. A. Proposals will be normalized based on 31 developed lots and 19 vacant lots (actual mowed lots in 2011 and 2012)to determine the lowest"seasonal"submittal. Section 8. Emergency Response. During the contract term it may be necessary to have contract work done on an emergency basis. Upon the City's request for additional work, Contractor shall respond to the City's request upon 24 hours verbal or written notice. If the City's Engineer or designee determines it necessary, the City may hire another entity other than Contractor for completion of the requested work. Section 9. Independent Contractor. The City hereby retains Contractor as an independent contractor upon the terms and conditions set forth in this Agreement. Contractor is not an employee of the City and is free to contract with other entities as provided herein. Contractor shall be responsible for selecting the means and methods of performing the work. Contractor shall furnish any and all supplies, equipment and incidentals necessary for Contractor's performance under this Agreement. The City and Contractor agree that Contractor shall not at any time or in any manner represent that Contractor or any of Contractor's agents or employees are in any manner agents or employees of the City. Contractor shall be exclusively responsible under this Agreement for Contractor's own FICA payments, worker's compensation payments, unemployment compensation payments, withholding amounts, and/or self- employment taxes if any such payments, amounts, or taxes are required to be paid by law or regulation. Section 10. Extra Service. No claim will be honored for compensation for extra services or work beyond the scope of this Agreement without the written approval of the City. 2 Section 11. Insurance. Contractor shall furnish the City certificates of insurance from insurers duly licensed with the State of Minnesota covering public liability insurance, including general liability, automobile liability and bodily injury liability in an amount of at least $1,000,000 for injury or death of any one person in any one occurrence; and bodily injury liability in an amount of at least $2,000,000 for injuries or death arising out of any one occurrence. Property damage liability shall be furnished in the amount of at least $500,000. Contractor shall comply with all applicable insurance requirements of the Worker's Compensation Act. Contractor shall provide proof of worker's compensation coverage. The City shall be named an additional insured on the general liability policy. Section 12. Unsafe Conditions Reporting. Contractor shall promptly inform the City by telephone and in writing of any unsafe conditions on City streets or property discovered during the course of Contractor's duties, whether or not Contractor is able to remedy the unsafe condition. Section 13. Indemnification. Contractor shall indemnify and hold harmless the City, its officers, agents and employees, of and from any and all claims, demands, actions, causes of action, including costs and attorney's fees, arising out of or by reason of negligence in the execution or performance of the work or services provided for herein and further agrees to defend at its sole cost and expense any action or proceeding commenced for the purpose of asserting any claim of whatsoever character arising hereunder. Section 14. Covenant Against Contingent Fees. Contractor warrants that it has not employed any person to solicit or secure this Agreement for a commission, percentage, brokerage or contingent fee. Section 15. Governing Law. This Agreement shall be governed by the laws of the State of Minnesota. Section 16. Affirmative Action. The Contractor shall comply with all applicable laws relating to nondiscrimination, affirmative action,public purchase, contracting and employment. Section 17. Compliance with Laws and Regulations. In providing services under the Contract, the Contractor shall abide by all statutes,ordinances, rules and regulations pertaining to the provision of the services provided. Section 18. Utilities. The Contractor shall be obligated to protect all public and private utilities, streets or roadways, whether occupying a street or public or private property. If such utilities, streets or roadways are damaged by reason of the Contractor's performance of the services required under the Contract, the Contractor shall repair or replace the same, or failing to do so promptly, the City shall cause repairs or replacement to be made and the cost of doing so shall be deducted from payment to be made to the Contractor for mowing services. Section 19. Notices. DISCUSSION Previously staff had discussed with the City Council at its March 11,2013,workshop a request to spend the remaining$111,744.65 from the 2010 Arena Improvement Project. During the work session a number of capital improvements were discussed. City Council provided direction to staff to move forward with acquiring proposals from contractors to complete the following three projects: • replacement of the heating systems for the bleachers on the west side of the Arena • replacement of the furnace that heats team rooms five and six • replacement of the dehumidification system Attached in Exhibit A are the proposals received from contractors. All of the work associated with replacing the bleacher heating system and the furnace only requires one contractor to complete. As you can see however,because there is more work involved with replacing the dehumidification system,staff broke this project into the three following separate projects: • Purchase of the dessicant dehumidification unit • Installation of the gas piping and ductwork for the dessicant dehumidification unit • Installation of the electrical service for the dessicant dehumidification unit Unfortunately after completing the solicitation of proposals to complete all work associated with these three capital projects the total proposed cost is$116,413.75,which exceeds by$4,669.91 the$111,744.65 that remained from the 2011 Arena Improvement Project. In order to cover this shortage of funding,staff has made the Farmington Youth Hockey Association (FYHA)aware the City is planning on using the$5,000 that FYHA contributed in 2012 towards future Arena capital projects.As a result there would be$330.90 remaining from the payment that FYHA made in 2012. Per the agreement that was approved with FYHA in 2012,use of these funds is allowed for future Arena capital projects. The 10 year agreement with FYHA stipulates that each year a$10,000 contribution will be made by FYHA to the City with$5,000 going to cover annual Arena operation and maintenance and$5,000 being set aside for future Arena capital projects. In 2013,there will be an additional$5,000 capital projects contribution coming from FYHA resulting in the balance of capital projects contributions increasing to a total of$5,330.90. Staff has included separate agreements for each of the contractors involved with the capital projects to be completed. 53 ACTION REQUESTED The City Council is being requested to approve the attached agreements to complete the Arena's capital projects in 2012 and to using the remaining$111,744.65 from the 2010 Arena Improvement Project and using$4,669.10 of FYHA's$5,000.00 contribution made in 2012 to the Arena to cover the various capital project costs. The orderly annexation agreement gives the City authority to exercise planning, land use,zoning and subdivision regulations within the boundary of the Orderly Annexation Area[OAA]. Past practice has been that the City would only zone and comprehensively guide a property if it were within the municipal boundary of the City. Recently,the township expressed its expectation that the City would assume the zoning regulations for the properties within the OAA. A work session with the Planning Commission and two Empire Township Representatives was held on November 1,2012,to discuss the potential zoning and comprehensive plan guidance of the properties within the OAA as well as received public comment regarding what was being proposed. At that work session general consensus was made on what the properties within the OAA should be zoned and comprehensively guided. DISCUSSION Attached as Exhibit A,is a city map identifying the areas of Empire Township that are within the OAA. For purposes of this discussion, staff has divided the OAA into seven areas labeled as A-G.
