Call to Order Chair Rotty called the meeting to order at 7:00 p.m. Members Present: Rotty, Kuyper, Franceschelli, Bjorge, Primmer Members Absent: None Also Present: Tony Wippler Assistant City Planner, Lee Smick City Planner 2. Approval of Minutes a) March 12, 2013 Regular Meeting Minutes MOTION by Kuyper second by Franceschelli to approve the minutes as presented. VOTING FOR: Kuyper, Franceschelli, Rotty, Bjorge, Primmer. MOTION CARRIED. 3. Public Hearings a. Zoning and Comprehensive Plan Guidance for a portion of the area known as the Empire Orderly Annexation Area City of Farmington Assistant Planner Wippler reviewed the area where the change is being recommended. An affected property owner would prefer that the their area be zoned Agricultural, A -1 rather than the Park /Open Space designation that was previously suggested. There are 3 parcels owned by 3 separate property owners that would be affected by this change. If the Commission is agreeable to amending its previous recommendation, staff would suggest that all three parcels be zoned and comprehensively designated A -1 and Agricultural. MOTION by Kuyper second by Bjorge to close the public hearing. APIF, MOTION CARRIED. MOTION by Franceschelli second by Kuyper to recommend approval of the Comperhensive Plan Guidance and Zoning for this portion of the Empire Orderly Annexation Area and forward on to the City Council. APIF, MOTION CARRIED. 4. Discussion a. Request to Board of Adjustment for approval of Off Street Parking Lot Colin Garvey Planner Smick reviewed with the Commission Mr. Garvey's request. Mr. Garvey is requesting that the Planning Commission allow him to use this property as a parking lot. Code does allow for this use by approval by the Zoning Board of Adjustment. The parking lot must comply with the City Ordinances. Concrete or bituminous would be required for parking areas. Mr. Garvey is proposing to park pickups, no larger than one ton, and trailers on this site. Grading and drainage must be properly designed. Any lighting must be directed away from residences. Mr. Garvey indicated he will not be placing lights in this area. Driveway access can be no wider than 30 feet at the curb and right of way. Plans must be submitted to the City Engineer for review of the drainage system, grading and other engineering requirements including submittal of surety /escrow. Screening and fencing will be required and must be walls, fencing, dense planting or a combination of these to screen truck parking areas. Screening shall block the views of rights -of -way, private streets and off street parking area and shall be equally effective in winter and summer. Fencing may be Planning Commission, April 9, 2013, pg 3 installed at a maximum height of 8 feet with approval of a building permit. The following comments were taken by the audience: Suzanne 108 4th Street Concerns are: l Cut trees are still there. 2. Burning of trees. 3. More trailers still parked on the lot. 4. Diesel spill not relevant. 5. She has mice in the house due to piles of brush. 6. Knocked down trees on her property. 7. Pushed garbage on her property. Wanted to show his negligence. Get him to clean up the property. Alie 313 Main Street Will there ever be an alley constructed? Should she get a surveyor? Joseph Jentry 317 Main Street 1. Property line issue. 2. Exhaust issue in neighborhood. 3. Would like to see some order to what is happening. Concerned about a private road going through the property. Steve representing 313 Main Street Is there anything the city will do for traffic control? Will he allow the continuance of snowmobile traffic on his property. Pat Devney Safety for snowmobile usage on his property. Would like to see it continue. Does not want it blocked. Julie May 120 4th Street Traffic will increase. The Planning Commission has the authority to deny the request. She wants to protect the value of her property. Runoff and lighting will be an issue. She is trying to protect her property. They have been assessed for improvements. Who is going to police the requirements? Colin Garvey Stated his trucks have not been running all winter. Did pull a burning permit and put out fire before they left. He did not go onto others property. He stated that he has not heard from the neighbors with regards to his plans. He doesn't know how all the rumors got started. He will clean up trees. If he is required to put up a fence that will impact the snowmobiles. His plan is exactly as was presented. Joseph Jentry Will Mr. Garvey encroach into the alleyway? He would not be allowed to do this. Suzanne 108 4 Street She did try to talk to Mr. Garvey and was talked to by one of his employees. Member Franceschelli noted that the fence cannot encroach into alleyway. Member Kuyper noted that traffic studies have been done. It's illegal to cross railroad tracks. There is a controlled intersection one block south to get to businesses. Streets are for vehicles and bicycles not for children playing. The city will respond to complaints. Member Bjorge asked what conditions are unique to this property? Planner Smick indicated none. Member Primmer asked about the bituminous. Ms. Smick indicated the parking lot has to be 10 feet away from the property line. Does it require a replat. Planner Smick stated that it does not. Chair Rotty indicated that transitions in use are a challenge. He will support this with the conditions that have been discussed tonight. The consensus of the commission was to approve the request with the following conditions: 1. Grading and drainage of the parking lot and driveway must be properly designed for drainage and surfaced with concrete or bituminous material. 2. Any lights used to light the parking lot shall not reflect into the residential districts. 3. Access driveways may be a maximum of 30 feet in width at the right -of -way line and the public street. 4. Plans must be submitted to the City Engineer for review of the drainage system, grading, and other engineering requirements including the submittal of a surety acceptable to the City. Compliance of Section 10 -6 -28 concerning Downtown Commercial Overlay District Design Standards in of the City Code is required, including the need to install a 6 to 8 -foot tall wood fence on the south side of the property adjacent to residential. 5. Adjourn MOTION by Kuyper second by Primmer to adjourn at 8:50 PM APIF, MOTION CARRIED. Respectfully submitted, 6. Chainlink and slatted fencing is permissible in the side and rear yards of properties zoned B -3 when not adjacent to established residential uses. 8. No storage of equipment shall be allowed in the parking lot area. 9. No maintenance of trucks or equipment shall be performed in the parking lot area. 10. Pavement is required in access drive areas and pickup truck/trailer parking spaces. 11. Parking area shall be limited to the parking of pickup trucks, 1 -ton pickups with flatbed, and trailers. 12. Felled trees and shrubs on Parcel A will be cleared by June 1, 2013. 13. A site plan will be reviewed with City staff before construction begins on the property. 14. The width of the parking lot is limited to the width of the Pedersen Lot. 15. The property owner must sign the findings of fact document agreeing to these conditions of approval.
