Regular Meeting
July 9, 2013
1. Call to Order
Chair Rotty called the meeting to order at 7:00 p.m.
Members Present: Rotty, Primmer, Franceschelli,
Members Absent: Kuyper, Bjorge
Also Present: Tony Wippler Assistant City Planner
2. Approval of Minutes
a) May 14, 2013 Regular Meeting Minutes Tabled
b) June 11,2013 Regular Meeting Minutes Tabled
Minutes tabled as only 2 of the 3 members present could take action on the minutes.
3. Public Hearings
a. Urban Chicken Permit Application Annabelle Stefan Randow 5530 193' St.
W. Assistant Planner Wippler introduced the request to the Planning Commission.
Because this is a corner lot, they have 2 front yards. They also have a large easement on the
property. If approved Mr. Wippler will work with the applicant on the screening of the west
lot line. The applicant meets all requirements set forth by the Commission for permitting
chickens. Mr. Wippler read a letter from Gary Loretta Nunn, 19300 Euclid Court
opposing the approval of allowing chickens. MOTION by Franceschelli second by
Primmer to close the public hearing. APIF, MOTION CARRIED. MOTION by
Franceschelli second by Primmer to approve the Urban Chicken permit for the Randow
residence subject to the following conditions: 1) a renewal permit must be approved for each
year after the initial permit has been approved, 2) the coop shall be located in the rear yard
of the property behind the home in a location acceptable to staff, 3) The coop must be
screened from view from the western property line with either a solid fence or landscape
buffer of at least four (4') feet in height, 4) all other requirements specified in Section 10 -6 -29
of the City code be abided by. APIF, MOTION CARRIED.
b. Variance Application Expansion of a Nonconforming Use Oran Evans 405 Elm
Street Assistant Planner Wippler indicated that the purpose of this request is for the
purpose of constructing an 825 square foot detached garage on a residentially used property
that is zoned for commercial uses. MOTION by Primmer second by Franceschelli to close
the public hearing. APIF, MOTION CARRIED. MOTION by Primmer second by
Franceschelli to approve the variance request to build a detached garage with the condition
that a building permit is applied for and approved. APIF, MOTION CARRIED.
4. Discussion
Property Maintenance Ordinance Assistant Planner Wippler reviewed with the
commission triggers for determining what structures would be non compliant with the
proposed property maintenance code. The Commission liked the idea of utilizing a
percentage of a given wall to be the trigger. They would like to see the non compliance
percentage number fall somewhere between 25% 35
