Citizen Request Form about a potential home occupation
which has not been sanctioned by the Planning Commission.

DNR on May 6, 1993.

2. PUBLIC HEARING 7:00 P.M. Conditional Use Request from Mark Gerry for
a Fast Food Restaurant at SE Corner of 3rd and Elm
The fast food restaurant involved in this application is Subway, which meets
the requirements of the code if categorized as a restaurant, but not as a fast
food restaurant. The difference is off street parking. A restaurant will need
5 spaces whereas a fast food establishment will need 25 spaces. This is one
of the little used portions of the code which suggests that the source of the
standard may be wrong. Staff will investigate the experience further in other
communities.
The site plan indicates 9 spaces but the maneuverability within the parking lot
and a need to provide good access to the building suggest that two of the spaces
should be removed.
Without information to the contrary, the Staff would suggest that 7 off street
parking spaces would be more than adequate. On the other hand, the staff does
believe that additional landscaping should be required, particularly adjoining
Third Street, Elm Street and the west side of the building adjoining the two
entrances. A schematic plan has been drawn and shown to the applicant. Additional
landscaping does not appear to be a problem. Because of the Farmington Ford
move to Lakeville, a new use for this site would appear to be appropriate. The
only question that is unanswered is parking. The applicant may be able to contribute
to the discussion based upon the experience of other franchises.
Evaluate parking needs and the landscape plan in the context of the long term
use of the site.
3. DISCUSSION Tim Carr, 19185 Akin Road
Mr. Carr arrived at the last regular meeting after adjournment. He has said
that he can be at this meeting to discuss the home occupation that has been questioned.
Conditional Approval of the Draft Flood Plain Ordinance
The DNR has reviewed the draft ordinance and indicated approval of the draft
subject to the revision of several sections in what do not appear to be of great
significance. The Staff will review the draft more closely before the meeting
to bring to the surface any potential problems that could be introduced by the
recommended changes.
