DISCUSSION BLAHA CONDITIONAL USE The Planning Commission approved the Conditional Use requested by Francis Blaha to locate a metal garage building at the Collision Center site on Spruce Street on May 12, 1992. "Motion by Schlawin, second by Thelen to approve the Conditional Use to enable the applicant to anchor the garage now on site which will elimi- nate any potential wind problems subject to the development of a site plan including landscaping which is acceptable to the Planning Commission. APIF, motion carried." The issue was discussed again on June 9, 1992 since a landscape plan had not been prepared. The resulting motion from that discussion follows: "Motion by Schlawin, second by Rotty to require that Mr. Blaha submit a landscape plan for his conditional use by the end of June in order for it to be reviewed by the Planning Commission at its regular meeting in July. APIF, motion carried." The Zoning Ordinance in Sections 10- 8 -5(B)2 and 10 -8 -12 read as follows: "The approved site plan and all attached conditions shall be filed by the petitioner with the Zoning Officer within thirty (30) days of final appro- val. Any development contrary to the approved plan shall constitute a violation of this Title." "In case any building, structure or land is, or is proposed to be, erected, constructed, reconstructed, altered, converted, maintained or used in vio- lation of this Title, the City Council, in addition to other remedies, may institute in the name of the City of Farmington, any appropriate action or proceeding to prevent, restrain, correct or abate such buildings, struc- ture or land, or to prevent, in or about such premises, any act, conduct, business or use constituting a violation." The issue here is that the Conditional Use was granted subject to the preparation and approval of a site plan. Since the motion did not specify a time line, the next meeting provided one which is consistent with the intent of the City Code. Without an approved site plan, there is no conditional use. The City Administrator, as Zoning Officer, has authorized the Police Department to begin tagging the building as a violation of City Code unless the applicant has responded in writing by noon on Tuesday, July 14, 1992. DISCUSSION METROPOLITAN COUNCIL POPULATION PROJECTIONS The attached population projections from the Met Council staff are considerably closer to the 1990 Farmington forecasts than earlier Council projections. However, they will be investigated more thoroughly prior to the July 14, 1992 meeting in preparation for a discussion item by the City Council at their meeting of July 20th.
