APPROVE MINUTES APRIL 21ST AND MAY 12TH 3. PUBLIC HEARING Conditional Use Request from Todd Schmidt, 716 First Street, for a Home Occupation Permit to Operate a Print Shop Mr. Schmidt intends to initiate a printing business in his basement with equipment that he either has in place or will soon purchase. There will be no customer service since orders will be handled over the telephone and pick up /delivery by the owner. There will be no employees or exterior display of the business other than a two sided two (2) square foot non illuminated sign. The purpose is to build a business while employed elsewhere and expand into a business district when justified by revenues. Only one telephone call came in from a resident within 350'. This individual was not concerned about the proposed business use. Recommendation Approve the requested home occupation after outlining in detail the conditions under which the print shop has been authorized. A. Billiard Parlor as a Commercial Recreation Use within the B -1 Business District at Townsedge Center Mr. Powell from 9715 Woodhill Boulevard in Lakeville has prepared a statement regarding the control of activity within the billiard center as well as the adjoining parking lot, the proposed hours of operation and the equipment. The first two sections deal with questions raised during Mr. Powell's first discussion with the Planning Commission. The third attempts to justify the need for a very late night operation. The Chief of Police brought the attached news clipping from the St. Paul paper on May 20, 1992 regarding the experience in West St. Paul on regulating hours. Both the news article and the experience of Mr. Powell suggest a demand for this activity during late evening and early morning hours. The Chief is concerned that late hours in Farmington could attract problems that other communities have tried to regulate. It may be possible to establish compromise hours as an interim measure subject to review within a specific time frame. Authorize Billiard Parlors as a commercial recreation use and indicate hours of operation that will be acceptable and request that the City Council empower the City Attorney to develop business regulations for billiard parlors that conform with those guidelines. B. Day Care Within Existing Strip Center at Dakota County Estates One of the uses originally proposed in the Dakota County Estates PUD was a freestanding daycare at the south line of the Dakota County Estates PUD. As can be observed in the enclosed schematic plan, there is a fenced outdoor area for children in addition to open space that presumably would be landscaped. The strip center site plan in existence has been modified by the Planning Commission to include employee parking. This parking lot is located in an area where outdoor play space would be if a daycare center were to rent space within the strip center. The question raised by a local daycare provider is whether or not a daycare center in the strip center could be authorized as a minor change in the PUD if a fenced outside play space could be incorporated into the plan? C. Blaha Conditional Use To date, there has been no attempt made by Francis Blaha to explore the options available in the major condition outlined in the Conditional Use that was authorized during the May meeting. Staff would like some guidelines as to the intent of the Commission with respect to the required landscape plan. The paper work will be forwarded to the County once the conditions of the Conditional Use have been satisfied. D. Wetland Protection in Zoning Ordinance The Wetland Ordinance was submitted to Briggs and Morgan for their review. The attached letter was returned this week giving a blessing with minor revisions to the ordinance as drafted. Bring copies of the ordinance to assure that the recommended changes can be adopted by the Commission. Ir appropriate, the ordinance can be forwarded to the City Council with a recommendation that it be approved. E. Silver Springs The original plat of Silver Springs was approved by the Planning Commission in a form involving 84 lots. The most serious question at the time was phasing proposed by the project engineer. After several meetings, the City Council approved a Phase I development of approximately one half of the lots, including frontage on 187th and 188th Streets. The new owner of the plat has now submitted documents which show Phase II as Silver Springs 2nd Addition. This has been advertised for public hearing before the City Council on June 15, 1992. F. Meeting Schedule and Issues Session with City Council Assuming that the Planning Commission will no longer accept informal discussions with applicants who do not provide complete documentation for variances and conditional uses, there will be a need for the Commission to establish the possibility of two meetings per month if requests arrive shortly before a regularly scheduled second Tuesday of the month meeting. While this flexibility has always existed, the staff needs a specific time to schedule regular meetings when a second one becomes necessary. The City Council would also like to schedule an issues meeting in June or July to extend discussions on elements of the Comprehensive Plan Draft that have been questioned.
