Mr. Pluntz lives on a 2.6 acre site on the east side of Akin Road at approximately
203rd Street. The house faces north toward a 60 foot wide driveway easement
which provides access to other properties. The Akin Road "yard" contains available
for sale nursery stock. Mr. Pluntz has equipment associated with the plant
materials that he would like to enclose in the proposed shed. The attached
sketches show both the location of the property in Section 25 and the location
of the proposed storage building on the lot. The perspective of the shed indicates
the type of building, however, there will be minor changes in the opening of
the structure and the roof will be asbestos shingles rather than metal. The
City zoning ordinance in Section 10- 3 -2(C) says that accessory structures of
800 to 1000 square feet may be built in the R -1 Low Density District as a Conditional
Use. The request is for a 1200 square foot building.
The basis of the request is the lot size which at 2i acres does allow for hobby
farming activity and agriculture as a permitted use. The difficulty in granting
a variance on size is that whatever is authorized will become the standard for
the district. While preparing a public hearing notice on this variance, a request
from a real estate agent for a similar structure, across Akin Road in Pine Knoll,
was telephoned. Several years ago, the City Council determined that 800 square
feet was too small for accessory structures in the R -1 and R -2 Districts and
that structures up to 1000 square feet would be acceptable with a conditional
use application. After reviewing Section 10- 8 -6(C), there appears to be no
justification for granting a variance.
Recommendation
Review the application as if it were a conditional use and grant permission
to build a smaller structure (30 x 30 subject to whatever conditions that
appear to be appropriate. All neighboring property owners within 350 feet have
been notified. A second hearing and associated costs appear to be unnecessary.
4. DISCUSSION ARTERIAL ROAD SCREENING
This subject has been under discussion at various times both by the City Council
and the Planning Commission since June of 1991. Attached is a recommendation
for zoning ordinance amendment which the City Council has already followed in
the plat approval for Nelsen Hills Farm.
