3. PUBLIC HEARING Variance Request by Dakota Electric Association for a Pole
75 Feet Tall at 4300 220th Street
The attached site plan shows the location of a pole to be utilized as a mount for
an antenna which will provide radio back up service for Dakota Electric Association.
The request is for a variance from zoning ordinance height regulations which place
a limit of 45 feet for all structures. The Planning Commission may authorize
a variance for radio towers. This request appears to be important for the service
provided by Dakota Electric and the location should not be a problem for adjoining
property owners.

Approve the variance as requested.

4. DISCUSSION Akin Park Estates #2 PUD Revised Schematic Plan
The main difference between the proposal reviewed earlier and this one is that
the housing adjoining Essex Avenue will be in apartment structures rather than
on single family lots and the proposed day care center is on the corner adjoining
Akin Road Elementary School. In addition, the number of lots in the plat have
been reduced slightly. The current proposal shows 68 single family lots, 72 apartment
units, a large health club, a day care center and a site for Bible Baptist Church
and School. A couple of issues that will be investigated are the densities of
housing units and the building coverage of the non residential uses. The proposal
also includes a dedicated pathway from 183rd Street to the school property.
Approve the schematic plan and encourage the developer to submit materials for
the PUD and the preliminary and final plat in time for general distribution that
will enable discussion during the January meeting.
5. DISCUSSION Pilot Pointe Preliminary Plat
Heritage Development has sold the development it was working on in Lakeville and
has decided to proceed with its interest in the Nelsen Farm. The process is likely
to be relatively simple as the only item which derailed the earlier proposal was
that Heritage was not willing to sign a developer's agreement in 1989. This discussion
will take the place of a schematic plan review. Staff has a grading plan from
the original plan that will be available at the meeting. The developer plans
to have documentation available for a preliminary plat discussion during the January
meeting.
