3. Continued Hearing 7:00 P.M.
Variance requested by David Neilsen of 909 Hickory Street, to build a garage /storage
building 10 feet in front of the existing setback line. Mr. Neilsen has decided to
relocate the garage to a rear yard and the hearing therefor is no longer necessary.
While this hearing may be closed, another needs to be opened to attempt making a
change in the Zoning Ordinance which will allow construction of the building in
any buildable area.
4. Public Hearing 7:05 P.M.
Proposed change recommended by the City Staff for Section 10 -4 -1 (c) regarding
the acceptable area for private garages.
Originally, this section of the ordinance was designed to include only detached
garages. The City Staff raised the issue that this is discriminatory since an
attached garage could be any size. The ordinance was changed to the present
wording. Recently the ordinance was amended to include limiting the lot coverage
of all structures. This eliminates the need to include the size limits on attached
garages. The only reason to continue wording covering detached garages is to
prevent oversized accessory buildings within residential districts. The attached
amendment should help to resolve the questions focused upon the Nielsen garage/
storage building on Hickory Street.
5. Discussion Pete Gerten Fence at 707 Centennial Drive
A six foot fence is permitted along rear and side yard lot lines behind the
nearest front corner of a principal building. Mr. Gerten bought material for a
six foot fence and erected it on an uneven yard. The resulting fence is therefore
level at the top but may have been six or eight inches higher than ground level
in some places. A neighbor called this to the attention of the building official
who responded by informing the fence owner that the fence was too high. The owner
then brought in soil and covered it with sod to make the entire fence six feet
high. Several questions have been raised in the process including what constitutes
a six foot fence? The lumberyard sells material for six foot fences. Does this
become a taller fence if the yard is uneven? The City Engineer is concerned that
the fill brought in to make the fence six feet high will interfere with drainage.
A separate report on this issue will be provided by Mr. Kaldunski. The attached
sketch is not to scale and does not tell the story adequately. This issue is a
must for field inspections before the meeting. Mr. Gerten plans to be in attendance.
6. Discussion Schematic Plan for Silver Springs, an 86 lot subdivision on land owned
by Robert Stegmaier.
The proposal follows closely the earlier sketch plan prepared by the City Staff for
the location of streets. The lot sizes are somewhat small but do meet the minimum
requirements of the zoning ordinance. Some adjustments have been made to create
slightly larger lots at street intersections. However, the staff will provide
some analysis of the buildable area on these lots at the meeting. A major staff
concern is the way in which the main entrance to the plat has been treated. The
solid lines indicate the layout of the plat under consideration at the present
time. The dashed lines indicate the way in which this plat will relate to
Akin Park Estates.
7. Discussion Land Use Category for Dakota County Lumber
Dakota County Lumber has presented plans for a new office on the west frontage
road of Highway 3. At first staff was concerned that the new office was being
placed so as to allow the lumber company to take advantage of the traffic on
Highway 3 and add a retail line to the existing supply yard operation. Staff
has been assured by the builder, Jim Deegan, that this is not the case. The new
building is to serve the same builders and occasional retail as are currently
being served. No new sales lines are to be introduced. The reason that the
proposed building is being brought to the attention of the Commission Members is
to make everyone aware of the change in location and that any change in operation
will require a change in zoning. Engineer Kaldunski has indicated that he has
questions about how drainage will be handled on site and the Planner is requiring
that the entire entrance shall be paved so that the parking lot will flow onto
the frontage road without any change in surface. The Engineer plans to submit
his comments on an accompanying memo.
8. Discussion Clayton Nielson Duplex at Corner of First and Spruce Street
A Public Hearing has been scheduled by Chairman Hanson for August 20, 1991 at
5:00 P.M. to discuss a Variance and Conditional Use for this duplex. The primary
concern is that the ordinance does not have a mechanism for approving separately
owned duplex units on lots that are approved outside of the PUD process. This
possibly needs to be addressed in the ordinance, but in the meantime a variance
will be required before Mr. Nielsen can proceed with this development.
9. Discussion Arterial Road Screening
The attached memo from Administrator Thompson identifies the problem. The
Planner will investigate other City ordinances and prepare recommended wording
to be added to the subdivision ordinance in time for discussion at the meeting.
