PUBLIC BEARING Variance and Conditional Use requested by Cory L. Dees and Linda L. Dees of 513 Spruce Street for expansion of an existing garage which is 3 feet from the east property line. The total area of the new facility will be 980 square feet. 4. GENERAL DISCUSSION Land issues with the City Council focusing upon the City Comprehensive Plan but introduced by a discussion of a specific request from Farmington Ford for a new location on Highway 50. 5. Dees, 513 Spruce Street The attached site plan shows the existing home and garage at 513 Spruce Street. The garage is three feet from the east property line and the owner wishes to extend this garage to the rear using the same setback. The current City code requires a six foot setback. The existing garage contains 308 square feet and the addition will include 672 square feet, for a total of 980 square feet. The rear yard is reasonably spacious and includes no trees that will interfere with the new construction. This block contains no alley so that the only access to the addition will likely be through the existing garage. In the past, the Commission has permitted encroachments on side yard setbacks if the new structure is no closer to the property line than an existing building. It appears as if the neighboring property to the east will be screened from the addition by existing plant materials in their own yard. It should be noted, however, that the zoning amendment relating to mailed notice for Conditional Uses and Variances had not been adopted prior to advertising for this hearing and, therefore, the only neighborhood notice would have occurred through the newspaper advertisement and from verbal contact between the applicants and their neighbors. No sketch was submitted with the application to show what the addition will look like. Recommendation Approve the conditional use on the condition that the new structure will architecturally blend with the existing garage and that its roofline will not extend appreciably higher than the existing structure. 4. DISCUSSION Land use issues Farmington Ford ex,d,) Charles Tooker Planner CT /mh LAND USE ISSUES with the City Council, introduced by a specific request from regarding possible changes in the land use plan and zoning map. A reduction of the City wide land use plan will be available for this meeting. The City Council has requested a joint meeting with the Planning Commission to discuss various land use issues and completion of the Comprehensive Plan, in particular. Since there is only one agenda item on the June 11th agenda, Chairman Hanson has indicated that this would be a good time to hold such a discussion. In the meantime, Farmington Ford has been discussing a possible move from its present location to a variety of sites along Highway 50 in both Lakeville and Farmington. Since two of the sites being considered would require both Comprehensive Plan and Zoning Map amendments, the staff Development Committee suggested that this specific topic might initiate a more general discussion between the Council and the Planning Commission. The meeting being planned will start with an informal dinner and discussion at the Senior Center starting at 6:00 P.M.. The Planning Commission will need to move to City Hall to hold the advertised public hearing at 7:00 P.M. and there to be joined by the City Council and the owners of Farmington Ford, Murray Kelly and Steve Johnson, at approximately 7:15 P.M.
