Before purchasing this house on Oak Street, the Chants asked the Commission about the
possibility of building a mother -in -law apartment above a detached garage which they
anticipated would be built on the site. The Commission at that time (February, 1990)
indicated that it did not have a problem with such a proposal as long as the main
house became a single family dwelling and the existing garage was situated within the
property. In looking at the house from the east along 7th Street, there are two curb
cuts for driveways which either enter the existing garage or a paved parking area
immediately outside the rear porch entrance. Because the request is based upon creating
a carriage house to compliment the existing architecture of the house, the applicant
should be asked about the possibility of removing the existing garage. The ordinance
has no rule against having both an attached and a detached garage, but it is clear
about access to parking areas. They are limited to a 24 foot wide opening. Therefore,
the curb cut along 7th Street needs to be checked and, if possible, the off street
parking space should be removed from the front yard.
Recommendation
The lot is large enough to accommodate a duplex and, therefore, an accessory apartment
may be approved. The extra 40 square feet proposed for the garage should also be
approved since the house is large enough in scale to handle a slightly larger garage
building.
3. PUBLIC HEARING 5:10 P.M. CONDITIONAL USE FOR JAMES DEEGAN AT 1009 THIRD STREET
The ordinance, in Section 10 -6 -16 Relocated Structures indicates that a site plan
and list of proposed improvements are necessary. The applicant has supplied the location
of the house on the property and said that improvements will be geared to whatever a
potential buyer will require before signing a purchase agreement. The major problem
with the site is that the front yard has served as a parking lot for the adjoining con-
venience store. It may be difficult to retrain people so as not to have them continue
parking in the front yard. It is recommended that before an occupancy permit is granted
for the moved structure, a landscape plan shall be approved and installed. A sub-
stantial shrub border is recommended to define the break between commercial and resi-
dential use along the south boundary of this site. Another recommendation is that
prior to moving the structure, the owner shall supply a letter of credit to the Adminis-
trative Assistant or a certified check for $2,500.00 to be held until the house is in
place, plus a certificate of insurance from the mover covering property damage and
personal injury that potentially could occur during the move from 105 Elm Street to the
1009 Third Street location. The certificate of insurance shall be reviewed by the
Finance Director.
Recommendation
Approve the conditional use subject to surety and a certificate of insurance with the
understanding that a landscape plan will need to be prepared and implemented before the
house can be occupied.
4. PUBLIC HEARING 5:20 P.M. CONDITIONAL USE FOR PAUL GERTEN FARMINGTON FLORAL
The sign at the corner of Willow Street and Highway 3 advertising Farmington Floral
is in reasonably good condition even though the paint has faded during the past two
years. The only question that might be raised is upon what property is the sign
located? It would appear that the City should not have any problem with this sign as
long as the property owner does not object.
Recommendation
Approve the conditional use request for the continued use of this sign for one more
year.
