3 The existing use, a real estate office, was revoked by Planning Commission
action on November 15, 1983, on the basis that the business use did not
qualify as a home occupation. THe use, however, has continued until en-
forcement procedures were instituted by the City staff. A direct result
of this action has been the attached request. Although Mr. Johnson's
representative has indicated that the property has in the past included
a rental unit, the City records of utility billing shows that it has
been a single family unit for the past 15 years.
The property measures 120' x 100' for a total of 12,000 square feet. In
the R -2 District, a two family unit requires only 11,000 square feet. The
Board of Adjustment does, therefore, have the power to grant special ex-
ceptions if the requirement of Section 2 -4 -4 (A -F) of the City Code have
been met. Special attention should be directed to paragraphs C,D and E.
RECOMMENDATION
Approve the Special Exception on the basis that the entire property will
become a two family dwelling and if the requirements of Section 2 -4 -4 have
been satisfied.
4. Reisinger Construction secured in 1976, a special zoning amendment which
allows Non Commercial Equipment Maintenance and Storage within the C -1
Conservation District. A building was constructed by this company on the
basis of the zoning amendment. The current request has come about because
the owner wishes to expand the structure. Another Special Exception could
be granted if the applicant is able to satisfy the requirements of Section
2 -4 -4 of the City Code. The owner, however, is reluctant to make a signi-
ficant expansion of the building without assurance that future commercial
use by a subsequent owner is provided.
The City Comprehensive Plan, adopted in October, 1982, indicates that the
land area in question should be developed as residential and conservation.
Development potential is considered to be long range since the site is not
within any contemplated Sanitary Sewer Service Area through the year 2000.
Industrial and heavy commercial land use has been recommended along Highway
50 south of the north branch of the Vermillion River. Any extension of this
northward would threaten property values of existing housing on Akin Road.
The housing in this area preceded the Reisinger Building. Any future
commercial use of the property in this request should be subject to the
same evaluation as the original structure experienced in 1976.

Forward the request to the Farmington City Council with the recommendation
that it be denied.
