Administration. AGENDA REPORT PLANNING COMMISSION REGULAR FEBRUARY 21, 1984 4 Public Hearing Contract Sewing Special Exception at 308 Oak Street. The City Council at its meeting of November 21, 1983 added light manufacturing to the B -2 General Business District in a effort to recognize what has already taken place within the downtown business district as well as to re- duce limitations on the occupancy of existing structures. The Planning Commission reviewed this application in September and generally agreed that the use would be a suitable replacement for vacant space in one of the principal business blocks provided that there would be enough off street parking available for employees. At about the time this request for a special exception was submitted, the Planning Commission failed to grant a variance for the redivision of this parcel in which three separate lots were to be reorganized into two, one of which would become a substandard lot. The attached drawing shows the property in question. Parcel 1 contains the contract sewing operation as well as Parker Appliance and substandard parcel 2 contains the Century 21 real estate office. Both property owners and the City Attorney have been asked to attend this hearing since an earlier remodeling of the structure on parcel 2 was approved by the Housing and Redevelopment Authority on the basis of available off street parking. It now appears that this request for a special exception will also involve the issue of off street parking, the very same spaces that formerly were used to justify expansion of the real estate office. The request focuses upon section 2 -4 -4 (E) which requires the special ex- ception to organize vehicular access and parking to minimize traffic con- gestion in the area. Manufacturing or industrial land use requires 2 off street parking spaces for each 3 employees on the maximum work shift. RECOMMENDATION: Require the owner of Parcel 2 to renegotiate the purchase from Parcel 1 so that both lots meet the minimum lot size of 5000 square feet. Continue the hearing until this objective has been met. Without such an agreement, it will be impossible to discuss the severity of off street parking problems on site and the special exception should then be denied. 5. Circulation and Parking Plan for United Financial Branch. Paul Kogel, Vice President of United Financial has asked for a review of the circulation and parking plan, copy enclosed, by the Planning Commission prior to proceeding with addition of the drive up window indicated on the plan. The question raised by Mr. Kogel involves the appropriateness of two side by side drive up lanes and three curb cuts on Oak Street. The nature of sur- viving correspondence indicates that United Financial requested and was granted curb cuts on the basis of this same plan at the time downtown side- walks were replaced in 1974. RECOMMENDATION: Approve the plan as submitted and advise the Building Inspector. 6. Request for Variance by Patrick T. Fahey. Currently the Dairy Queen, situated at the intersection of Willow Street and State Trunk Highway #3, is 13.9 feet from Highway 3 and 35 feet from Willow Street. The required setback from both streets is 50 feet. The owner would like a variance to build an addition within 25 feet of Willow Street. The test for a variance is listed in section 2 -4 -3 of the City Code and would be used in this case to question whether this is the only appropriate location for the proposed addition. RECOMMENDATION: Schedule a Public Hearing for March 20, 1984 at 7:00 P.M. 7. Planning Commission One Day Seminar. The City Council has authorized tuition for any Planning Commissioner in- terested in and available to attend an afternoon and evening seminar on planning administration as described in the attached registration material.
