Terra Second Addition Preliminary Plat The enclosed copy of the preliminary plat incorporates all suggestions made by the staff during the preliminary discussion phase. Euclid Way is being platted as a continuous right -of -way with its two sections connected by a centerline curve radius of 75 feet. Both Euclid Way and Upper 183rd Street meet Euclid Street at 90 angles. A 20 foot wide easement has been in- cluded within Lot 1, Block 4 for the purpose of a pedestrian connection be- tween the existing City Park in Hill View Addition and Euclid Street. One additional requirement for platting will be to note the purpose of this easement. Currently, it is placed in the same category as drainage and utility easements on the plat. As indicated in the preliminary discussion phase Lot 6, Block 2 is slightly smaller than 10,000 square feet in size. The final calculation shows it to be 150 square feet short. This is a minor deviation from the standard and is easily cancelled since several (at least 5 of the lots are larger than 10,000 square feet. To date comments on the plat have been received from the Dakota County Engineer and the Metropolitan Sewer Board. The Dakota County Engineer wants a re- stricted access easement dedicated to the County placed along lots adjoining Highway 31. The Metropolitan Sewer Board is looking for some additional statements in the Farmington Comprehensive Sewer Plan which, although were requested earlier, never have been added to the Comprehensive Plan. The City staff is developing some appropriate language to be added to the plan in the hope that a favorable recommendation will be forthcoming from the Sewer Board. RECOMMENDATION Motion by second by to approve the preliminary plat of Terra Second Addition subject to: 1) The addition of a restricted access easement dedicated to the County along Highway 31. 2) The addition of a note describing the 20 foot wide easement in Lot 1, Block 4 as a trail easement dedicated to the City of Farmington. 3. Public Hearing 7:30 P.M. Towns Edge Standard Variances. The three foot variance request by Clyde Thompson is generated by an earlier variance granted to John Polasik for the construction of an additional service bay. The request if granted would mean that the building will be within 7 feet of the property line rather than 10. The earlier variance already will allow this addition to be constructed without any yard set back along the north pro perty line. The requested 38 foot variance will make it possible for Mr. Thompson to build a large canopy over the pump islands at the corner of Highways 50 and 3. The Planning Commission, in granting a retail sales special exception to Leibfried Construction, did not question the site plan submitted with the application in which a similar canopy was shown to be 30 feet from the Highway 3 frontage road. A five foot shift of the proposed islands northward would keep this canopy 30 feet from the original north /south alignment of the frontage road and 17 feet from the triangle of land purchased by the highway department to move the frontage road intersection with Highway 50 away from the Highway 3 intersection with Highway 50. A shift northward of the pump islands would place this canopy in the same relationship with Highway 3 as the earlier one and would also provide an additional five feet of visibility at this inter- section. RECOMMENDATION Approve the 3 foot variance to the yard required along the east property line as requested and approve a 33 foot variance from the diagonal front yard line which forms the intersection of Highways 3 and 50 since both meet the require- ments of Section 2 -4 -3. 4. Whispering River Special Exception The special exception authorizing 36 townhouse units was approved by the Planning Commission on May 17, 1983. Under Section 2 -4 -6 of the City Code if substantial progress has not been demonstrated the Board of Adjustment shall declare the special exception null and void. A number of mitigating circum- stances need to be considered. The final plat was actually approved on July 18, 1983 and the developer was unable to secure financing until the City Council significantly reduced the surety for the project based upon a recognition that the improvements will be privately owned rather than being dedicated to the City. The developer has applied for house numbers and three permit applications are being held by the Building Inspector until the final grading stakes have been placed. The developer expects construction to begin in June.
