Lonnie Stark Request for Public Hearing to discuss a Special Exception involving the creation of a second living unit within the single family house situated at 1202 Fairview Lane. 5. Proposed Draft of Revised Chapters 1 -7 in the Farmington Zoning Ordinance. Establish a time framework with accelerated meeting schedule. AGENDA REPORT PLANNING COMMISSION REGULAR SEPTEMBER 18, 1984 1. Approval of minutes, August 21, 1984. 2. Public Hearing 7:00 P.M. Vogel OUtdoor Advertising, Inc. As indicated in the last agenda report the sign ordinance is in process of a long overdue rewrite. Both sites, Locations A B on the attached sketch, when viewed on the ground offer ample testimony to the need for major revisions. Neither site, from the point of view of staff, would be an acceptable location for a billboard. A contemporary ordinance will include recommendations for 250 300' spacing be- tween an intersection and its first sign. The reason for such a requirement is to minimize distractions from traffic movement at all intersections. Because the Ordinance already is woefully inadequate it is difficult to justify granting a Variance which further will reduce minimum standards. If a majority of members believe that a greater distance between intersections and signs should be incorporated into the new ordinance, the applicant should be advised to place the requested sign without benefit of a variance. This would place the sign in the position of being a legal non conforming use subject to eventual removal. If a variance is granted the sign will be located on that site until a lease can no longer be negotiated. If the variance is not granted, the applicant should be notified that Dakota County #31 is 100 feet in width rather than 66 feet as shown on the plan. RECOMMENDATION The request should be denied based upon non compliance with Section 2 -4 -3 of the City Code. 3. Bernard Murphy Dar -Lin Investment Rediscussion Harvey Snyder and Jim Romberger visited with staff following publication of the Minutes of August 21, 1984 objecting to the clause which limits access to the one now utilized by Duo Plastics. The position of Dar -Lin is that if it would be appropriate for another landowner to have access to this land from Highway 50, it should also be all right for Duo Plastics to include an extra access. The state- ment was also made that separate trucking and employee access will become more important as Duo Plastics expands. Snyder suggests that possibly the truck access could be diverted to the "in- dustrial park" road after it is constructed, which means that two access drives to Highway 50 will be temporary. RECOMMENDATION Negotiate. 4. Lonnie M. Deborah Stark request for Special Exception Public Hearing. The attached request was submitted following neighborhood complaints that a duplex has been created without benefit of a Special Exception hearing before the Planning Commission. The applicants essay outlines the reasons for creating an "accessory apartment" at this address. A planning analysis shows the lot to measure approximately 85 x 132 feet for 11,300 square feet. The property is zoned R -2 which requires 11,000 square feet for a two family dwelling. The Board does therefore have the power to grant a special exception following a Public Hearing. The item perhaps of most interest to the neighborhood will be found in Section 2 -4 -4 (D) (E). If the visual im- pression remains that of a single family dwelling and traffic congestion is mini- mized, the use should be acceptable even if it were to be in place for more than the two years identified in the request. RECOMMENDATION Establish a public hearing at 7:00 P.M. on October 16, 1984. 5. Proposed Draft of Revised Chapters 1 -7 in the Farmington Zoning Ordinance. The regular meetings of the Planning Commission generally consume two hours of time even when the agenda is relatively light. For this reason, it may be ad- visable to schedule at least one extra meeting per month through the end of the year in order for the Commission to be able to fully discuss the revised draft.
