1. Approval of minutes, September 18, 1984 and October 2, 1984.
2. Public Hearing 7:00 P.M. Lonnie Stark, 1202 Fairview Lane, Special
Exception to create a duplex from a single family dwelling.
Two Family Dwellings are listed Special Exceptions in the R -2 Medium
Density District. The lot is of adequate size for a second unit to be
considered. The criteria for evaluating such a request are found in
Section 2 -4 -4 of the City Code. In particular, the Commission should
satisfy itself that items C,D and E will be properly addressed. Staff
has viewed the subject property and believes that these criteria can
be met. The dwelling is a split entry with four off street parking spaces.
Currently there is no obvious indication that more than one family resides
at this address.

RECOMMENDATION:
Approve the Special Exception subject to a continuation of the appearance
of a single family dwelling.
3. Public Hearing 7:15 P.M. Schmidtke Fuels, 112 Spruce Street, Special
Exception to add storage capacity to the existing bulk fuel storage yard.
As suggested during the preliminary discussion on September 18, 1984, the
requested Special Exception may be granted by the Board of Adjustment in
the B -3 Heavy Business District under the criteria listed in Section 2 -4 -4
of the City Code. The condition brought into question by residents at pre-
vious public hearings is contained in subsection B which says in part that
the Special Exception shall not involve any element or cause any condition
that may be dangerous, injurious or noxious to any other property or persons.
Because the request is an expansion of an existing facility, it would be
difficult to find that the Special Exception would indeed be dangerous or
injurious. It is possible that the appearance of the existing facility could
be greatly improved as a condition of granting an expansion thereby making
the facility considerably less noxious to the adjoining neighborhood. Items
to be considered include graded parking lots, landscaping and repainting of
existing tanks.
RECOMMENDATION:
Discuss with the owner and neighbors those items which would be acceptable
as conditions for granting the requested expansion.
