Continuation of discussion of the preliminary draft of a revised Zoning Ordinance for Farmington. 1. Approval of Minutes, November 20 and December 4, 1984. 2. Public Hearing 7:00 P.M. Variance and Special Exception to re- establish a duplex at 506 Spruce Street. Dirk Rotty has submitted the attached memorandum which explains the circumstances under which the property was purchased as well as the City record of utility payments dating from 1980. In addition, there is an enclosure outlining a staff proposed amendment to the ordinance which would allow a limited number of accessory apartments within all residential districts in Farmington. The property as now described is not large enough to accomodate a second unit without a variance. The Planning Commission in the past has denied similar requests when the conversion involved single family structures on lots of 10,200 square feet. The basis for denial has rested on the basic lot area requirement of 11,000 square feet for a two family dwelling in the R -2 District. The situation arising in this request is one of a legal non conforming use which was abandoned through some miscommunication between the applicant and the City staff. The use actually was abandoned for a period of three months whereas the City shows it to be abandoned for a period of two years. of,„ Charles Tooker Planner CT /mh AGENDA REPORT PLANNING COMMISSION REGULAR DECEMBER 18, 1984 RECOMMENDATION The staff is of the opinion that findings can be developed to justify the requested variance based upon: a) the long history of this building as a duplex, which actually was not abandoned; whereas the second unit charge for utilities was; b) the Planning Commission already has con sidered an amendment to the Ordinance which would in effect legitimatize a number of existing second units in single family structures throughout the City.
