3. Public Hearing Robert Alich 413 Elm Street
Mr. Alich is working with his mother, Julia Alich, to convert an
existing duplex on Elm Street to a rooming house. As presented by
Mr. Alich, the upstairs apartment will be converted into four sleeping
rooms which his mother can rent out to individuals. Unspoken in the
request, is the possibility that the basement may also be converted
to living space for Mr. Alich and his son as a way to avoid disturbing
Mrs. Alich's living quarters on the first floor. There is no rule
against creating additional living space in the basement, as long as
it does not become a second apartment. The objective appears to be
creation of a potential reliable income source as well as to provide
living quarters for an extended family of three. Mrs. Alich's experience
with a separate apartment in the house has not been favorable. Con-
struction plans also include creation of a double garage on this property.
Section 10 -1 -4 of the City Code defines a boarding house where meals
and or lodging are provided as rental housing for between 3 and 10 persons.
The Alich proposal would add a potential of four persons who are not
living as a family. Boarding Houses are Conditional Uses in the R -2
Medium Density Residential District. The lot measures 80 feet by 170 feet
for a total useable area of 13,600 square feet, suggesting that there
is enough space for off street parking. However, no site plan has been
submitted.
RECOMMENDATION
The use is not likely to be detrimental to the neighborhood if off street
parking is available. However, the applicant should be required to submit
a site plan indicating the number of spaces, how they will relate to a
proposed two car garage, and how the lots will be buffered from adjoining
residential uses. The applicant should be cautioned that a concrete or
bituminous surface shall be required.
4. Public Hearing Timothy and Mary MacEnany 909 10th Street
Mr. and Mrs. MacEnany have had an ongoing problem with water in the
basement, which has been handled by expensive continuous pumping. They
have decided to fill the basement and add the lost square footage for
utilities and storage to the first floor. They had experimented with a
second floor on the house, but could only build a partial second level
because of the clear story construction in the living room. They could
expand the living area into the rear yard but do not wish to give up
the outdoor living space that this would require. They have therefore
petitioned for a variance to Section 10 -4 -1 (G) of the City Code which
says that front setback line shall be uniform. The plan that they pro-
