Similarly, a landscape plan is not yet available. However, the developer
appears to be agreeable to staff recommendations regarding the desirability
of shading for the large bituminous parking lot. The one question which
has not been resolved is the height of the fence between the parking lot
and adjoining residential use. The ordinance allows a six foot fence in
side and rear yards, but only a four foot fence in front yards. The
section of fence between the street right of way line and the front of
the neighboring residence to the west will be four feet high. The fence,
which will enclose the rest of the parking lot on the west and south sides,
will either be five or six feet in height because the neighbor wants pro-
tection without feeling "closed in The drawing will show a five foot
fence with the option that it could be six feet if requested by the neighbor.
Recommendation
With the information currently available, staff recommends approval of the
Conditional Use request to build a Hardee's Restaurant on Lots 1 -3 and the
east 40 feet of Lot 4, Block 17, Original Town of Farmignton, subject to
amendment of the City Zoning Ordinance within sixty days and also subject
to the following, plus any other comments that are generated by forthcoming
information:
a. Signage limited to those indicated and in no case exceeding 100
square feet.
b. Lighting adjoining residential property not to exceed .5 foot candles
at the property line.
c. Fence height to recognize wishes of adjoining property owner, but
not to exceed six feet.
4. Discussion Dakota County Estates PUD Amendment /Minor Change
Please review the minutes of February 16, 1988 item 5. Staff will
bring drawing prepared for that meeting.
5. Discussion Silver Springs Subdivision
Jack Benedict, Bill Block and Robert Stegmaier are joining forces on this
plat and would like Commission input as to its layout. The staff has not
yet seen the revised layout, but should have copies available, if not for
this distribution, prior to the meeting. One general comment is that the
developers plan to phase the development in over an unspecified period of
time. The Commission should be aware that staff will ask for phases that
do not include temporary deadend streets. Looping is important, both for
utilities and long term maintenance.
