DISCUSSION APPLICATION FOR SIDE YARD VARIANCE FOR A WALK LINKING EXISTING PATIO DOORS WITH REAR YARD DECK AT 5231 W. 180TH STREET AGENDA REPORT PLANNING COMMISSION REGULAR AUGUST 16, 1988 1. Call to Order 7:00 P.M. 2. Approve Minutes July 19, 1988 3. Public Hearing 7:00 P.M. Variance Request from Hardee's Enclosed item 8 from July 19, 1988 Agenda Report provides background for this request. Mr. Dimond from Cardinal Development Corporation plans to be in attendance. Staff had not developed wording for an amendment which would allow accessory storage buildings within the business and industrial districts if built of the same materials as the principal building. However, this can be done relatively quickly if the Commission believes that such an approach is sound. 4. Discussion Peliminary Plat Country Hills Subdivision Item 2 from August 9, 1988 agenda report remains relevant. Developer plans to meet with Engineer Kaldunski prior to the Planning Commission meeting. 5. Citizen Input Eugene "Babe" Kuchera Request for DiscussionofUse at 105 Oak St. Enclosed item 7 from July 19, 1988 Agenda Report provides background for this discussion. A letter was forwarded from staff to Mr. Kuchera informing him of the outcome of the discussion last month. 6. Discussion Application for Side Yard Variance at 5231 W. 180th St. A salesman for Evergreen Investments sold a house with patio doors opening onto a 6 foot wide side yard on Lot 2 Block 1, Dakota County Estates 2nd Addition. The salesman is no longer employed and Evergreen Investments has agreed to provide the owner at no charge a 3 foot wide cantilevered walk from the patio doors to a rear yard deck also to be provided if the Commission will agree to grant a variance of 3 feet to the side yard setback. It should be noted that the 3 foot wide variance will be required for a relatively short distance since the bulk of the house actually sits 8 feet from the property line. In this area the penetration onto the side yard would be only 12 inches or approximately the same as an ordinary overhang. There is no house on the adjoining lot to the west. One complicating factor in this request is that staff did not advertise a hearing even though the application was presented in ample time for a hearing to be held at this meeting. Staff would like some direction regarding the justification for hardship in this instance as the owners, Mr. and Mrs. Gunderson,would like to have the walk and deck installed during the current building season. If there is either strong opposition or strong support for a variance, the matter reasonably could be resolved prior to the next regular meeting when a hearing may be held. Charles Tooker Planner
