CALL TO ORDER 7:00 P.M. 2. APPROVE MINUTES APRIL 11, 1989 3. PUBLIC HEARING VARIANCE REQUEST BY PATRICIA NASH AND DENNIS REGER The existing house is approximately 30 feet from the right of way of Upper 182nd Street. The owners wish to build a garage that would extend beyond the front of the house by four feet in order to save an existing three foot high retaining wall which would be removed if the garage were to remain in line with the house. The applicant has submitted some snap shots which shown another house and garage built in the relationship requested. The section of the ordinance responsible for this variance request is 10- 4 -1(G) as follows: "Where structures on adjacent lots or parcels in the same district have front yard setbacks different from those required, the minimum front yard setback shall conform with existing adjacent structures and an addition to an existing building may be extended utilizing whatever setback that has been established by that building." A similar request was discussed by the Planning Commission within the past year. The staff does not believe that straight setback lines along front yards is necessarily good. An ordinance revision was drafted which would allow for variable setbacks of up to 5 feet, provided that the front yard became no smaller than the established minimums. The Commission, at that time, decided to keep the ordinance as it is today. Regarding the specific request in this application, there is no justification for granting a variance as measured by Sectionl0- 8 -6(c). Removal of the retaining wall and the garden are going to be an inconvenience, but they do not constitute a hardship. The point made by the applicant that the structure will be more attractive if built as requested is as true today as it was in the earlier request. However, it does not provide the justification required. Recommendation AGENDA REPORT PLANNING COMMISSION REGULAR MAY 9, 1989 Deny the request on the basis that it does not meet the condition listed in Section 10- 8 -6(c) of the City Code. 4. DISCUSSION DAKOTA COUNTY ESTATES SIXTH ADDITION The missing material needed to evaluate this plat has been supplied both to the City Engineer and the Soil and Water Conservation District. The Soil and Water Conservation District has commented and is satisfied that erosion will be controlled on site. t Tom Kaldunski has indicated that the material he now has looks good and he will forward a separate memo along with this material. The tree planting program has included four species in an alternate planting plan. Staff will bring a suggested revision to the meeting for approval. The Plat contains 51 single family lots in the same general configuration as the PUD. One quad lot has been changed to a single family lot patter following the replat of the Fifth Addition which changed all of the other quad lots at this location to single family construction. Most of the lots are 6,000 square feet in size and all are within the MUSA boundaries of Farmington. The plat is comprised of one major loop street and three points of access to adjoining development, plus one short cul de sac. Approximately 2,000 lineal feet of streets are added to the City street system. Recommendation Forward this subdivision to the City Council with a favorable recommendation subject to the comments from the City Engineer. 5. DISCUSSION PROPOSED REVISION TO THE CITY SIGN ORDINANCE Please refer to previously mailed material on Section 4 -3 -3 of the City Code Charles Tooker Planner
