2. Public Hearing 7:00 P.M. Request from Thomas D. Quam for a Conditional
Use to Install Upper Level Multiple Family Dwelling at Corner of 3rd and Oak

Multiple family dwellings are listed as conditional uses in the B -2 General
Business District. Mr. Quam purchased the former Hagen Hardware building
with the intent of developing a mixed use building. He will continue to rent
the downstairs or first floor to the retail /office market and provide two
rental assistance units on the second level. The plan looks workable but the
Building Inspector will require that a registered architect signs off on the
drawings. Because the housing improvements are located within the Downtown
tax increment district, the HRA will also need to review the plan. The purpose
of this discussion is to determine if the Planning Commission favors the pro-
posed improvements. There is no off street parking available on the lot,
however, the property is close to the City parking lot which adjoins the City
Hall on Third Street.

Approve the conditional use for two subsidized apartments at the corner of
Third and Oak Streets subject to similar approval by the Farmington HRA.
Marigold Foods Inc. has had similar milk silos in place since it purchased the
property from Mid- America. The proposal is to replace the existing treated
chill water tank with a new silo which will be in line with the two existing
silos. The Zoning Ordinance has a height limit of 45 feet which may be extended
provided that additional setback is installed on a foot per foot basis. The
I -1 Light Industrial District requires a 50 foot setback and the entire building
is not far from 4th Street. The setback problem came up when the tall business
sign was granted a variance two years ago.
Recommendation
Approve the variance for a 56 foot milk silo on the basis that others are in
existence, one of which is taller than the silo that is requested.
