Email from applicant describing the proposed business Exhibit C Air, and CEG A residential CSAH 50 is DISCUSSION The applicant, is seeking approval of a Conditional Use Permit to allow a Commercial Recreation use within the IP (Industrial Park) zoning district. The use is proposed to occupy approximately 1,600 square feet of the existing multi tenant building located at 21210 Eaton Avenue. The proposed business is called CrossFit Calypso and as described in Exhibit C "is a class based fitness facility that focuses on functional movements. Our programs combines weight lifting, gymnastics, conditioning, plyometrix and bodyweight movements. All classes are taught by a CrossFit Certified Coach. Our clients or athletes as we call them first go through a four week beginners course and then they can take part in regular classes. Classes run Monday through Saturday with multiple classes a day." The City Code defines a Commercial Recreational Use as the provision of entertainment, games of skill or lessons to the general public for a fee, including, but not limited to, dance and karate studios, golf driving range, archery, and miniature golf. Staff feels the proposed use, as described by the applicant, meets the aforementioned definition. Setbacks and lot coverage are not an issue with this application as the use it proposed to occupy space within an existing building. Parking for both the proprietors and clients of the proposed business would be accommodated by the existing parking found on the property both on the north and south side of the building. There are currently 41 off street parking stalls on the subject property. The applicant has stated that the average class size will be 8 persons. It is staffs belief that there is adequate parking on site to accommodate the proposed use. Conditional Use Permit The City Code provides criteria that must be satisfied for the Planning Commission to grant a Conditional Use Permit. Those criteria are: 1. The proposed use conforms to the district permitted and conditional use provisions and all general regulations of this title. The proposed use is a conditional use within the IP Zoning District and conforms to all general regulations of this title. 2. The proposed use shall not involve any element or cause any conditions that may be dangerous, injurious or noxious to any other property or person and shall comply with the performance standards listed below. The proposed use will not involve any element or cause any conditions that may be dangerous, injurious or noxious to any other property or person and it complies with all performance standards. 3. The proposed use shall be constructed, designed, sited, oriented and landscaped to produce a harmonious relationship of buildings and grounds to adjacent buildings and properties. The use will be established within an existing building. 4. The proposed use shall produce a total visual impression and environment which is consistent with the environment of the neighborhood. The use will be contained to the inside of an existing building. 5. The proposed use shall organize vehicular access and parking to minimize traffic congestions in the neighborhood. The proposed use will not significantly increase traffic in the surrounding neighborhood. 6. The proposed use shall preserve the objectives of this title and shall be consistent with the comprehensive plan. The proposed use is consistent with the Comprehensive Plan. ACTION REQUESTED Approve the Conditional Use Permit allowing a Commercial Recreation use to be established within the IP zoning district at the property addressed as 21210 Eaton Avenue, subject to the following conditions: 1. A sign permit be applied for and approved for any signage to be placed on the premises. 2. The applicant shall obtain all necessary building permits from the City's Building Official.
