Call to Order Chair Rotty called the meeting to order at 7:00 p.m. Members Present: Rotty, Primmer, Franceschelli, Kuyper Members Absent: Bjorge Also Present: Tony Wippler Assistant City Planner 2. Approval of Minutes a) September 10, 2013 Regular Meeting Minutes Motion by Kuyper, second by Primmer to approve the minutes as presented. APIF, Motion Carried. Chair Rotty opened the Public Hearings 3. Public Hearings a. An Amendment to Section 4 -5 -5 (Residential Performance Standards) and 4 -5 -7 of the City Code related to property maintenance and appeals.- Applicant: City of Farmington Assistant Planner Wippler stated that this is a complaint driven process and that the proposed trigger point is 25 A change that was made, based on comments from Council Members, was including language that addressed "other comparable protective coverings" in addition to the language of vinyl siding, aluminum siding, and steel siding. With this language it will address all forms of exterior coverings. A complaint would come in; the Building Official would inspect the property and if non compliant would send a notice to the owner indicating the violations and why issued along with a corrective order and a time frame for completion (case by case basis). If violation order not complied with, it will go to our legal counsel for action. There is an appeal process that will work by the property owner appealing to the Planning Division, if they feel they are being unjustly accused, after the Building Official has inspected and sent a notice to the owner indicating the violation. The City Planner will then determine whether the violation should be supported. The property owner may appeal to the Board of Adjustments, (Planning Commission) if the owner feels the decision of the Building Official and Planning Staff is incorrect. An appeal to the Planning Commission is $150.00. APIF, Motion Carried. Tom Ryan 208 Walnut Street he has lived with a problem house for 20 years. He owns the lot next door to his house so he could build another house. With the condition of the neighboring property, the house would not be sellable. Resources need to be available to the violators for repairs. Tony Vietti 401 Spruce St. This ordinance is a step in the right direction. Susan Reichert 709 4th St. Goal to see "old" Farmington maintained. She is supportive of resources for those who can't afford the work, are elderly, etc. Gretchen Fairview Lane The City doesn't follow through with these Ordinances. If the City would follow through that may take care of some of the problems. Planning Commission, October 8, 2013 pg 2 Member Franceschelli stated that we have a starting block for maintaining property. It has taken a long time to get it this far. Member Kuyper thanked Assistant Planner Wippler for all his work on this ordinance. He also thinks this is a good beginning and could be reviewed for amendments if necessary. Member Primmer also thanked Tony and the Commission and echoes the other member's comments. Tom Ryan you have to deal with the properties and make hard decisions. You need a blanket ordinance. Assistant Planner Wippler indicated that this has been before the Council in the past and decided not to pursue the ordinance. The current council decided to make this a priority. Member Rotty noted residents have come to the commission in the past with complaints. This is the right time for the ordinance. The ordinance will make owners accountable. MOTION by Franceschelli second by Primmer to close the public hearing. APIF, Motion Carried. Motion by Kuyper second by Franceschelli to approve the Ordinance and forward to the City Council for action. APIF, Motion Carried. 4. Discussion None 5.
