Call to Order Chair Rotty called the meeting to order at 7:00 p.m. Members Present: Ratty, Kuyper, Rich, Bjorge Members Absent: Franceschelli Also Present: Tony Wippler --- Planning Manager 2. Approval of Minutes a) May13, 2014 Regular Meeting Minutes — Motion by Rich second by Bjorge to approve the minutes as presented. APIF, Motion Carried. 3. Public Hearings — Chairperson Rotty opened all Public Hearings a. Ordinance amending Section 10 -2 -1of the Zoning Code defining Limited Commercial Ventures, Ordinance amending Sections 10-5-6(c), 10-5-7(c), 10-5-11(c), and 10 -5 -12 (c) of the Zoning Code adding Limited Commercial Ventures as a Conditional Use, Ordinance amending Title 10 of the City Code by creating 10 -6 -30 Limited Commercial Venture Standards - City of Farmington — Planning Manager Wippler stated that over the last several months the HPC has been working on developing an ordinance that would allow certain commercial establishments to be located within properties /buildings that have been or are eligible for designation as Farmington Heritage Landmarks and/or on the National Register for Historic Places. These proposed ordinances are a result from the request that staff had received regarding the Akin House (19185 Akin Road Dick Orndorff asked how taxes would be classified on these properties. Wippler indicated it's up to the County but thought that the "classification" would determine the tax rate. A member of the audience noted that at the time of classification, taxes remain the same. Member Kuyer asked about language regarding advertising signs. Chair Rotty noted that signs, parking and lighting would be addressed at the Public Hearings. Language for termination if things aren't working is included in the ordinance. Mr. Omdorff asked what prevents neighboring properties from also opening businesses in their homes? Chair Rotty indicated that there are ways to address these in our code. MOTION by Bjorge second by Kuyper to close public hearing. APIF, Motion Carried. Motion by Bjorge second by Rich to recommend approval of the ordinances. APIF, Motion Carried. 4. Discussion a. Temporary Storage Garages - Planning Manager Wippler continued the conversation regarding these structures. He asked Lakeville, Apple Valley and Rosemount and how they deal with them. These communities consider them accessory structures and they are not allowed. Accessory structures have specific guidelines that must be followed with regards to appearance, materials, etc. Our code states that accessory structures must be in the back yard and follow setback and easement requirements. Currently, our enforcement is complaint driven. The commission agreed that these are not accessory structures as defined in the code as they are designed for temporary use, however, if there is a complaint they should be removed from a property. At this time there is no interest to modify the code to include these structures. Planning Commission August 13, 2014 5. Adjourn MOTION by Bjorge, second by Kuyper to adjourn at 7:35PM.
