ATTACHMENTS: Type o Cover Memo Description Regular Planing Commission Minutes 9/9/14 TO: FROM: SUBJECT: DATE: City of Farmington 430 Third Street Farmington, Minnesota 651.280.6800 - Fax 651.280.6899 www.ci.farmington.mn.us Planning Commission Tony Wippler, Planning Manager Update on Notice and Corrective Order - 409 Spruce Street October 14, 2014 INTRODUCTION The Planning Commission granted an extension to the Notice and Corrective Order (City Code 4- 5 -5(D) - property maintenance ordinance) for the property located at 409 Spruce Street. The extension deadline of September 30, 2014 has passed. Staff wanted to provide an update for the Commission. DISCUSSION As the Commission is aware, a Notice and Corrective Order was given to the property owners of 409 Spruce Street in November of last year in order to address the exterior appearance (siding and roof) of the home located at the property by February 3, 2014. The property owners appealed the staff determination to the Planning Commission and on January 14, 2014 an extension was granted by the Commission. The extension provided until September 30, 2014 to bring the property into compliance with the property maintenance ordinance. The September 30, 2014 deadline has passed and staff (Building Official, Planning Manager and Community Development Director) have reviewed the progress that has been made at the property and have determined that the structure in question currently meets the "not more than 25 %" mark for missing siding (see attached pictures from October 1, 2014), and the roof has been replaced entirely and passed inspection. Therefore, the Notice and Corrective Order will not be passed on to legal counsel for additional action. It should be noted that even though at this time it will not go through the legal process that staff will continue to work with and urge the property owner to complete the exterior improvements in a timely manner Staff will continue to update the Commission as necessary on this property. DISCUSSION As from time to time staff will review the City's Zoning Ordinance for potential code changes /amendments or additions to either address deficiencies in the code or to take advantage of trends that staff are seeing in other communities and in the region. Some of the potential code revisions staff and the Commission will be considering deal with the following: Home Occupations Data Centers Brew Pubs Election Signs Outdoor Donation Receptacles ACTION REQUESTED No action is required at this time. However, staff would like to discuss potential work session dates with the Commission to begin having discussions on these potential ordinance changes.
