The church name is Homestead Community Church. Existing Zoning: B -2 (Downtown Business) 2030 Comprehensive Plan: Commercial Attachments: (1) Conditional Use Permit application — Exhibit A (2) Letter of Intent from applicants — Exhibit B (3) Location Map — aerial — Exhibit C DISCUSSION According to the City Code, churches are conditionally allowed in the B -2 (Downtown Business) Zoning District. Proposed Use Description Jeffrey and Kristine Kerr are the applicants and they are requesting that the Planning Commission approve a Conditional Use Permit to allow the establishment of the Homestead Community Church within the Exchange Bank and Larson buildings located at 344 Third Street and 213 Oak Street. The Kerr's are currently in contract negotiations with the property owner to purchase the properties. According to the information provided by the applicant (Exhibit A), the property will be utilized for Sunday morning services, Wednesday night programs and other meetings throughout the week. The applicants expect the Sunday morning attendance to be around 300 people including children. The Wednesday night activities are expected to have approximately 150 participants. The applicants plan on converting the two spaces within the Larson building into early childhood and nursery spaces. The former "Cow Interrupted" space would hold elementary age service while the adult service would take place in the upstairs ballroom. The corner downstairs space would become a lobby area. Historic Preservation The Exchange Bank Building (344 Third Street) was constructed in 1880 and was designated as a Farmington Heritage Landmark by the City Council in 2003. The Exchange Bank Building was listed in the National Register of Historic Places on December 31, 1979 because of the buildings architectural qualities which reflect the standards and tastes of the late Victorian period in small town Minnesota. The Larson Building (213 Oak Street) was constructed in 1900 and is attached to the western side of the Exchange Bank Building. The Larson Building is neither a Farmington Heritage Landmark nor listed on the National Register of Historic Places. If the Commission approves the requested CUP, a condition of approval should be that a Certificate of Appropriateness must be granted by the City's Heritage Preservation Commission for any exterior improvements proposed for either building, including signage. Conditional Use Criteria The City Code provides the following criteria that must be met in order for the Planning Commission to approve a conditional use permit: 1. The proposed use conforms to the district permitted and conditional use provisions and all general regulations of this title. A church is a conditional use in the B -2 Zoning District. 2. The proposed use shall not involve any element or cause any conditions that may be dangerous, injurious or noxious to any other property or persons and shall comply with the applicable performance standards. The proposed use will not involve any elements that may be dangerous, injurious or noxious to any other person or property and it does comply with all applicable performance standards. 3. The proposed use shall be constructed, designed, sited, oriented and landscaped to produce a harmonious relationship of buildings and grounds to adjacent buildings and properties. The proposed use will occupy the existing buildings; therefore, this requirement is non - applicable in this instance. 4. The proposed use shall produce a total visual impression and environment which is consistent with the environment of the neighborhood. Again, the proposed use will occupy existing buildings in the downtown. The use will not affect the visual impression and environment of the downtown neighborhood. 5. The proposed use shall organize vehicular access and parking to minimize traffic congestion in the neighborhood. The B -2 Zoning District does not have requirements for off - street parking. Existing on- street parking as well as nearby public parking facilities will be utilized. 6. The proposed use shall preserve the objectives of this title and shall be consistent with the Comprehensive Plan. The proposed use is consistent with the City's Comprehensive Plan. Staff believes that the proposed church meets all of the aforementioned criteria. ACTION REQUESTED Approve the Conditional Use Permit allowing a church to be established at 344 Third Street and 213 Oak Street contingent upon the following: 1. The applicants obtain all necessary building permits for conversion of space to a church. 2. A sign permit shall be required for any signage to be placed on site. 3. A Certificate of Appropriateness shall be reviewed and approved by the City's Heritage Preservation Commission for any exterior improvement proposed to the buildings. DISCUSSION This ordinance is being proposed to bring the above - referenced portions of City Code into compliance with the recently approved 2015 State Building Code and to correct some identified inconsistencies. The proposed changes include: • Increasing the square footage requirement from exceeding 120 square feet to exceeding 240 square feet for accessory buildings requiring a floating slab (new verbiage) or permanent foundation. Also changing verbiage from the uniform building code to the International Residential Code. (Section 4- 5-5(C)3) • Increasing the square footage of accessory structures that require approval of a building permit from exceeding 120 square feet to exceeding 200 square feet. (Section 10- 6- 6(A)4) • Various verbiage additions to sections 10- 6- 6(A)6 &7 for clarification and consistency purposes. ACTION REQUESTED Recommend approval of the attached ordinance and forward that recommendation on to the City Council. ATTACHMENTS: Type Ordinance Description Ordinance Amendment CITY OF FARMINGTON DAKOTA COUNTY, MINNESOTA ORDINANCE NO. AN ORDINANCE AMENDING SECTIONS 4- 5 -5(C) AND 10- 6 -6(A) OF THE CITY CODE AS RELATED TO ACCESSORY BUILDINGS AND ACCESSORY STRUCTURES, RESPECTIVELY THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS: SECTION 1. Sections 4- 5 -5(C) and 10- 6 -6(A) of the Farmington City Code, are hereby amended by adding the underlined language and deleting the struck language below as follows: 4 -5 -5: RESIDENTIAL PERFORMANCE STANDARDS: (C) Accessory Buildings: 1. The maximum number of accessory buildings that shall be permitted on each residential lot is as follows: (a) One Acre Or Less: Two (2) accessory buildings. (b) Greater Than One Acre But Less Than Two Acres: Three (3) accessory buildings. (c) Greater Than Two Acres But Less Than Three Acres: Four (4) accessory buildings. (d) Accessory Buildings: All accessory buildings shall comply with lot coverage and size limitation requirements under the city zoning ordinance2. 2. The same or similar quality exterior building material shall be used in the accessory and principal building. All accessory buildings shall also be compatible with the principal building to the extent that the exterior appearance of the accessory building is not at variance with the principal building from an aesthetic and architectural standpoint. 3. Accessory buildings exceeding one two hundred twenty forty (120) (240) square feet in floor area shall be designed for placement on a floating slab or permanent foundation complying with the u International Residential code. 4. The height of an accessory building shall be measured from the mean ground level to the uppermost point of the roof. Except as expressly permitted by a conditional use permit, accessory buildings shall be limited to twenty feet (20') in height. 10 -6 -6: ACCESSORY STRUCTURES: (A) Residential: 1. Accessory structures shall be located behind principal structure in the side or rear yard and at least ten feet (10') away from any structure. 2. Storage sheds shall not exceed twelve feet (12') in building height and two hundred forty (240) square feet. 3. Accessory structures shall meet the minimum requirements of the building code as approved by the building inspector. 4. Accessory structures over one two hundred twenty{120) (200) square feet require a building permit. 5. Storage sheds are required to be anchored to the ground. 6. Accessory structures over two hundred forty (240) square feet require a foundation or floating slab. 7. Accessory structures at one thousand (1,000) square feet and above require frost footings and foundation. 8. Detached garages shall be constructed of similar materials as the principal structure.
