Director of Public Works/City Engineer SUBJECT: 1997 Street and Utility Improvements - Project 96-1, Main Street DATE: May 27, 1997 INTRODUCTION On March 17, 1997, the Council accepted the feasibility report, authorized the preparation of plans and specifications and set a Public Hearing for the 1997 Street and Utility Improvement - Project 96-1, Main Street. DISCUSSION The feasibility study presented at the March 17, 1997 Council meeting presented the design issues and parameters for the reconstruction of Main Street. The Main Street reconstruction project has been identified as a high priority project and is a part of this year's Capital Improvement Program due to the deteriorating infrastructure in the project area. The lack of an adequate drainage system is contributing to the street deterioration. As evidenced by the results of recent sewer televising, the existing sanitary sewer is in need of rehabilitation. Currently, there is small diameter watermain that connects trunk watermain on either end of Main Street and the Water Board has approved the replacement of the small diameter watermain with trunk watermain. There are several other improvements proposed for the project area. The removal of the railroad crossing Fifth Street will improve the drainage and driveability at the intersection of Fifth and Pine. The upgrade of the trunk sanitary sewer along Fifth Street will help to alleviate sewer back ups in the old part of Farmington that is serviced by this line. The Fourth Street outfall, which is separate component of the overall project, will replace the existing storm sewer system at Fourth and Willow that is collapsed. Estimated assessments have been calculated for the properties benefiting from the proposed improvements. The assessments have been calculated following the guidelines of the City's assessment policy. FarminlJton, MN 55024 · (612) 463.7111 · Fait (612) 463.2591 BUDGET IMPACT The estimated total project cost for the Main Street Utility and Street Improvements is $1,503,900. The City's share of the project cost is $924,500. The estimated maximum amount that would be assessed against the benefiting properties, calculated according to the City's current assessment policy is $10,600 per buildable lot. The total amount to be assessed would be $579,400. A breakdown of project costs and assessments is shown on the attached table. The table following the project cost breakdown summarizes the funding sources for the City's share of the project. The estimated project cost for the Fourth Street Storm Sewer Outfall component of the project is $75,400, which includes an estimated cost for right-of-way acquisition. This improvement would be funded by the Storm Water Utility Fee which was established in 1990 for the purpose of maintenance and/or construction of storm sewer improvements in the existing areas of Farmington. The Fourth Street Outfall will replace the existing storm sewer at Fourth and Willow that is collapsed. An appraisal of the project has determined that the benefit to existing properties is less than the amount of the proposed assessment. Based on this appraisal, staff cannot recommend imposing an assessment of $10,600 on the benefiting properties. RECOMMENDATION That the Council decide whether or not to order the Main Street, Street and Utility Improvements, Project 96-1. . If the Council chooses to order the project - adopt the attached resolution approving the plans and specifications, ordering the project and authorizing the advertisement for bids. . If the Council chooses not to proceed with the entire project, that the Fourth Street Storm Sewer outfall portion of the project be ordered by adopting the attached resolution. Director of Public Works/City Engineer Sl:lUECT: Storm Sewer Assessment Policy DATE: May 5, 1997 ~T'fRODUCTION This memo is presented to Council for informational purposes regarding the current City policy on assessing storm sewer improvements. DISCUSSION Attached is the City of Farmington Assessment/Improvement Policy. Following is a discussion of the policy regarding storm sewer assessments, in both existing and new developments. A. Existing Developments Section VI in the Assessment/Improvement Policy addresses improvements in eXlstmg developments. In this section, storm sewer improvements are divided into two categories, trunk and lateral. Lateral storm sewer is further split into two differently assessable categories. The policy states that the costs for Stonn Sewer Trunk shall be 100% financed by the City. Therefore, storm sewer trunk costs are not assessable against benefiting propenies. There are two different cases for storm sewer lateral. The costs for a New Stonn Sewer Lateral Enhancing Existing System are 35 % assessed agair.:.St the benefiting propenies and the City finances the remaining 65 %. This case occurs when u;~re is already a storm sewer system in place and additions or upgrades are installed. The costs for New Stonn Sewer Laterals are assessed 100% against the benefiting propenies. This case occurs when there IS no storm sewer currently and a new storm sewer system is installed in an area. Lateral costs are assessed per buildable lot in the area that drains to the storm sewer system (both cases). This is the policy that is currently in effect and the staff follows these guidelines when preparing the assessment rolls. Sew Developments Section V in the Assessment/Improvement Policy addresses improvements in new developments. In new developments, the intent of City Policy is that no developmental costs are incurred by existing lots or parcels or by the City in general. Therefore, the storm sewer costs for the development are bOf:1e by the developer. The exception is for Lrnprovements which are determined to have an area wide benefit which exceeds the scope of the development. Each development is charged a Surface Water Management fee. This fee is intended to fund past. present or furore storm sewer costs of trunk improvements that provide an area wide benefit as shown in the City's Surface Water Management Plan. When a developer constructs storm sewer improvements that are identified in the Surface \Vater Management Plan as trunk improvements. the developer receives a credit against his surface water management fee to cover the costs of those trunk improvements. BUDGET TI\1P ACT The City has two sources of revenue to fund storm sewer improvements. As outlined above, a Surface Water Management fee is charged to all new developments that is intended to fund the trunk storm sewer improvements identified in the City's Surface Water Management Plan. . -~\ The second source of revenue is the City's storm water utility fee. This fee was adopted in 1990 as a funding mechanism for storm sewer maintenance and construction in the existing areas of Fannington. Director of Public Works/City Engineer SUBJECT: Emergency Vehicle Preemption (EVP) on signal at TH 3 and Ash Street, Project 97-03 DATE: May 27, 1997 INTRODUCTION At the May 19th Council meeting, the Council approved the plans and authorized the advertisement for bids for the installation of the EVP system on the traffic signal at TH 3 and TH 50, award of the contract being contingent on the execution of a cooperative agreement between the City of Farmington and MnDOT. DISCUSSION MnDOT has forwarded the cooperative agreement for execution on behalf of the City of Farmington. BUDGET IMPACT MnDOT's revised estimate for the cost of the EVP installation is $15,000. The estimated total project cost based on this estimate is $20,600. MnDOT's share of this cost is $12,150 leaving $8,450 to be funded through a combination of the City's Municipal State Aid Account and the Road and Bridge Fund. S 16A.1S.] Budget Office: (Authorized Signature) THIS AGREEMENT made and entered into by and between the State of Minnesota, Department of Transportation, hereinafter referred to as the "State", and the City of Farmington, hereinafter referred to as the "City", WITNESSETH: WHEREAS, Minnesota Statutes Section 161.20 (1994) authorizes the Commissioner of Transportation to make arrangements with and cooperate with any governmental authority for the purposes of constructting, maintaining and improving the Trunk Highway system; and WHEREAS, it is justified and considered mutually desirable to install emergency vehicle pre-emption at the existing traffic control signal on Trunk Highway No. ~ 3 ~ (Chippendale Avenue) at Trunk Highway No. 50 (Ash Street) - County State Aid Highway No. 74 (Ash Street); and WHEREAS, the City requests and the State agrees to the installation of an Emergency Vehicle Pre-emption System, hereinafter referred to as the "EVP System", as a part of the existing traffic control signal installation in accordance with the terms and conditions hereinafter set forth; and WHEREAS, it is considered in the public's best interest to perform the EVP System cabinet modifications with State forces and equipment, all at the cost and expense of the State; and WHEREAS, the City and the State will participate in the cost, maintenance and operation of the EVP System as hereinafter set forth; 76215 -1- NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 1. The City shall prepare the necessary plan, specifications and proposal which shall constitute "preliminary Engineering". The City shall also perform the construction inspection required to complete the items of work hereinafter set forth, which shall constitute "Engineering and Inspection" and shall be so referred to hereinafter. 2. The City with its own forces and equipment or by contract shall install an EVP System at the existing traffic 3~ control signal on Trunk Highway No. ~ (Chippendale Avenue) at Trunk Highway No. 50 (Ash Street) - County State Aid Highway No. 74 (Ash Street) in accordance with State Project No. 1920-35. Estimated Construction Cost is $15,000.00. State's share is 75 percent. City's share is 25 percent. 3. Upon completion of the work provided for in Paragraph 2 hereof to the satisfaction of the State's Assistant Division Engineer at Roseville or his duly authorized representative, the State shall pay to the City the State's share of the actual Construction Costs plus eight (8) percent of its share for the Cost of Engineering and Inspection. 4. The amount to be encumbered for payment to the City from Trunk Highway Funds for the construction work performed under this Agreement is $12,150.00, which is the State's share of the Construction and Engineering and Inspection Costs. In the event that at any time it appears that such reimbursement will 76215 -2- exceed said sum, the City shall promptly notify the State's Assistant Division Engineer at Roseville or his duly authorized representative of the reason for the increase in cost and the amount of additional funds necessary to complete the project. If approved by the State's Assistant Division Engineer at Roseville or his duly authorized representative, additional funds shall be encumbered by the State and notice by the State's Assistant Division Engineer at Roseville or his duly autaorized representative to the City of that additional encumbrance will permit the City to complete this project. 5. Payment to the City will be made by the State for such work which is complete and approved and upon submission by the City of an invoice in quintuplicate itemizing the actual Construction Cost and certified by a responsible City official that said work has been completed under the terms of this Agreement. The invoice and supporting records are subject to audit by the State's representative at the direction of the State. 6. In the event the City advertises for bids for all or a portion of the work in Paragraph 2 hereof, the City shall submit to the State a certified copy of the low bid received and an abstract of all bids received by the City, together with the City's request for concurrence by the State in the award of a construction contract. Award of the contract shall not be made until the State advises the City in writing of its concurrence. 76215 -3- 7. The construction work provided for herein shall be under the direction and supervision of the City. It is agreed, however, that the State shall have the right to periodically inspect said cost sharing construction work. 8. Upon completion of the work contemplated in Paragraph 2 hereof, it shall be the City's responsibility, at its cost and expense, to provide the necessary electrical power for the op~ration of the EVP System. 9. The EVP System provided for in Paragraph 2 hereof shall be installed, operated, maintained, or removed in accordance with the following conditions and requirements: a. All maintenance of the EVP System shall be done by State Forces. b. Emitter units may be installed and used only on vehicles responding to an emergency as defined in Minnesota Statutes Chapter 169.01, Subdivision 5 and 169.03. The City will provide the State's Assistant Division Engineer or his duly appointed representative a list of all such vehicles with emitter units. c. Malfunction of the EVP System shall be reported to the State immediately. d. In the event said EVP System or components are, in the opinion of the State, being misused or the conditions set forth in Paragraph b above are 76215 -4- violated, and such misuse or violation continues after receipt by the City of written notice thereof from the State, the State shall remove the EVP System. Upon removal of the EVP System pursuant to this Paragraph, the field wiring, cabinet wiring, detector receivers, infrared detector heads and indicator lamps and all other components shall become the property of the City.' e. All timing of said EVP System shall be determined by the State through its Commissioner of Transportation. 10. Any and all persons engaged in the aforesaid work to be performed by the City shall not be considered employees of the State and any and all claims that mayor might arise under the Worker's Compensation Act of this State on behalf of said employees while so engaged, and any and all claims made by any third party as a consequence of any act or omission on the part of said employees while so engaged on any of the work contemplated herein shall not be the obligation and responsibility of the State.
