SUBJECT: Draft Ordinances concerning Breweries, Brewpubs, Taprooms, Distilleries,
Microdistilleries, and Cocktail Rooms

INTRODUCTION
Attached, for the Commission review and comment, are five draft ordinances (all in one document)
concerning Breweries, Brewpubs, Taprooms, Distilleries, Microdistilleries, and Cocktail Rooms.
DISCUSSION
The first ordinance(pages 1-2 of the attachment)is an amendment to Title 3 of the City Code concerning the
sale of on-sale liquor specifically amending the types of licenses that are required. This ordinance adds the
requirement that a license be submitted and approved for a Cocktail Room, Brewpub, and a Taproom. In
addition, this particular ordinance corrects the outdated citation of Minnesota Statute 340 to the new Section
340A. This ordinance also allows for the potential issuance of a license for off-sale for a Cocktail Room,
Brewpub, and Taproom.
The second ordinance(pages 3-4 of the attachment)amends Title 10 the City Code adding the following
zoning definitions:
• BREWERY: A facility that produces beer, ale or other beverages made from malt by fermentation
and containing not less than one-half of one percent alcohol by volume.
• BREWERY, SMALL: A brewery that produces not more than twenty thousand(20,000)barrels of
malt liquor in a calendar year as regulated by Minnesota Statutes, as may be amended.
• BREWPUB: A small brewery with a restaurant use operated on the same premises as the brewery.
• COCKTAIL ROOM: An area for the on-sale consumption of distilled spirits on the premises of or
abutting a microdistillery and in common ownership to the producer,which may include sales of
beverages produced and packaged at the microdistillery for off-premises consumption as may be
allowed by Minnesota Statutes, as may be amended.
• DISTILLERY: A facility that produces ethyl alcohol, hydrated oxide ethyl, spirits of wine,whiskey,
rum,brandy, gin, or other distilled spirits, including all dilutions and mixtures thereof for nonindustrial
use.
• MICRODISTILLERY: A distillery producing premium, distilled spirits in total quantity not to exceed
forty thousand(40,000)proof gallons in a calendar year as regulated by Minnesota Statutes, as may
be amended.

• TAPROOM: An area for the on-sale consumption of malt liquor produced by the brewer for
consumption on the premises of a brewery or on an abutting property in common ownership of the
brewer, which may include sales of malt liquor produced and packaged at the brewery for off
premises consumption as allowed by Minnesota Statutes, as may be amended.
The third ordinance(pages 5-14 of the attachment)amends various zoning districts to address Breweries,
Small Breweries, Distilleries, Microdistilleries, Taprooms, and Cocktail Rooms as allowed uses. The draft
ordinance places Breweries, Small Breweries, Distilleries, and Microdistilleries as permitted uses within the
B-2(Downtown Business), B-3 (Heavy Business), IP (Industrial Park), and I-1 (Industrial)zoning districts.
Additionally, this ordinance lists Cocktail Rooms and Taprooms as conditional uses in the aforementioned
zoning districts. It should also be noted that Cocktail Rooms and Taprooms would only be allowed as an
accessory to Microdistillery(Cocktail Room)and Brewery/Small Brewery(Taproom). State Statute
requires that Cocktail Rooms and Taprooms either be on the premises of the Microdistillery or Brewery/
Small Brewery or on an adjacent property owned by the distiller or brewer.
The fourth ordinance(pages 15-26 of the attachment)amends various zoning districts to address Brewpubs
as an allowed use. The draft ordinance places Brewpubs as permitted uses within the B-1 (Highway
Business), B-2(Downtown Business), SSC (Spruce Street Commercial), Business/Commercial Flex, and the
MUCR Mixed Use Commercial/Residential.
The final ordinance(page 27 of the attachment)amends Section 7-2-5 of the City Code as it relates to
Offensive Business. This ordinance removes brewery and distillery from the list of unlawful businesses.

THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. Section 3-12-1, State Law Provisions Adopted,of the Farmington City Code is amended
by adding the following underlined language:
The provisions of Minnesota Statutes,chapter 340A,as amended,with reference to the definition of
terms,application for license, conditions of license,restrictions of consumption,provisions on sales,
condition of bonds of licenses,hours of sale,and all other matters pertaining to the retail sale,distribution
and consumption of intoxicating liquor are hereby adopted and made a part of this chapter as if fully set
out herein,except as hereinafter modified.(Ord.083-156, 12-5-1983,eff. 1-1-1984)
SECTION 2. Section 3-12-3,License Required,of the Farmington City Code is amended by revising the
paragraph as follows,additions shown by underline or deletions shown by strike language:
With the exception of the municipally owned liquor store and except as provided in Minnesota Statutes
Annotated 340A, .11,subdivisions 2 and 15,no person shall directly or indirectly deal in,sell,keep for
sale or deliver any intoxicating liquor without first having received a license to do so as provided in this
chapter;nor shall any private club or public place, directly or indirectly or upon any pretense or by any
device,allow the consumption or display of intoxicating liquor or serve any liquid for the purpose of
mixing with intoxicating liquor without first having obtained a license therefor from the city as provided
in this chapter,except as otherwise expressly provided in this chapter.Except as otherwise expressly
provided herein,the provisions of this chapter regulating licensed establishments shall also apply to
municipally owned liquor establishments.(Ord. 083-156, 12-5-1983,eff. 1-1-1984)
SECTION 3. Section 3-12-4,Types of Licenses,of the Farmington City Code is amended by revising
and the paragraph as follows,additions shown by underline or deletions shown by strikethrough
language:
(B) "Special Club Licenses": Special on-sale licenses shall be issued only to clubs in accordance with the
provisions of Minnesota Statutes Annotated section 340A.11, subdivision 11.(Ord. 083-156, 12-5-1983,
eff. 1-1-1984)
(D) "Bottle Club License":Bottle club licenses may be issued to bottle clubs and business establishments
in accordance with the provisions of Minnesota Statutes Annotated section 340AA-1-9 for the consumption
or display of intoxicating liquor or the serving of any liquid for the purpose of mixing with intoxicating
liquor.This subsection shall not apply to any person or premises otherwise licensed by the city for the
sale of intoxicating liquor. (Ord. 083-156, 12-5-1983,eff. 1-1-1984)
(F) "Cocktail Room License": Cocktail room licenses may be granted to the holder of a microdistillery
license in accordance with Minnesota Statutes 340A. A cocktail room license authorizes on-sale of
distilled liquor produced by the distiller for consumption on the premises of or adjacent to one

distillery location owned by the distiller. A microdistillery may be issued an off-sale license subject
to the limitations and requirements specified in state law.
(G) "Brewpub License": Brewpub licenses may be granted to a brewery for a restaurant operated on the
premises in accordance with Minnesota Statutes 340A. A brewpub off-sale malt liquor license may
be issued,with approval of the commissioner, subject to the requirement of Minnesota Statutes 340A.
(H) "Taproom License": Taproom licenses may be granted to a brewery licensed in accordance with
Minnesota Statutes 340A for on-sale of malt liquor produced by the brewer for consumption on the
premises of or adjacent to one brewery location owned by the brewer. The license issued by the City
may authorize the licensee to conduct on-sale business on Sundays. The brewer may be issued a
license in accordance with state law for off-sale of malt liquor at its licensed premises that has been
produced and package by the brewer.
SECTION 4. Effective Date. This ordinance shall be effective upon its passage according to law.

(A)Purpose: The SSC Spruce Street commercial district is primarily designated for commercial retail
sales and services.This district is not intended to compete with the businesses in the central business
district;rather,it is intended to provide a location for those businesses that have space needs that
cannot be accommodated in the downtown or would be a disruption to existing development patterns.
Development in this district will provide design elements and building and site relationships that
emulate traditional main street form to create a walkable pedestrian friendly environment with
connections to surrounding areas.The relationship of the Spruce Street commercial district to CSAH
50, future residential development,and the central business district will require a greater sensitivity to
design with higher quality standards in order to develop a pleasant,attractive and aesthetically
pleasing environment.

FARMINGTON CITY CODE CONCERNING
OFFENSIVE BUSINESS
THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS:
SECTION 1. Section 7-2-5 of the Farmington City Code is amended by removing the following struck
through language:
7-2-5: OFFENSIVE BUSINESS:
It shall be unlawful for any person to establish,maintain and carry on any offensive or unwholesome
business within the city or within one mile of the limits thereof.
It shall be unlawful for any person to locate,without first having obtained permission of the council so to
do,any packing house,renderies,tallow chandleries,bone factories,soap factories,tanneries,brewery,
distillery,or any establishment liable to produce offensive or unwholesome smells,within the city and
within the distance of one mile of the limits thereof.(1970 Code)
SECTION 2. Effective Date. This ordinance shall be effective upon its passage according to law.
