Call to order Chair Rotty called the meeting to order at 7:00 pm Members Present: Rotty,Franceschelli ,Bjorge,Rich,Kuyper Members Absent: None Also Present: Planning Manager Tony Wippler 2. Approval of Minutes a) Motion by Rich second by Bjorge to approve the minutes of September 9,2015. Vote: 4-0- 1 (Kuyper Abstained),Motion Carried. 3. Chair Rotty opened the public hearings a) Ordinance amending Title 3, Chapter 12, of the Farmington City Code concerning on- sale liquor_ Planning Manager Wippler shared the proposed ordinance with the commission. The ordinance adds the requirement that a license be submitted and approved for a Cocktail Room,Brewpub,and a Taproom. Also,this ordinance corrects the outdated citation of Minnesota Statutes 340 to the new Section 340A. This ordinance also allows for potential issuance of a license for off-sale for a Cocktail Room,Brewpub and Taproom. Motion by Franceschelli second by Kuyper to close the public hearing. APIF,Motion Carried. Motion by Franceschelli second by Kuyper to recommend approval and forward to the City Council for action.APIF,Motion Carried. b) An ordinance amending Title 10,Chapter 2 of the Farmington City Code defining brewery,small brewery, brewpub,cocktail room ,distillery,microdistillery, and taproom—Planning Manager Wippler noted that the ordinance amends Title 10, Chapter 2 of the City Code adding the following zoning definitions: • BREWERY: A facility that produces beer, ale or other beverages made from malt by fermentation and containing not less than one-half of one percent alcohol by volume. • BREWERY, SMALL: A brewery that produces not more than twenty thousand(20,000)barrels of malt liquor in a calendar year as regulated by Minnesota Statutes,as may be amended. • BREWPUB: A small brewery with a restaurant use operated on the same premises as the brewery. • COCKTAIL ROOM: An area for the on-sale consumption of distilled spirits on the premises of or abutting a microdistillery and in common ownership to the producer,which may include sales of beverages produced and packaged at the microdistillery for off-premises consumption as may be allowed by Minnesota Statutes, as may be amended. • DISTILLERY: A facility that produces ethyl alcohol,hydrated oxide ethyl, spirits of wine, whiskey,rum,brandy, gin, or other distilled spirits,including all dilutions and mixtures thereof for nonindustrial use. Planning Commission October 13,2015 • MICRODISTILLERY: A distillery producing premium,distilled spirits in total quantity not to exceed forty thousand (40,000)proof gallons in a calendar year as regulated by Minnesota Statutes,as may be amended. • TAPROOM: An area for the on-sale consumption of malt liquor produced by the brewer for consumption on the premises of a brewery or on an abutting property in common ownership of the brewer,which may include sales of malt liquor produced and packaged at the brewery for off premises consumption as allowed by Minnesota Statutes, as may be amended. Motion by Rich second by Bjorge to close the public hearing. APIF,Motion Carried. Motion by Bjorge second by Franceschelli to recommend approval and forward to the City Council for action. APIF,Motion Carried. c) An ordinance amending various zoning districts concerning breweries,small breweries, distilleries,microdistilleries,taprooms,and cocktail rooms-Planning Manager Wippler noted the ordinance places breweries, small breweries,distilleries,and microdistilleries as permitted uses within the B-2 (Downtown Business),B-3 (Heavy Business),IP (Industrial Park),and I-1 (Industrial)zoning districts. Additionally,this ordinance lists cocktail rooms and taprooms as conditional uses in the aforementioned zoning districts. It should be noted that cocktail rooms and taprooms would only be allowed as an accessory to a microdistillery (cocktail room) and brewery/small brewery(taproom). State Statute requires that cocktail rooms and taprooms either be on the premises of the microdistillery or brewery/small brewery or on an adjacent property owned by the distiller or brewer. Motion by Franceschelli second by Bjorge to close the public hearing. APIF,Motion Carried. Motion by Kuyper second by Franceschelli to recommend approval and forward to the City Council for action. APIF,Motion Carried. d) An ordinance amending various zoning districts concerning brewpubs--Planning Manager Wippler indicated that the ordinance amends various zoning districts to address brewpubs as an allowed use. The ordinance places brewpubs as a conditional use within the B-1 (Highway Business),B-2(Downtown Business), SSC(Spruce Street Commercial), Business/Commercial Flex, and the MUCR(Mixed Use Commercial/Residential).Motion by Kuyper second by Rich to close the public hearing. APIF,Motion Carried. Motion by Rich second by Franceschelli to recommend approval and forward to the City Council for action. APIF,Motion Carried. e) An ordinance amending Title 7,Chapter 2 of the City Code as it relates to offensive business.—Planning Manager Wippler noted that the ordinance removes brewery and distillery from the list of unlawful businesses. Motion by Kuyper second by Francheschelli to close the public hearing. APIF,Motion Carried. Motion by Franceschelli second by Kuyper to recommend approval and forward to the City Council for action, APIF,Motion carried. 4. Adjourn -Motion by Kuyper second by Bjorge to adjourn at 7:34PM.
