PUBLIC HEARINGS a) Adopt Enabling Resolution and Ordinance Economic Development Authority Composition Revision-Administration The current composition of the EDA is two councilmembers and three residents. The city council requested that two school board members be added. Their term will run concurrent with their school board term and they will receive a stipend as other non-councilmembers do. Council will appoint the school board members during the board and commission interview process in January 2016. This change will be effective February 1,2016. As school board meetings are the same night as EDA meetings,the EDA will determine a new meeting schedule for 2016 at their next meeting. MOTION by Bartholomay, second by Bonar to close the public hearing. APIF,MOTION CARRIED. MOTION by Bartholomay, second by Bonar to adopt enabling RESOLUTION R58-15 amending the enabling resolution of the EDA and ORDINANCE 015-702 amending title 2, boards and commissions, chapter 8,Economic Development Authority, amending the composition of the EDA to be appointed by the city council. APIF, MOTION CARRIED. 9. AWARD OF CONTRACT 10. PETITIONS,REQUESTS AND COMMUNICATIONS a) Adopt Ordinances Concerning Breweries,Brewpubs,Taprooms,Distilleries, Microdistilleries and Cocktail Rooms—Community Development Ordinances were presented for the above types of businesses including definitions and zoning districts. Breweries, small breweries, distilleries and microdistilleries will be permitted uses in the B-2,B-3, 1P, and I-1 zoning districts. Cocktail rooms and taprooms will be conditional uses in these zoning districts. Brewpubs will be allowed as conditional uses in the B-1,B-2, Spruce Street commercial, business/commercial flex and mixed use commercial/residential districts. A license will be required for a cocktail room,brewpub and taproom for on-sale and off-sale. An ordinance also removes brewery and distillery from the list of unlawful businesses. APIF,MOTION CARRIED. b) Sanitary Sewer Joint Powers Agreement with the City of Lakeville- Engineering This agreement pertains to the upsizing of the sanitary sewer line in the Lakeville development,Pheasant Run,which is just north of 180th Street and east of Pilot Knob Road. Farmington also uses this sewer line. As the upsizing benefits the utility system in general,the developer will be compensated for upsizing costs. The total cost is $89,271, of which$17,410.50 is attributable to Farmington and the remaining$71,860.50 pertains to Lakeville. Funding will come from the sanitary sewer fund. MOTION by Bartholomay, second by Pitcher to approve the Joint Powers Agreement with Lakeville for the sewer line work in the Pheasant Run development. APIF,MOTION CARRIED. c) Adopt Resolution Dakota County 2016 to 2020 Capital Improvement Plan- Engineering Farmington has requested two projects be included in the county's 2016 to 2020 CIP. An overlay of Pilot Knob Road from south of 195th Street to CSAH 50 and CSAH 50 from Cedar Avenue to Division Street will be done in 2016. Also, .signal reconstruction on TH3 at Elm and Ash Streets will be done in 2016. MOTION by Bonar, second by Pitcher to adopt RESOLUTION R59-15 supporting Dakota County's 2016 to 2020 C1P. COUNCIL ROUNDTABLE City Administrator McKnight: The fire department's turkey bingo will be held November 14,2015, at Fire Station one. DISCUSSION Per State Statute 349.166 and pertinent City Code,a Gambling Event Permit must be issued by the city for this type of event. An application has been received, along with the appropriate fees. The city attorney has reviewed the application and the attached resolution approving the request. BUDGET IMPACT Gambling fees are included in the revenue portion of the 2015 budget. DISCUSSION The Masonic Lodge is requesting a temporary on-sale liquor license for a wine with dinner event to be held on December 11,2015 at 326 Third Street. Per state statute,a temporary on-sale liquor license must first be approved by the city and then forwarded to the state for approval BUDGET IMPACT The State of Minnesota waives all fees for temporary liquor licenses for non-profit organizations. DISCUSSION A cash donation of$367.15 was made by Happy Harry's Furniture to the RRC. The donation was made through a program created in 2011. The program provides an opportunity for a customer of Happy Harry's Furniture to select a charity of their choice to receive a donation when the customer purchases merchandise from the store and then 10%from the sale to the customer is donated to the charity. The RRC is one of the charities that can be selected. With this most recent donation,Happy Harry's Furniture has donated a total of$6,696.65 to the RRC since the program's inception. This donation has been deposited into the RRC Capital Improvement Fund and will be used for future building improvements and/or for purchasing equipment or furniture for the RRC. Betty Steege, Jodi Pedersen and Margaret Wenner donated a new bookshelf that was installed in the RRC's Jerry Ristow Library. The purchased value of the bookshelf is $325.00. The bookshelf was donated in memory of Jim Steege. Staff will communicate the city's appreciation on behalf of the city council to Happy Harry's Furniture, Betty Steege, Jodi Pedersen and Margaret Wenner for their generous donations to the RRC. DISCUSSION An agreement is attached that reflects the hourly rate FSD will pay the City for boys and girls high school hockey games along with the City's and FSD's responsibilities during the games that are played at the arena. The proper FSD administrative staff has reviewed and signed the attached agreement form. BUDGET IMPACT FSD's rental of the arena for high school games provides revenue for the arena. The total revenue generated during the ice season however, depends on the total number of home games played during the regular season, tournaments and playoffs. The School District hereby agrees to pay to the City$323.75 an hour for Farmington High School varsity and junior varsity games when the Facility Maintenance Supervisor works during games and$263.75 an hour when the Facility Maintenance Supervisor does not work during games. Since the School District is tax exempt no taxes will be charged. The City agrees to allow the School District to keep 100%of the gross ticket proceeds from Farmington High School hockey games. In consideration of being allowed to use the Schmitz-Maki Arena(Arena),the School District,for itself and each of its members,hereby voluntarily assumes all risks of accident or damage to its property and to any person and property of said members and hereby releases and agrees to defend and indemnify the City,its officers and employees from every claim,liability or demand of any kind for or on account of any personal injury or damage of any kind sustained by it and each one of its members or guests,whether caused by negligence by the City,its officers or employees. The parties agree that the release,defense, and indemnification obligations of this Agreement are intended to be as broad and inclusive as is permitted by the laws of Minnesota. If any portion thereof is held invalid,it is further agreed that the balance shall,notwithstanding,continue in full legal force and effect.Further,the School District agrees ;. that it and its members and guests using the Arena shall abide by all rules and regulations from time to time in effect governing the use thereof. It is understood that the City and the School District each reserves the right(1)to cancel this Agreement for any default by either party in terms of this Agreement and(2)to reschedule the dates or times of permitted use of said facilities on 20 days written notice. In the event of mechanical failure of the Arena's equipment,the School District shall be notified by the • Arena staff as soon as possible. The condition of the ice sheet becomes the responsibility of the Arena staff Prepaid fees for hours canceled due to mechanical failure shall be reimbursed to the School District. The School District shall receive a refund of the amount owed for ice rental when the following conditions apply: • 1. When the School District has declared school closed due to inclement weather or other emergency 7. • condition,Act of God/Force Majeure. 2. When the Minnesota State High School League curtails all practice times for any reason. All invoices or refunds due to the School District under this Agreement shall be sent directly to the School District's Business Office. The City shall provide and pay for the following: • One(1)scoreboard operator • One(1)announcer • One(1)penalty box gate operator The School District shall provide and pay for the following: • First-aid personnel • Game referees • Goal judges when deemed necessary by the Athletic Director • Admission personnel Concessions are provided by the Farmington Youth Hockey Association (FYHA).Scheduling and concession's staffing will be facilitated by FYHA.The School District agrees to inform both FYI-IA and the City about any concerns and/or issues it has with concessions. The School District shall be responsible for notifying their opponents of the game schedule and fees set forth by the City for the Arena. DISCUSSION Mr. Gene Spars has submitted his resignation from his position on the Parks and Recreation Commission. His term on the board runs through January 31,2016. A copy of his resignation is attached. This seat will be advertised with the annual vacancies. The corporate offices for Family Fresh have recently changed their practices and rather than buying and charging to an in-store account,they have requested that each purchaser have their own purchasing card(ie. store credit card). DISCUSSION Since, several of the staff who purchase items from Family Fresh have city issued credit cards, it is more efficient to expand the number of city business cards. If we did not use this approach then, some staff members would have both a city issued credit card and a Family Fresh purchasing card which is confusing and cumbersome. In addition Finance would now have another account to maintain and reconcile. It is more efficient and less confusing to provide city business cards to those additional staff members who purchase items for city business from Family Fresh. Staff recommends four additional business credit cards be issued as follows: Assistant Fire Chief Jeff Allbee Assistant Fire Chief Justin Elvestad Assistant Fire Chief Jim Schmitz Municipal Services Coordinator Lena Larson Staff recommends the credit limit for each card be$500. BUDGET IMPACT This does not affect the city budget. After nine months, assuming revenues were received and expenditures made evenly throughout the year,you would expect revenues and expenditures to be approximately 75% of their annual budget amounts. As you review the attached financial reports,the following notes will provide explanations for the more significant variations from budgeted expectations. DISCUSSION General Fund Revenues Year-to-date General Fund revenues total$5.5 million or 53%of budgeted amounts. Property Taxes—Property taxes represent 81%of the city's total budgeted General Fund revenues. The first installment was received. Of that amount, $60K represented debt levy for the repayment of the fire truck loan and$40K for previously delinquent taxes. Licenses—License revenue is ahead of pro-rata budget amounts. When compared to 2014,the 2015 amounts are lower because 2015 is the second year of the two year renewal license period. In addition residents have the option to purchase lifetime animal licenses. After factoring in October liquor license renewals,this line item will finish ahead of budget for the year. Permits—Building,plumbing and heating, sewer and utility permit revenues are less than last year and behind the 2015 pro-rata budgeted amounts. Building activity is slower. To-date there are 31 fewer permits in 2014(78)than in 2015(47). Staff estimates this line item will finish the year$110,000 below budget. Intergovernmental—LGA,Fire and Police Aid amounts will be received in the fourth quarter. Investment Income—Historically,investment income was allocated based on budgeted amounts amongst a few funds.Now,investment income is being allocated based on month-end cash balances across all city funds. The General Fund is benefiting from having a higher month-end cash balance than it has in the past. Miscellaneous Revenues—This line item is primarily for rental income. 2015 rental income is lower than 2014 primarily due to no rental income from the library;this was available in 2014 during their remodeling project. In 2015,this line item also reflects the city's decision to utilize$81K of its existing fund balance to pay for increased human resource costs in the fire department($60K)and the carryover of a 2014 building project for the fire department(fire station#1 concrete apron replacement for$21K)to 2015. General Fund Expenditures The year-to-date General Fund expenditures for 2015 total$7.5 million or 70%of budget. Legislative-The annual League of Minnesota Cities dues were paid during the 3rd quarter. Emergency Management—Siren repairs have been higher than budgeted. Fire—Year-to-date expenditures are$143K more than 2014 for the same time period. Of this amount $68K represents higher human resource costs,which relate to higher costs for a full-time fire chief and increased cost for the paid, on-call firefighters related to increased training. In addition higher uniform costs for the new fire chief and turnout gear replacement comprise$30K of the increase. The remaining $45K in expenditures was spent across many line items to address deferred and ongoing operational needs. Staff expects part-time salaries,primarily related to training,but also increased calls,will be $50,000 over for the year. Planning—Year-to-date expenditures are 95% of budget,the higher than expected amount relates to a personnel settlement with a former employee. Snow Removal—Year-to-date amounts are significantly less than last year. The first four months of 2015 were much milder than the same time period in 2014. General Fund,Fund Balance During the first nine months of 2015 the fund balance in the General Fund decreased approximately$1.7 million to approximately$2.4 million or 22.2%of the 2015 budgeted General Fund expenditures. The historical General Fund fund balance chart is included in your packet. General Fund 2015 Projection Staff has updated its 2015 General Fund projection for the rest of the year and will continue to do so each month. Projected revenues continue to be less than budgeted,primarily in the area of building permits. Expenditure budgets are challenging,but are still projected to come in under budget. Continued low fuel prices and a very mild start to winter would be very helpful,not only with the snow removal budget,but also with heating costs. Other Funds Rambling River Center(Included in the General Fund) Overall,Rambling River Center revenues are ahead of budget. After including$4,500 for CDBG reimbursements which are separately tracked in the federal grants line item,the 2015 YTD revenues are $3,300 less than the first nine months of 2014. This reflects a few trip cancellations due to insufficient registrations and not as many program offerings with the reduction in city staff. The 2015 year-to-date expenditures are within budget. The increase relative to 2014 relates to costs incurred with the concrete entrance replacement and motion sensor switch improvements. Pool(Included in the General Fund) The 2015 pool revenues are nearly identical to 2014. The revenue mix changed with pool .dmissions, concessions and rentals being higher and swimming lessons being less. The 2014 year-to-date expenditures were$4,000 less. EDA–Special Revenue Fund The large revenue and expenditure variances are due to the receipt of CDBG funds and subsequent payment to Dakota County Lumber for their improvement project. These amounts were not included in the day-to- date operating budget for the EDA. Park Improvement Fund—Special Revenue Fund 2015 revenues are ahead of budget,though less than 2014,primarily due to fewer special assessments being received and fewer park development fees which correlate with fewer building permits. Year-to-date expenditures include the purchase of park boardwalk materials and a new park shelter in Fairhills Park. Ice Arena–Special Revenue Fund Increased revenues are attributable to summer ice and increased advertising revenue. Higher expenditures include new security cameras, 10,000 hour service for the compressors,resurfacer maintenance and repair of the condenser variable speed drive motor. • Enterprise funds Liquor Operations Neither liquor store met their individual gross profit benchmark of 25%. Through September the downtown liquor store was at 24.6%and the Pilot Knob liquor store was at 24.5%. The stores are experiencing increased competitive pressure from neighboring communities and the traffic flow disruption of the 195th street project. Staff continues to closely monitor sales prices and when buying inventory works to take advantage of vendor sales and quantity discounts to maximize profit margins. The net income for 2015 is $95K less than last year. The difference can be summarized by the following: security camera upgrades ($20K,post last year's burglary);the fact that the community investment transfers are being done pro-rata throughout the year in 2015,rather than at the end of the year($31K); and that net sales are lower at both stores (DT$3.9K and PK$37.8K lower). Sewer Fund The increase in 2015 expenses when compared to 2014 is primarily attributable to the budgeted increase in MCES (Metropolitan Council Environmental Services)fees. Solid Waste The 2015 increase in expenditures is related to higher recycling costs from Dick's for residential properties, including townhomes, an increase in the amount of commercial recycling, increased disposal fees from Resource Recovery and the purchase of new garbage containers. In addition the city has disposed of nearly 154 tons more in the first nine months of 2015,when compared to the same time period in 2014. Storm Water The increase in expenses,when compared to 2014, is related to pond dredging and the 195th street reconstruction project. Water Revenues consist of not only water bills,but also special assessments,permits,water availability charges, interest on investments,marked-to-market on investments and rental income. The water availability charges are less than 2014 due to fewer building permits. The 2015 net interest income amounts are less than 2014. Current year amounts are allocated based on actual month-end cash balances. Past practice was to allocate in accordance with budget allocation. The 2015 rental income is higher than 2014,because the new lease with Verizon started in September 2014, which means the revenues for this lease were not in effect during the first nine months of 2014. Enterprise sales are lower than 2014 and are starting to reflect that less water is being consumed. Quarterly billing has a built in 1-2 month lag. The"all other revenues"in the Water Fund line item trends with building permit activity.As you know building permit activity is down and as a result these amounts are down when compared to the prior year. There is no one particular reason for the decrease in Water Fund expenses from the prior year. Several line items are lower than last year and several line items are ahead of where they were a year ago. BUDGET IMPACT Not applicable. These bonds bear interest at 4.63%. The city's last payment is scheduled for August 20, 2016. In early 2016, the bonds are optionally redeemable,at par,plus accrued interest. The city uses property taxes to repay these bonds. DISCUSSION Upon receipt of the second installment of the 2015 property taxes,the city will have sufficient funds on hand to fully redeem the remaining obligation. Retiring the bonds early will save the City$659.95 in interest and fully retire this series of bonds. Staff recommends notifying the Public Facilities Authority(the issuer)of the city's intention to repay the remaining bonds early and remitting the necessary funds to complete the payoff. BUDGET IMPACT The benefit to the city is estimated to be$659.95 in net interest savings. ACTION REQUESTED 1. Authorize the Finance Director to notify the Public Facilities Authority of its intention to repay the remaining amount outstanding,plus accrued interest, as of February 20,2016. 2. Celebrate the city fully retiring one more series of bonds.
