PLEDGE OFALLEGIANCE Ben and Carter,members of Boy Scout Troop 116 led the audience and Council in the Pledge of Allegiance. 3. CONSENT AGENDA MOTION by Bartholomay, second by Pitcher to approve the Consent Agenda as follows: a) Approved Council Minutes (10/5/2015 Regular)(10/12/2015 Work Session)- Administration b) Received Third Quarter 2015 New Construction Report and Population Estimate —Community Development c) Adopted RESOLUTION R56-15 Approving Dakota County Ten Ton Route Designation-Engineering d) Adopted RESOLUTION R57-15 Accepting Donations to Rambling River Center for New Flower Containers—Parks and Recreation e) Approved Appointment Recommendation Liquor Operations—Human Resources f) Approved Appointment Recommendation Police Department—Human Resources g) Approved Appointment Recommendation Fire Department—Human Resources h) Approved Seasonal Hiring—Human Resources i) Approved Sale of Excess City Property-Police j) Approved Bills Council Minutes(Regular) October 19,2015 Page 2 APIF,MOTION CARRIED. 8. PUBLIC HEARINGS a) Adopt Enabling Resolution and Ordinance Economic Development Authority Composition Revision-Administration The current composition of the EDA is two councilmembers and three residents. The city council requested that two school board members be added. Their term will run concurrent with their school board term and they will receive a stipend as other non-councilmembers do. Council will appoint the school board members during the board and commission interview process in January 2016. This change will be effective February 1, 2016. As school board meetings are the same night as EDA meetings,the EDA will determine a new meeting schedule for 2016 at their next meeting. MOTION by Bartholomay, second by Bonar to close the public hearing. APIF,MOTION CARRIED. MOTION by Bartholomay, second by Bonar to adopt enabling RESOLUTION R58-15 amending the enabling resolution of the EDA and ORDINANCE 015-702 amending title 2, boards and commissions, chapter 8,Economic Development Authority,amending the composition of the EDA to be appointed by the city council. APIF, MOTION CARRIED. 9. A WARD OF CONTRACT 10. PETITIONS,REQUESTS AND COMMUNICATIONS a) Adopt Ordinances Concerning Breweries,Brewpubs,Taprooms,Distilleries, Microdistilleries and Cocktail Rooms—Community Development Ordinances were presented for the above types of businesses including defmitions and zoning districts. Breweries, small breweries, distilleries and microdistilleries will be permitted uses in the B-2, B-3, IP, and I-1 zoning districts. Cocktail rooms and taprooms will be conditional uses in these zoning districts. Brewpubs will be allowed as conditional uses in the B-1,B-2, Spruce Street commercial, business/commercial flex and mixed use commercial/residential districts. A license will be required for a cocktail room,brewpub and taproom for on-sale and off-sale. An ordinance also removes brewery and distillery from the list of unlawful businesses. MOTION by Pitcher, second by Bonar to adopt ORDINANCE 015-703 amending title 3,chapter 12 concerning the sale of on-sale liquor, ORDINANCE 015-704 amending title 10, chapter 2 defining brewery, small brewery,brewpub, cocktail room, distillery, microdistillery and taproom, ORDINANCE 015-705 amending sections 10-5-14(downtown business), 10-5-15 (heavy business), 10-5- 21 (industrial park)and 10-5-22 (industrial)relating to breweries, small breweries,distilleries,microdistilleries,taprooms and cocktail rooms, ORDINANCE 015-706 amending sections 10-5-13 (highway business), 10-5-14 Council Minutes(Regular) October 19,2015 Page 3 (downtown business), 10-5-17(Spruce Street commercial), 10-5-18 (business commercial flex)and 10-5-20(MUCR mixed use commercial/residential)relating to brewpubs, ORDINANCE 015-707 amending title 7, chapter 2 concerning offensive business. APIF,MOTION CARRIED. b) Sanitary Sewer Joint Powers Agreement with the City of Lakeville- Engineering This agreement pertains to the upsizing of the sanitary sewer line in the Lakeville development,Pheasant Run,which is just north of 180 'Street and east of Pilot Knob Road. Farmington also uses this sewer line. As the upsizing benefits the utility system in general, the developer will be compensated for upsizing costs. The total cost is$89,271,of which$17,410.50 is attributable to Farmington and the remaining$71,860.50 pertains to Lakeville. Funding will come from the sanitary sewer fund. MOTION by Bartholomay, second by Pitcher to approve the Joint Powers Agreement with Lakeville for the sewer line work in the Pheasant Run development. APIF,MOTION CARRIED. c) Adopt Resolution Dakota County 2016 to 2020 Capital Improvement Plan- Engineering Farmington has requested two projects be included in the county's 2016 to 2020 CIP. An overlay of Pilot Knob Road from south of 195th Street to CSAH 50 and CSAH 50 from Cedar Avenue to Division Street will be done in 2016. Also, .signal reconstruction on TH3 at Elm and Ash Streets will be done in 2016. MOTION by Bonar, second by Pitcher to adopt RESOLUTION R59-15 supporting Dakota County's 2016 to 2020 CIP. APIF,MOTION CARRIED. 11. UNFINISHED BUSINESS 12. NEW BUSINESS a) Adopt Ordinance 2016 Fee Schedule-Administration Changes to the 2016 fee schedule were presented. MOTION by Bartholomay, second by Bonar to adopt ORDINANCE 015-708 approving the 2016 fee schedule. APIF,MOTION CARRIED. 13. COUNCIL ROUNDTABLE City Administrator McKnight: The fire department's turkey bingo will be held November 14, 2015, at Fire Station one. City Engineer Schorz`nan: The 195th Street project is on schedule to be finished the end of November. Parks and Recreation Director Distad: The Rambling River Center's silent auction and waffle breakfast will be held October 24, 2015. The Halloween Walk will be held October 30, 2015, at Council Minutes(Regular) October 19,2015 Page 4 Dodge Middle School at 5:00 p.m. The Halloween Skate will be held October 30,2015, at 7:00 p.m. at the ice arena.
