Council Member Pitcher represents the City Council on this committee. One Planning Commissioner is needed to represent the Commission on this committee. The 2015 representative was Planning Commissioner Bjorge. B) Castle Rock Discussion Group This committee meets periodically to discuss topics pertinent to Farmington and Castle Rock Township. Mayor Larson represents the City Council on this committee. One Planning Commissioner is needed to represent the Commission on this committee. The 2015 representative was Planning Commissioner Franceschelli. C) Eureka/Farmington Planning Group This committee meets periodically to discuss topics pertinent to Farmington and Eureka Township. Council Member Bonar represents the City Council on this committee. One Planning Commissioner is needed to represent the Commission on this committee. The 2015 representative was Commissioner Kuyper. D) MUSA Review Committee This committee meets periodically to discuss the growth of Farmington and where the next extension of sewer will occur in the future. Council Members Donnelly and Pitcher represent the City Council on this committee. Two Planning Commission Members are needed to represent the Commission on this committee. The committee is also made up of two members from the Parks and Recreation Commission/ staff and two members from the School District Board/staff. The 2015 representatives were Commissioners Kuyper and Rich. The minimum lot size in the A-1 Zoning District is 40 acres. The subject property is owned by the Kathleen Blair Trust. Planning Review Applicant: Kathleen M. Blair Trust 101 E. 10th Street,Apt. 649 St. Paul, MN 55101 Property Location: Generally located East of Flagstaff Avenue, South of CSAH 50(see Exhibit A). Existing Parcel Size: 39.86 acres Proposed Parcel Sizes: One 24.40 acre parcel and one 15.46 acre parcel. Existing Zoning: A-1 (Agriculture) 2030 Comprehensive Plan: Agricultural and Park/Open Space(floodplain) Surrounding Land Uses: Agricultural uses to the South, East, and North; Single-family residences to the West. Attached exhibits: Exhibit A-General Location Map Exhibit B-Variance and Waiver of Plat Application Exhibit C -Certificate of Survey Exhibit D-Legal Descriptions for subject properties Exhibit E-2030 Comprehensive Plan Map DISCUSSION The minimum lot size requirement for properties within the A-1 Zoning District was amended in May of 2002. The previous minimum lot area was one(1)acre and was changed to forty(40)acres. The applicant is requesting to split the subject property into two parcels (a 24.40 acre parcel and a 15.46 acre parcel). Dakota County has reached an agreement with the property owner to purchase the northern 24.40 acres (see attached survey-Exhibit C)as part of its Lake Marion Greenway Master Plan. The following is a lost of properties that have received similar variances in the past from the A-1 Zoning District Standards: Devenshire Farms 9-11-12(1 parcel)-approved Pelach 6-12-12(4 parcels)-approved Malszycki 3-9-10(2- 1 acre parcels)-approved P. Donnelly 10-10-06(5 acre parcel)-approved ISD#192 10-10-06(18.4 acre parcel)-approved T. Donnelly 6-10-03 (5 acre parcel)-approved Kindseth 2-11-03 (1.42 and 1.69 acre parcels)-approved Ward 1-14-03 (30 acre parcel)-approved B. Donnelly 12-10-02(30 acre parcel)-approved The Board of Adjustment may vary from the regulations of this Title if the following requirements are met: 1. Because the particular physical surroundings, or the shape, configuration, topography, or other conditions of the specific parcel of land involved, strict adherence to the regulations of this title would cause practical difficulties. Economic consideration alone does not constitute practical difficulties. The City Code was amended in May of 2002 to increase the minimum lot area required for properties in the A-1 Zoning District from one(1)acre to forty(40)acres. If the Code amendment had not occurred, the applicant could proceed with the waiver of plat and be in complete compliance with the Zoning Code. Additionally, the property is substantially encumbered with floodplain and various easements that render approximately 15.46 acres as developable. This makes the property generally unique in that approximately 61% of the total property acreage is technically undevelopable. 2. That the variance would be consistent with the comprehensive plan. The comprehensive plan shows the property as agriculture and park and open space. The uses of the property will remain the same after the approval of the waiver of plat(agriculture on the southern 15.46 acres and park/open space on the northern 24.40 acres). Therefore, the created parcels would be consistent with the 2030 Comprehensive Plan. 3. That the variance would be in harmony with the general purposes and intent of this title. The applicant,Kathleen Blair, wishes to split the property into two parcels(a 24.40 acre parcel and a 15.46 acre parcel)in order to sell and convey the northern 24.40 acre parcel to Dakota County as part of the County's Lake Marion Greenway Master Plan. The 24.40 acre parcel will remain as open space/natural area and the southern 15.46 acres will continue to be farmed. The granting of a variance in this instance would be in harmony with the general purpose and intent of this Title. 4. The condition upon which a variance is based are unique to the parcel of land for which the variance is sought and are not applicable, generally, to other properties within the same zoning classification. The northern 24.40 acres of the total 39.86 acre parcel is almost entirely encumbered with floodplain. Additionally, there are several easements that bisect the northern 24.40 acres of this property. Due to these encumbrances, this property is generally unique in the A-1 district as only the southern 15.46 acres is technically developable 5. The alleged difficulty or hardship is caused by this title and has not been created by any persons presently having an interest in the parcel of land. As previously mentioned the property is substantially encumbered with floodplain and easements, making a large portion of the property(approximately 24.40 acres of 39.9 acres)non-developable. This difficulty was not created by any persons having an interest in this property. 6. The granting of the variance will not alter the essential character of the locality or be injurious to other property in the vicinity in which the parcel of land is located or substantially diminish property values. Granting a variance to create a 24.40 acre parcel and a 15.46 acre parcel would not alter the character of the area or have a negative impact on other property within the vicinity. Both parcels will continue to be utilized in a similar manner as they had prior to the proposed split 7. The proposed variance will not substantially increase the congestion of the public streets, or increase the danger of fire, or be detrimental to the public welfare or public safety. The proposed variance would not result in any of the above mentioned adverse effects. 8. The requested variance is the minimum action required to eliminate the practical difficulties. The granting of the variance would allow for the selling and conveyance of the northern 24.40 acres of this parcel to Dakota County. This would be the minimum action required. 9. Variances may not be approved for any use that is not allowed under this title for property in the zone where the affected person's land is located except that the temporary use of a one-family dwelling as a two-family dwelling may be authorized by variance. The practical difficulty was not created by the owner or applicants or any other person having an interest in the property. ACTION REQUESTED Approve the variance to allow the creation of a 24.40 acre parcel and a 15.46 acre parcel of land on the Kathleen Blair property generally located South of CSAH 50, on the East side of Flagstaff Avenue through the waiver of platting process.
