DISCUSSION Background For the last several years Mr. Bongard has been attempting to sell his property located at 20522 Akin Road (see attached Exhibit A). This property is the current location for his trucking operation. The property is zoned R-1 (Low Density Residential), thereby making it difficult for Mr. Bongard to sell the property for commercial uses. On August 10, 1976 the City's Planning Commission granted a special exception permit (Conditional Use Peiiii;t)for this property to allow Equipment Maintenance& Storage,Non-commercial on this site(please see Exhibit B). The definition for Equipment Maintenance& Storage,Non-commercial was established by ordinance No. 076-39 and is as follows: "Equipment Maintenance& Storage, Non-commercial: A building in which is exclusively maintained, repaired or stored, only equipment which is owned and used by the same individual,firm, or organization that owns, rents, leases or occupies the building and in which no maintenance, repair or storage of equipment is performed for any other party or person." As the Commission is aware, staff has had discussions with Mr. Bongard about the possibility of rezoning the property to a B-4(Neighborhood Business)zoning designation and amending the comprehensive plan designation to Commercial. Mr. Bongard is aware that he would have to petition for these changes and that approval of these changes is ultimately up to the City Council after review and recommendation from the Planning Commission. As a reference, I have attached the B-4 zoning code as Exhibit C. ACTION REQUESTED Hear Mr. Bongard and provide any direction to Mr. Bongard and/or staff that the Planning Commission feels is appropriate. The meeting was called to order at 7:30 P.M. by the Chairman Present: Chairman Shirley, Members Endres, Hoyer, Nelson Absent: Member Hanson Also Present: 'Administrator Ford • 2. Motion by Nelson, second by Endres to approve the Minutes of July 20, 1976 APIE, motion carried. -----4-- 3. The Chairman opened the public hearing previously scheduled for 7:30 P.M. in the matter of the request of Mr. James-Reisinger for.. a special:exception in the C-1 zoning district for a "Equipment maintenance and storage; non-commercial" land use as permitted by ordinance #076-39. The Planning Commission discussed this matter thoroughly and determined thatAhe requested special exception did meet the requirements of the code for said special exception. Motion by Nelson, second by Shirley that the above special exception be granted on the following conditions: Type of Building - Pre-engineered structural steel, butler type Gold or yellow in-color. Size of Building - Shop,'60 x 40; attached office, 20 x 30. . . ' . Screening - That adequate and satisfactory landscape . screening be planted on both the North. and South lines beginning at the 30 ft'. set back line for - a distance of 80 ft. Voting.'for: Shirley, Nelson, Endres. Voting against: Royer. Absent: Hanson. • Motion carried. 4. The planning commission then entertained the •request of Mrs. Tyrone Yule for a home occupation special exception to operate a beauty salon from.her home at 900 Maple Street. Motion by Endres, second by Hoyer that a public hearing be set in this matter for 7:30 P.M September 21 1976 APIF, motion carried 5 The Planning Commission discussed the form recommended by the City Administrator • for the proposed amendment to the zoning ordinance dealing with the provision of residential garages in relationship to. the set back and authorized him to recommend adoption of the ordinance amendment to the council. 6. THE CITY COUNCIL OF THE CITY OF FARMINGTON ORDAINS AS FOLLOWS: Section I. Title 10, Chapter 7, Section 1, paragraph I of the City Code entitled "Conservation District" is hereby amended by adding to and appropriately numbering under the column headed "special exceptions" the following: "Equipment Maintenance and Storage; Non-commercial" Section II. Title 10, Chapter 1, Section 3 of the City Code entitled "Definitions" is hereby amended by inserting alphabeti- cally the following: "Equipment Maintenance 4 Storage; Non-commerical: A building in which is exclusively maintained, repaired or stored, only equipment which is owned and used by the same individual, firm or organization -that owns, rents, leases .or occupies the building and in which no maintenance, repair or storage of equipment is performed for any other party or person.
