Councilmember Donnelly asked for clarification on the Clear Company HRM Subscriber Agreement. Human Resources Director Wendlandt explained the benefits of the applicant tracking software program. The benefits include staff time savings,efficiencies in the applicant review process, reporting benefits and more. Councilmember Bonar asked if other cities have experience with this software. Wendlandt shared that while no local cities use this software she has checked listed and other references and received positive results. Councilmember Pitcher asked about learning curves and demonstrations. Wendlandt shared that city staff has participated in product demonstrations and the results were positive. Motion by Donnelly, second by Bonar,to approve the Clear Company HRM Subscriber Agreement. AFIP, motion carried. Councilmember Bonar asked for staff comment on the bank stabilization grant. Engineer Schorzman explained the project and the grant that was received in the amount of$255,000. The city council thanked staff for their work and involvement on this project. Petitions, Requests and Communications Preliminary and Final Plats-This Little Piggy Catering Planning Manager Wippler reviewed the preliminary and final plats submitted by This Little Piggy Catering. The project is generally located on the east side of Trunk Highway 3 south of Happy Harry's Furniture. The preliminary and final plats combine two existing meets and bounds described parcels into a single lot while dedicating right-of-way for Trunk Highway 3. The roadway surfaces for 224th Street and the frontage road are not being dedicated as part of the plats but are located within drainage and utility easements. This is an existing recorded temporary public right-of-way easement for the portion of 224th Street that is within the property that was executed with the Twin Ponds development that is adjacent to the east. A condition of approval of the preliminary and final plats should be that a public right-of-way easement be executed and recorded for the frontage road. All other easements as show on the plats are acceptable to the city. On June 23, 2016 the Planning Commission recommended approval of the This Little Piggy Catering preliminary and final plats with certain conditions with a vote of 4-0. The applicant is proposing to construct an 18,102 square foot commercial building for their catering business on the property to be platted. The use of the proposed building will include office space,food preparation area as well as a banquet facility. July 5,2016 Minutes -2- R55=/‘ Motion by Pitcher, second by Bonar to adopt a resolution approving the preliminary and final plats for This Little Piggy Catering contingent upon the following: 1. The submittal of a Parking Lot and Landscape Surety acceptable to city staff. 2. The execution and recording of a public right-of-way easement for the frontage road. APIF, motion carried. The city council thanked the application for expanding their business in Farmington. Unfinished Business Position Reclassifications in the Police Department Human Resources Director Wendlandt reviewed the proposed position reclassifications in the police department. The proposal is the reclassify our two administrative support technicians to administrative support specialists. This issue was reviewed in detail with the city council at the June 13, 2016 work session. Staff apologized for this issue and made it clear that they will work to ensure it does not happen again. Administrator McKnight acknowledged that this was a staff issue and we will do a better job in communicating issues in the future. Motion by Donnelly, second by Bonar,to reclassify Amy Mailhot as an administrative support specialist effective May 1, 2016 and place her at B22 Step 1 of the non-union wage scale and reclassify Gina Wooten as an administrative support specialist effective May 3, 2016 and place her at B22 Step 1 of the non-union wage scale. APIF, motion carried. New Business Development Contract-Trident Development Engineer Schorzman presented the draft development agreement with Legacy Partners of Farmington, LLC(Trident). The developer is proposing a 70 unit senior housing project south of St. Michaels Catholic Church off of Denmark Avenue. Schorzman reviewed elements of the development agreement. The issue of trunk credits was discussed with the city council. Motion by Donnelly, second by Bonar,to approve the development agreement with Legacy Partners of Farmington, LLC for a 70 unit senior housing project. APIF, motion carried. Xcel Energy Encroachment Agreement July 5,2016 Minutes -3- Engineer Schorzman presented an encroachment agreement with Xcel Energy. This agreement is necessary for sewer and water lines to be extended across an existing easement that Xcel Energy has for the Trident development project. The agreement allows the city to build in the easement area and to use this area for city services. Motion by Bonar, second by Pitcher,to approve the encroachment agreement between the City of Farmington and Xcel Energy for the Trident senior housing project. APIF, motion carried. City Council Roundtable Pitcher-Encouraged residents to shop local whenever possible. McKnight-Reminded the city council that the July 18, 2016 meeting will be a joint meeting with the school board. Schorzman-Provided an updated on the Highway 3 project that is underway. Encouraged residents to check the MnDOT website for project updates and closure information. APIF, motion carried. Emerald Ash Borer Management Scenarios Engineer Schorzman and Natural Resources Specialist Dullum presented information on potential emerald ash borer management scenarios. Dullum reviewed tree inventories she has performed of the Dakota Estates and Nelson Hills neighborhoods. The inventories showed the condition of the ash trees in these two neighborhoods. Staff corrected the information in the memo in regards to the cost of treatment options available. The correct cost should have read $130,000 as an estimate for treatment costs. Dullum reviewed the option of removing trees one third at a time and potentially replacing them one third at a time as well. Staff estimated costs with this area to potentially include: • Poor Quality Trees Removal $196,000 • Treatment $130,000 • Removal and Replacement of All Trees $2,200,000 The city council asked a number of questions and as of now directed staff to work with other cities on a potential joint powers agreement on this issue,continue the three year approach to tree removal,take the necessary steps to adjust any city policies/ordinance to ensure that trees are not replaced in the boulevard, anticipate that the city council will support treatment of trees, complete the ash tree inventory and schedule some public input meetings at the appropriate time based on this potential approach. July 11,2016 Work Session Minutes -1- Draft 2017 Budget Finance Director Hanson presented the draft 2017 budgets for all city funds. The proposed increase for next year is a result of increased debt payments and increased human resources costs. The human resources cost increase for 2017 are a result of three additional positions added in 2016, increased costs for the four union contracts settled for 2017 and the proposed addition of a new position in the Information Technology Department in 2017. Expenditures outside of debt and human resources areas in all budgets are at or below 2016 levels. The use of local government aid dollars and the transfers out expenditures were reviewed with the city council. The city council asked questions in a number of areas including the IT budget and new proposed position, police budget adjustments for 2017, a possible fire inspector position, projected fiscal disparities amounts, compensated absences funding, and future funding of other areas the city council has noted as needing to be addressed in the future. City staff will bring back updated General Fund information and more detail on the IT Fund at the August 2016 work session. Debt Service Funds Levy The Debt Service Fund budget provides funding for scheduled debt principal and interest repayment obligations,as well as ongoing trustee, assessments, arbitrage and post-issuance compliance fees related to the City's debt.The levy is also used to continue to strengthen the cash flow for various debt issues as the City continues to work toward full compliance with the 105%funding requirement. July 11,2016 Work Session Minutes -2- The 2017 debt levy increase has been mitigated by the use of$100,000 in MSA funds. Special Revenue Funds EDA—The EDA budget includes a $40,000 transfer in from the General Fund. TIF—City Center—The City Center budget is blank, because the city intends to decertify this district in 2016. Park Improvement Fund—The Park Improvement Fund has planned expenditures in 2017 of $150,000 for Prairieview Park and is also the placeholder for$40,000 in planned liquor stores community investment transfers. Ice Arena—The ice arena budgets reflects the rate increase which went into effect July 1, 2016. Capital Projects Funds Road and Bridge Fund—The only planned disbursements are the operating transfers included on the operating transfers worksheet. Fire Capital Projects Fund—No planned vehicle purchases until 2019. In accordance with the Fire CIP money is being accumulated to pay cash for a new fire engine in 2019. General Capital Equipment Fund—Monies are transferred into this fund in accordance with the police vehicle, police equipment, and fire equipment CIP's. In addition $90,000 of LGA funds will be transferred into this fund for the Municipals Services Director to use to address vehicle needs until the city's comprehensive vehicle CIP begins in 2020. Maintenance Fund—The 2017 budget includes planned transfers for seal coating,trail maintenance, and building maintenance per their respective capital improvement plans. In addition the budget includes the receipt of MSA construction funds for the 195th Street project. A portion of these funds are being used to reduce the 2017 debt levy by$100,000.The remaining funds are being transferred back to the Storm Water Trunk Fund to repay the funds to be borrowed later this year to pay the county for the remainder of the 195th Street reconstruction project. There is also one new item.The city has cost sharing arrangements with the three townships for road maintenance.These costs do not occur on a regular basis.When they do occur they are large enough that the city needs to separately budget for them to ensure we have sufficient funds on hand that will not take away from other ongoing city street maintenance projects.The 2017 budget includes a$3,000 transfer from the General Fund into the new Township Road July 11, 2016 Work Session Minutes -3- Maintenance line item. In addition staff is recommending$10,000 of the MSA construction reimbursement funds be transferred into this fund for initial funding.This will help cover the cost of one request already received this year from one of the local townships for approximately$5,000 for road maintenance. Enterprise Funds Solid Waste—The human resource costs for the Municipal Services Coordinator and new shared position are charged to the Solid Waste fund.The Sewer, Storm Water and Water Funds benefit from these two positions.Accordingly,these funds will be transferring in$64,000 to help pay for these two positions. Water--The 2017 budget reflects a planned rate increase per the long-term Water Plan. Streetlight--The 2017 budget includes$35,000 for the continued transition to LED lights with Dakota Electric. Fund Balance Projections A worksheet has been included in your packet which details the actual fund balance for the past four years as well as projected 12/31/16 and 12/31/17 amounts. If all of the 2016 and 2017 revenue and expenditures were to occur as budgeted,the General Fund's 12/31/17 fund balance of$4,734,534 would drop below the city's 40%funding level target of$4,897,958 by$163,424. Tax Notes A brief history of the tax levy changes for the past five years are listed below: 2012 0.00% 2013 0.00% 2014 1.92% 2015 4.96% 2016 4.90% The residential homeowner's estimated market value (EMV)for next year increased from $214,737 to$223,029, an increase of 3.86%. The County estimates the market value for new construction in Farmington is$14.1 million. This translates to$157,386 in new tax capacity.Applying the city's 2016 tax rate to this amount would result in $93,188 of tax levy related to new construction. Based on the information available today,staff estimates the impact of a 4.94%increase on the July 11,2016 Work Session Minutes -4- average residential home with an estimated market value of$223,029 would be$52.71/year or$4.39/month. Additional Notes The proposed levy is 4.94%.This is less than the amount needed to fund ongoing equipment, vehicle and building maintenance needs.This is the amount council indicated was the maximum increase you could support and fits within the city's long-term financial plan. As you consider the budgets please keep the following in mind. 1.The attached budgets do not include the impact of the city's 2017 bond referendum. If question one passed,the estimated annual tax increase on a 2016 median value home of $212,787 for question one is$75.00 for 20 years. If both questions one and two are passed the estimated annual tax increase is$102 for 20 years. In addition annual operating costs, net of the currently budgeted pool subsidy of$72,000, are estimated to require an additional $115,000 in annual operating levy. 2.The attached budgets do not reflect any anticipated debt refundings.These refundings are not guaranteed and will not occur until after the preliminary levy is adopted. If the city is able to refund some of its debt later this year,the 2017 debt budget will be revised, accordingly. The city council thanked staff for their work and looks forward to continued review of the 2017 draft budgets. Councilmember Bartholomay left the meeting at 8:45 p.m. Police Department Organizational Study Police Chief Lindquist discussed his desire to perform an organizational study of the police department. Chief Lindquist would like to study the following items: 1. Efficiency of Manpower Use 2. Effectiveness of Manpower Use 3. Policy Review 4. Technology Review 5. Morale 6. Structure Councilmembers asked questions on the status of a number of department related items including strategic plans, call volumes, Blue in the Schools, and more. Administrator McKnight brought up the fact that no new officers have been hired in five years and if the study would help determine what this means. July 11, 2016 Work Session Minutes -5- City councilmembers were in support of continuing to look into this item. Lindquist and McKnight will flesh out the issues to be studied and obtain some quotes to get this work done. The issue will be brought back to the city council for action when appropriate. DISCUSSION El Charro Mexican Restaurant currently holds an on-sale liquor license for 2016. They are requesting an amendment to their license to include a fenced in area on the east side of 120 Elm Street. The entrance to this area would be through the door on the east side of the building. The seating area would be to the east and would include approximately eight to ten tables. Alcohol will be served in this area. Hours of operation for this area will be normal business hours of 11:00 a.m. to 11:00 p.m. BUDGET IMPACT No fee has been established for this type of license amendment. DISCUSSION Second Quarter Building Permit Information:During the second quarter of the 2016 building construction season(April 1st through June 30th),the City issued 25 new single-family detached housing. The average building valuation of the single-family homes during the second quarter of 2016 was $213,788, down from$218,420 during the first quarter of 2016. (Note that the valuation averages do not represent the average sale price or average market value of the homes in question, since they do not include the value of the lot or any amenities added to the home that are not part of the building code formula). Year-End Population Estimate: At the beginning of 2003, city staff decided that each quarterly building permit report should also include an updated population estimate for the City of Farmington. After discussing several methods of calculating population, a decision was made to base our population estimates on Certificates of Occupancy rather than upon building permits. Building permit activity is not a"real time"reflection of actual population, given the "lag time"between the issuance of the permit and the actual occupancy of the dwelling unit(ie., the time required to construct, market and sell the home). Accordingly, staff started with the City population as of April 1,2000(as determined by the U.S. Census Bureau)and then determined the number of Certificates of Occupancy[C.O.s] issued by the City since that date. The number of C.O.s is multiplied by 2.95,which was (according to the 2010 Census)the average number of occupants per Farmington dwelling unit. Under the various joint powers agreements the city is required to contribute funds to various road maintenance efforts. DISCUSSION In the past the city has not budgeted for these activities. Staff is recommending a transfer of$10,000 from the city's 2016 MSA construction funds be transferred into the newly created Maintenance Fund-Township Road Maintenance account. This will provide funds to pay for the request received this summer for one road maintenance project($5,000)and additional funds to put towards future requests. In addition staff has included a$3,000 transfer into this fund in 2017 and envisions similar annual requests in future budgets to provide additional funding for these recurring projects. BUDGET IMPACT $10,000 of MSA construction funds that would have otherwise been used to pay a portion of the remaining bill on the 195th street construction project will re-directed to the township road maintenance fund to provide seed money for this type of work. Future MSA construction reimbursement monies will be sufficient to cover the remaining cost of the 195th street project. DISCUSSION The timeline for the Recreational Facilities Referendum(Referendum)that has played out so far and will continue to play out up to the November 8, 2016 election is as follows: January 2016: City council determined it wanted the following parameters to be followed during the process of determining which recreational facilities the city council should consider for a possible referendum during the November 2016 election: • Determine and recommend up to $10 million in recreational facility construction • Include public input process through the creation of a Recreational Facilities Task Force(Task Force) • No land acquisition was to be part of the final recommendation • A final recommendation was to be made no later than at the May 2, 2016 city council meeting • After the final recommendation was made by the Task Force,the city council would determine if it wishes to have a General Obligation Bond Referendum by putting a recreational facilities ballot question on the November 8, 2016 election February—April 2016: City staff assembled a Task Force of community members. The Task Force consisted of 15 members. During these meetings,the Task Force started with approximately$22.5 million in recreational facility projects. As a group it was able to reduce this to an amount that the city council had set as the upper limit it wished to consider. The final recreational facility projects recommended to the city council for its consideration came in at just under$10 million. However as part of the Task Force's recommendation, it also included a second amount of just under$2.5 million worth of recreational facilities and would be paid from other funding sources, such as from youth sports organization, in order to provide the funding needed to finish some of the projects recommended in the just under$10 million amount.. Attached is Exhibit A, which includes a list of the recreational facility projects and costs the Task Force recommended to be funded through a Referendum and a list of the recreational facility projects and costs the Task Force recommended to be funded by other sources. May 2016: The city council accepted at its May 2, 2016 meeting, the Task Force's recommendations but delayed a decision on a Referendum until it had an opportunity to further study and discuss the recreational facility recommendations made by the Task Force. At its May 9, 2016 work session, the city council further discussed the recommendation made by the Task Force. The city council directed staff to bring back for its consideration at its next meeting two ballot questions for consideration. June 2016: At the June 6, 2016 city council meeting approval was given for two ballot questions. The first ballot question includes the recreational facilities recommended by the Task Force to be funded by a General Obligation Bond Referendum. The second ballot question includes the recreational facilities recommended by the Task Force that were to be funded by other sources. The two approved ballot questions are attached as Exhibit B. A list of the recreational facilities in Question One and Two with estimated construction costs are shown in Exhibit C. It is important to note that the recreational facilities in Question Two are dependent on Question One being approved. If Question One is not approved then the recreational facilities in Question Two are also not approved and cannot be constructed,because they are dependent on the recreational facilities in Question One being constructed first. If Question One is approved but Question Two is not approved, then only the recreational facilities in Question One will be constructed. If both Question One and Question Two are approved, then all of the recreational facilities in both questions will be constructed. August 2016: Information about the Referendum will be provided in the fall City News and Recreation Guide that will be mailed to households in August. September 2016: An informational newsletter will be direct mailed to all city of Farmington households providing important information about the Referendum. This mailing will occur during the last week of September. October 2016: Public information meetings about the Referendum are scheduled to occur as follows: 10:00 a.m., Wednesday, October 12, 2016 at the Rambling River Center 7:00 p.m.,Wednesday, October 19, 2016 at City Hall 7:00 p.m.,Wednesday, October 26, 2016 at the Central Maintenance Facility November 2016: Residents will vote on the ballot questions during the November 8, 2016 election,with the outcome of the vote determined after the polls close. BUDGET IMPACT The estimated annual tax increase on a 2016 median value home of$212,787 if question one is approved, is $75.00 for 20 years. If questions one and two are both approved,the estimated annual tax increase is $102 for 20 years.
